Wallowa County Endorses Petition  to De-Federalize Oregon Lands 

ENTERPRISE, OR – September 18, 2012 

The Wallowa County Commission has endorsed a petition requesting the US Congress to return federal
land in Oregon to the counties of Oregon. 
 
The Petition To De-Federalize Oregon Lands is championed by Oregon citizens coalition named
Give Us Our Land Back.  The Petition may be viewed and signed on the Internet at ttp://giveuslourlandback.org 

The Petition asserts that the federal ownership of 53 percent of Oregon’s landbase is unconstitutional and has been detrimental to the local economy and environment. 

The Petition further asserts, “… sovereign control, full jurisdiction, and eminent domain by the People of Oregon
over the land and resources within its boundaries would be most likely to effect proper stewardship and the safety and happiness of the People of Oregon
…” 
Wallowa County Commissioner Paul Castilleja noted that in 1994 a Wallowa County initiative (# 32-1) passed by the voters affirmed the policy of the County that “federal” land ownership is unconstitutional.

Question: Shall the People of Wallowa County Recognize the Federal Government’s Lack of Authority to Possess Unconstitutionally Held Land in Wallowa County? 


Summary: Amendment 10 of the United States Constitution: The Powers not delegated to the United Sates by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People.A review of the Constitution and  the intent and concerns of the framers indicates that this document does not
contain any authorization for the Federal government to own, hold or exert its dominion over any public lands,
except for land for the erection of forts, arsenals, dock yards, and needful buildings.  

Yes votes were 2,483, no votes were 907. 

Commissioner Castilleja stated, “It is my opinion that the Constitution of United States is still the law of the land and should be held to its highest standards.” 

Give Us Our Land Back executive director Mike Dubrasich stated, “The justifications for transferring title of federal lands back to the counties are constitutional, pragmatic, and ethical. “The land rightfully belongs to the residents.  We can do a far better job of stewardship and resource conservation than any Washington DC bureaucracy.  It is the right thing to do.” 

A meeting to discuss the Petition and its implications is scheduled for Oct. 5th at 10am at the Wallowa Courthouse (Thornton Room), 101 S. River Street, Enterprise.County Commissioner Paul Castilleja and Mr. Dubrasich will be attending.  The interested public is invited.

Status: The U.S. Supreme Court issued an unanimous decision in favor of the Sacketts on March 21, 2012. The judgment is reversed and case is remanded back to the district court.

Summary: In an unanimous opinion, the Supreme Court rules that landowners have a right to direct, meaningful judicial review if the EPA effectively seizes control of their property by declaring it to be "wetlands."
The Court rules in favor of PLF clients Mike and Chantell Sackett, of Priest Lake, Idaho, who were told by EPA -- and by the Ninth Circuit -- that they could not get direct court review of EPA's claim that their two-thirds of an acre parcel is "wetlands" and that they must obey a detailed and instrusive EPA "compliance" order, or be hit with fines of up to $75,000 per day.

Dear SAOVA friends,

Members of Congress are returning home to campaign for the upcoming November election.  We know that the HSUS and its animal rights allies never stop lobbying for their agenda, but lately they have been working overtime. 

This past week HSUS secured 8 additional cosponsors for the PUPS bill (HR 835):

The total number of cosponsors now stands at 213.  As of this writing, there are still 32 cosponsors on the companion Senate bill, S707, with the most recent cosponsor added January 2012. 

The HSUS byline for PUPS is that the legislation will close a loophole in the AWA that allows thousands of
commercial breeders to go unregulated. HSUS also disingenuously tells members of Congress and the public that “the bill will not affect small breeders and hobby breeders … the bill is crafted to cover only large commercial breeding facilities.”

PUPS is NOT what bill supporters claim.  HSUS/ASPCA promote PUPS as reasonable, but examination of the bill easily shows it is unneeded, overarching in scope and will adversely affect dog sportsmen, responsible breeders, rescue organizations, hunting and field dog trainers, and working dog kennels.

Bill supporters justify the bill by pointing to known AWA violators described in the May 2010 Office of the Inspector General’s report.  Like the proposed APHIS rule, PUPS would overextend limited USDA/APHIS resources by regulating small, private kennels rather than concentrate on a solution to the cited problem.

PUPS is based on ownership of just ONE “breeding female dog” which is defined as an intact female
*4 months of age or older* and sales of 50 dogs or puppies per year regardless of age or whether they were bred by the seller.
 
PUPS changes the Animal  Welfare Act (AWA) and USDA responsibility forever by granting authority for federal regulation to extend beyond commercial dog businesses and into private homes.

PUPS sets precedent by mandating specific exercise requirements in private homes exceeding those currently required for laboratory animals.  Setting government controlled exercise standards lays the groundwork for
regulation of socialization and breeding standards and is an unwarranted federal intrusion into the private husbandry practices of dog breeders.   Agricultural organizations raised a loud alarm over the HSUS initiated Egg Products bill which would set cage sizes and standards, calling this a “farm takeover bill” that would open the door to government regulation of farming operations.   PUPS exercise mandate represents this same unreasonable level of government over-regulation and should be strongly opposed.

The upcoming election will decide many national policy issues that are at the forefront of conversation and current campaign speeches.   Sportsmen and dog breeders must make government overreach into our homes,

Hello Council & Friends,

 Thanks to everyone who attended the meeting last night, and thanks to Darren Mahr (OFRI) for his presentation on how forest management affects water quality & fish habitat.  We appreciate his patience and staying longer than planned to answer the many questions that arose.  The general agreement was that all of us,  and especially those that work the land, need to apply the best management practices possible to ensure the health of our forests and water quality.  We all share the responsibility to protect the watershed we live in. 
 
We discussed the new planning update & public comment period for the Bandon Marsh, and at the end of this email is the word from USFWS about the recent happenings and materials available to the public.  Let me know if you have any questions.

 I also had confirmation from Fran Capehart that the Coquille Riverwalk Trestle Dedication ceremony will be held on Tuesday, October 16th at 3pm.  Congratulations to Dennis Graham and all the folks that have been working
tirelessly on the project and for the completion of this phase!  There are walkway bricks available if you wish to support the Riverwalk and see your name in stone.  The bricks are $75 for an 8” x 8”, or $50 for an 8”x 4” – order forms are available at the Community Center on Fran’s office door.  There are other Riverwalk events coming up and I’ll be sure to let you know as soon as I hear about them.

 We also touched on the unique Baker Creek Fish Ladder project, and Jeff Jackson (ODFW) and Kristle have a meeting set up to discuss the project.  If you are interested in attending that meeting, please shoot me an email for the details.

 This Saturday is “Public Lands Day”, so get out and enjoy yourselves and maybe do a little something for your favorite park or hunting grounds!

Coos Bay, OR –Scott Roberts (R-Coos Bay), candidate for State Senator in District 5, has recently been endorsed by Oregon’s leading small business associations. A Photo Inquiry Into The Egyptian Theatre In Coos  Bay, Oregon
 
Over a million taxpayer dollars have been spent on  this theatre with many more millions planned to be spent