Resistance to 941 Grows ‏Especially Here in Coos County ~ Time to Rally

If you are unfortunate enough to have a TV, you have no doubt been hammered with Bloomberg purchased ads promoting the Prozanski/Hoyle gun owner registration law.
The ad features a former Portland Police Chief (and Bloomberg shill) spewing lies before a background of soft-focus child actors playing in a park.

Since the chief sponsors of the bill (Prozanski and Hoyle) are shameless liars, why shouldn't the ad be a collection of lies?

But why would they feel the need to dump millions into ads for a bill they have already passed? Is it because they are fearful that as people start finding out exactly how bad this bill is there will be a backlash?

Well there is a backlash and it's been building.

Today we received a
new county resolution opposing SB 941.  Douglas County has added itself to the growing list of Counties and Sheriffs going on record against SB 941. We thank the commissioners for their courage and for standing up to the attacks on their constituents.

Of course, the liars who supported this attack on your rights continue to claim that almost 90% of Oregonians are eager to have their privacy invaded, their safety compromised and their property tracked for future confiscation.  (
Except Val Hoyle who recently dropped the number to "almost 80%".)
With most counties on record opposing 941 and some saying they simply will not enforce it, it must be getting harder and harder for the Bloomberg stooges to trot out their fiction with a straight face.  But if you have unlimited funds you can at least run an endless series of ads.

With Douglas County on board, and
Lane County having also rejected SB 941, bill sponsor and chief gun grabber, Floyd Prozanski is in an uncomfortable position. You see, Prozanski's district covers parts of both Lane and Douglas Counties. That means that the commissions in both his counties have stood up to his lies and shady maneuvers.  But more importantly, it is those very commissioners who will be choosing Prozanski's replacement should he lose his recall election. 

The Recall Prozanski campaign is going strong and there is still time to sign the petition to send Floyd back to his day job "prosecuting" traffic tickets. If you live in his district, or know people who do,
please visit the recall website to sign a petition. And please consider any support you can give OFFPAC to fund this effort.

Meanwhile, in Coos County, pro-rights activists have bypassed their county commission, which refused to stand up for residents, and have placed a pro-Second Amendment ordinance on the ballot for the November election.  This is the kind of action that grass roots activists can take when their elected representatives are too cowardly or too lazy to act on their own.
This battle is far from over. The people are stepping up.  We have a long way to go, but with each passing day the resistance to the tyranny of the Bloomberg flunkies is growing.

Hey Folks, 

In the General Election of 2012, the citizens of Coos County passed a resolution opposing the planned 5,000-acre Bandon Marsh expansion by the USFWS.  Many of us contended that The Service was going to use federal, state, and nongovernmental agencies, to do a 17,000-acre expansion. 

 We were wrong.  The expansion is even larger.

 The following is the announcement from Oregon Department of Fish & Wildlife concerning possible Conservation Opportunity Areas in the state with maps showing the federal government’s progressive land grab in the Coquille Valley and beyond.  It will eventually affect every person living in Coos County…..Rob T.

We wanted to let you know that the statewide Conservation Opportunity Area (COA) map is now available, including the remaining ecoregions. Arty Rodriguez, ODFW GIS analyst, has put together an updated online interactive map you can view here:

As before, please circulate this link to your colleagues as you see fit. The technical mapping process is completed, but if you have outstanding questions or comments on the results, please let us know as soon as possible. After next Tuesday August 11th we will have limited ability to make changes as the Strategy workplan turns towards writing the explanatory information for each COA (their “Profiles”), and the final online formatting of the Strategy so that we can complete the update by the October 1 deadline for the U.S. Fish and Wildlife Service.

As a brief reminder of the COA update process: We talked about the COA update process at our May 27 meeting. At that time, Arty (with close assistance from The Nature Conservancy and the US Fish and Wildlife Service) had just completed the first computer output using 2015 datasets to model COA boundaries, and we were beginning ODFW Fish and Wildlife District Biologist review. After many review sessions with district biologists throughout Oregon, Arty ran another iteration of the computer model, and the ODFW Conservation Program reviewed the output in detail to finalize the map now available above. The 2015 computer model results; 2005 COAs; and several additional landscape prioritization datasets (ex: TNC Willamette Synthesis and Statewide Portfolio, ODFW Sage-Grouse Core Areas, OWEB Focused Investment Partnership (FIP) areas and Salmon Strongholds provided by ODFW Conservation & Recovery, CHAT Connectivity Zones) were used in this final process to complete the 2015 COA map now available above. The statewide map will be presented at Friday’s Fish and Wildlife Commission meeting in Salem.  

Some additional points about the COA update:
·         COAs are areas where we want to focus conservation efforts and funding, with an emphasis on helping Oregon’s private landowners. COA delineations are focused on Conservation Strategy Species and Habitats, and no COA is being selected for an individual species.
·         Clicking on COAs within the web map will bring up potential names for each COA. We are still working on names, and have posted a “working draft” list on Dropbox in case anyone has interest in taking a closer look.  
·         The 2005 COAs encompassed ~26% of the state of Oregon. The 2015 version now covers ~%35, which was our estimated maximum allowance for COA coverage.
·         We decided to remove Wilderness Areas from the final COA designations. For the Strategy reader, we can provide links to more information about Wilderness Areas, including mapped information through ODFW’s Compass mapping application. Wilderness Areas helped the desktop analysis identify large blocks of land managed for native habitats, and in many cases COAs are near the boundary of Wilderness Areas. However, it was confusing to try to keep the Wilderness Areas as part of the final COA boundaries. Other public lands are considered depending on the situation. We will explain the role and recommended use of COAs for the Strategy reader through the web application

Common Sense for Oregon

Picture this scenario: the year is 2017. Oregon’s economy has rebounded nicely from the Great Recession. More people are moving into the state, and more people – including business owners, farmers and families – are staying in the state. The unemployment rate is the lowest since the Great Depression. More money is entering the state’s coffers than ever before, as the new residents increase the money the state receives from income and property taxes.

This scenario would have been real today had the estate tax been abolished in Oregon in 2012 (the first time we approached the state with the idea). But this 2017 scenario is still a dream. Now the year is 2015, and there is good news: we still have time to move Oregon’s economy in a positive direction to make the 2017 dream become reality.

Oregon needs to start rewarding its residents – the ranchers, the farmers, the small business owners, the families – who already contribute money to the state in property and income taxes, among many other taxes, by stopping the double and triple taxation of the Oregon estate tax. We need to make sure no tax is imposed on any gift of property within a family.

It is generally agreed upon that Oregon’s economy was struck with a death blow by the Great Recession. And while the economy has been improving – ever so slightly – it is still not cured by the Great Recession. We believe the state continues to add another “death” blow to the Oregon economy by continuing the estate tax, also referred to as the “death” tax.

The estate tax is a tax imposed on your estate when you die. An estate includes cash, stocks, property, jewelry, etc. This is what is passed on to your spouse and family members. It is based on the value of the estate. You can think of it as a type of property tax that is imposed on your property when you die. Usually, there is a deduction level and the government imposes a tax on the value above the deduction. In Oregon, if all the property you leave at death $1 million or less your family does not have to pay a tax. But if the value of your estate is over $1 million your estate is going to have to pay a tax ranging from 10% to 16%.

Oregon’s total estate tax revenue in 2012 was $101.8 million which represented just 1.2% of the total state tax revenue. Economists projected that increased income taxes from new jobs created by eliminating the estate tax would offset the loss of estate taxes within five years. If the estate tax was eliminated in 2013, “44,500 new jobs would have been created. The personal income of state residents would be $2.4 billion higher.  The state income tax collection would exceed the average death taxes revenues.” (Fruits, Eric & Pozdena, Randall. Oregon’s Death Tax: An Impediment to Economic Growth, In-Migration, and Public Revenue). Today, the numbers remain relatively the same.

When new entrepreneurs see a tax-friendly state, they will be more willing to come to Oregon and create jobs. And economists still project that taxes imposed from the new jobs will more than make up the tax.

Many ranchers, farmers and family business owners find the value of their land, buildings, equipment and their own homes substantially exceed $1 million. So while the ranchers and farmers may be land rich, they are cash poor. These families are confronted to pay an Oregon estate tax every time a generation passes away.

We want to help all Oregonians – husbands, wives, domestic partners, great grandparents, grandparents, parents, children, grandchildren, great grandchildren, great uncles, great aunts, uncles, aunts, nephews, nieces, great nephews, great nieces, siblings, and cousins – to stay in our state. Each member of a family is important to our state and the health of our economy.  So if you are a family member, your support for our efforts is essential. We have been hearing from a lot of landowners recently on the Army Corps permitting process, mostly about the complexities and intricacies, and we are, ourselves, deep into the process - so I wanted to remind everyone about the public meeting to discuss the process this Wednesday (Aug 19) from 1-4pm, in Coquille, where you will have the chance to discuss your potential projects and get feedback from the Army Corps and other agencies and perhaps get some answers and/or direction. There will also be a public meeting on November 18 (same time & place) in case you can’t make it to Wednesday’s forum. The CWA is looking forward to working with affected landowners on the Lower Coquille in the coming months, and if you have questions/comments we would love to hear them. Program Manager, Dawn Weekly, will be there for the CWA.

From a Watchdog in Bandon:

I attended the Wednesday evening (8/19/2015) Mosquito Vector Control meeting.  Just as I thought, the USFWS is treating private property land for the AD mosquito.  See enclosed handout. Zone 1 is the marsh. Zone 2 is private property.  Now keep in mind that the land listed in the Zone 2 report is not all of the land being treated.  VDCI is investigating other land that is not listed. Oh and by the way, USFWS is not going to fund the mosquito treatment for the year 2016. I thought you would enjoy this. Wayne Miller

A Community Enhancement Plan (CEP), a concept and a document that covers Jordan Cove Energy fees in lieu of taxes, and more, that is proposed by the private company SCCF, will soon be before the Coos Bay city council for approval.


 

This is the same government body that apparently bought the Egyptian Theatre for about $400,000 and sold it for a dollar; that practically gave away the Hollering Place to a sovereign nation tribe and then apparently agreed to spend more than a $100,000 of the people’s money for improvements to the tribe property; that built a Hollering Place viewing area that nobody visits and now are building a nearby sidewalk to nowhere; that apparently paid almost $500,000 for a part of the Central Dock that has not returned anything on investment; who will soon seek a higher gasoline tax.  Now, they appear eager to accept an incomplete, not negotiated with or accepted by JCEP, CEP document that is intended to be legally binding on the parties for the next 20 years.

 The proposed CEP appears to be great for Canadian Veresen / JCEP, a company that will be making billions and who would not find a welcome mat elsewhere along the North America west coast; not so great for us citizen taxpayers.  Please read the CEP document at the Port web site.  I have six pages of comments and concerns; you may have more.     

Where are the CEP safeguards for the people?  Who will guarantee JCEP promises?  Why are we giving JCEP tens of millions of our tax dollars annually if they honor their contractual obligations and pay fees on time?  Why does the agreement say we are paying JCEP because they moved here?  Why are we giving an extra 15 years tax relief to JCEP?  Why should we agree to lose control of our government and our tax dollars?  Why are we permitting private companies SCCF and CCD Business Development Corp. to have control of tens, maybe hundreds, of millions of taxpayer’s money?  Shouldn’t a JCEP negotiated and agreed upon document be approved or rejected by the people?  Why does the document say JCEP will hire 50 and there is no obligation to hire “local” people?  And, much more.

Brief answer to your question.  Google Oregon Constitution, Article IX, Section 3a.  It's on the Internet.  Yes, in his letter to the World paper editor of 8 August, John Whitty who brought us the SCCF, stated that fuels taxes can be used for roads repair.  Can, with the legal meaning - to have permission.
In fact Whitty is correct, except that the Constitution wording is shall - with a legal meaning has a duty to or is required to.
But the Constitution permits the collected motor vehicle fuel and other motor vehicle related products tax moneies to used, in addition to roads repair, for other specific items such as retirement of bonds and certain administrative costs.

Hello Council & Friends, 
Hope you are enjoying the dog days of summer!  Many thanks to all those brave folks fighting fires on the front lines - stay safe!

We have a very timely and  interesting presentation for our upcoming Council meeting, Monday August 24th in The Owen Building, Coquille OR - speakers Dr. Jimmy Taylor and Vanessa Petro from Oregon State University will present: “Understanding Beaver in the Beaver State”.


We are excited to have these fine folks from Corvallis come down and talk to us about beavers - a species we all know and love - and their presentation will discuss how American beaver are often called ecosystem engineers and keystone species due to the positive effects their dams have on surrounding communities, but they are also are called nuisance species when their dam-building causes conflict with humans.   

The meeting starts at 7pm in Coquille, and the public is encouraged to attend! Bring friends and family, we’ll have snacks and let’s have a nice crowd for Jimmy & Vanessa to show them we appreciate their travel to our humble little burg. 

The Coquille Watershed Association is the subject of a wonderful article in tomorrow’s Coquille Valley Courant about our work over the last 20 years. Intrepid journalist Shelby Case spent time with us, learning about our efforts to improve fish habitat and working landscapes, and allowing us to ‘toot our own horn” about all that we (and you!) have done for the watershed over the past two decades. Pick up a copy of the Courant at the McKay’s in Coquille and Myrtle Point, or at Frazier’s in Coquille. If you can’t find a Courant nearby (request your local store carry it!),

Basically a group of four people made all the major decisions

It is helpful to let a bit of time pass before taking a look at what was and wasn’t accomplished during a Legislative Session.

While the majority party “talked” about jobs and the economy, it became quite clear the first priority was political payback. There were bills that gave clear wins to trial lawyers, public sector unions, anti-gun groups and environmental organizations. All one needs to do is take a look at campaign contributions to understand why these passed.

It was also interesting that the Roseburg Chamber of Commerce had a list of bills they supported and a list they opposed. None of the bills they supported passed and all but one of the bills they opposed did pass. So much for “jobs and the economy.”

However, there were some areas where I think we did some very good work. One was in the area of sexual violence and sexual predators. We put into place safe haven arrangements so that women who have been assaulted have a safe and confidential place to go if they feel they have been a victim. We also dealt with some internet issues that I had previously been unaware of and I found to be very disturbing. On the other side of the issue we put in place a pathway for young people to earn their way off of the sex offender registry. We did this with the understanding that occasionally young people do dumb things and maybe they shouldn’t be labeled for life for one mistake.

We also took the first step in unwinding the empire former Governor Kitzhaber was trying to create, and we accomplished this by eliminating the Oregon Education Investment Board. Kitzhaber’s long-range plan was to have education, health care and social services all in one place controlled by him. Hopefully we can now head in a different direction. We have a workgroup in place with the plan to bring forward a better administrative structure during the 2016 Legislative Session. It should also be noted we are on a pathway to get rid of Common Core Standards and the Smarter Balance Assessments. Our schools worked better when there was local control and it is time we moved back to that model.

My one personal disappointment is the mascot issue. During the 2014 Session legislation was passed creating a workgroup to come up with a solution (which we did), and instructing the State Board of Education to adopt the rule. The Board chose to ignore the law and not adopt the rule. We had legislation ready to go to reverse their decision, and even had the support of Governor Brown. Then the confederate flag issue came up and the Governor backed down. She told me she would find a way for the Board to do the right thing, but it hasn’t happened yet, so clearly that particular story is not done yet.

While each Legislature develops its own personality, this one was unique for a couple of reasons. First, the Democrats had a super majority in the Senate and were one vote short of a super majority in the House. Also we did have a change of Governor mid-stream, which further complicated things. What we found was basically a group of four people making all of the major decisions.

Hopefully we will do better next time around.

Letter to Editor:

On August 4th, 2015 Rob Taylor and Tom McKirgan submitted petitions to the Coos County Elections office. With the help from  supporters, the committee gathered more signatures than were required in order to place the full Willowa County version of the Second Amendment Preservation Ordinance on the November 2015 Coos County ballot. We feel very confident that it will pass, becoming unlawful for any person or corporation to infringe on the Second Amendment resulting in fines of $2,000 per person and $4,000 per corporation for each violation.

Additionally, we've began recall efforts against Coos County Commissioner John Sweet as a direct result of his adamant  refusal to support the U.S. Second Amendment by twice voting against a proposed single page resolution against the despotic SB941, despite public outrage, stating; "I don't feel comfortable voting other peoples consciences on this matter."

The Committee to Preserve the Second Amendment warned the commission that if they refused to honor their sworn oaths to the U.S. and Oregon Constitutions by not passing the single page resolution, that We The People would do it ourselves. Thankfully, ​the ordinance has the full support of Coos County Sheriff Craig Zanni.

In conclusion, this study at Hart Mountain National Antelope Refuge provides insight into how riparian systems
in sagebrush/bunchgrass ecosystems of the Great Basin can respond to the cessation of livestock grazing. Fourfold increases in willow and rushes, with bare soil decreasing to a tenth of what it was during the period of
cattle grazing, show just how much a system can change within only two decades of cattle removal. Hart Mountain presents a unique opportunity to assess passive restoration as a means to rehabilitate a landscape after decades of cattle grazing. The results are promising, and similar on sites with passive versus active restoration treatments such as burning or planting. Simply removing cattle from areas may be all that is required to restore many degraded riparian areas in the American West.

  To the good people of Coos County,

  ​The Committee to Preserve the Second Amendment has​an obligation to make it known that on February 17, 2015; Commissioner Bob Main proposed a resolution that would prevent county funds and resources to be used in enforcing the tyrannical and unconstitutional SB 941.

​(Visit Oregon Firearms Federation webpage for details)  It is the same so-called law that our honorable Sheriff Zanni will not enforce. ​
 
"All laws which are repugnant to the Constitution are null and void." - Marbury v Madison 1803.  See also the Supremacy Clause U.S. Constitution Article VI Clause 2.

The resolution had overwhelming citizens support but regardless,​Commissioner Sweet adamantly refused to vote in favor of it, quoting, "I don't feel comfortable voting other peoples conscience on this matter.”  The commission then scheduled a work session for May 13th​ to discuss it further​.

Commissioner Main and many resolution supporters were present for the work session but it was cancelled just two and a half hours beforehand because both Commissioners Sweet and Cribbins did not attend. 


  The very next day, Governor Brown signed SB 941 into law. 

  ​Draw your own conclusion, but one could surmise that our attempt to pass the resolution was intentionally sabotaged in order to allow the passage of SB 941.

  ​Obviously Commissioner Sweet does NOT honor his sworn oath to support and defend the U.S. or Oregon Constitutions.  Not only is this offensive and cowardly, it's downright illegal!  See Oath of Office U.S. Constitution Article VI Clause III and Oregon Constitution Article XV Section 3.

  ​Infuriated citizens ​decided to initiate a recall of Coos County Commissioner John Sweet which was then filed on July​7th. 

  ​It's truly sad to know that our forefathers used the rifle to do what he won’t even do with the pen. What an insult to their honor for what they and theirs sacrificed for all of us! ​

  Since he refuses to interpose tyranny and stand for our liberties, we the people must do it ourselves then remove him from office.

  ​ ​The right to keep and bear arms shall NOT be infringed~by anyone.
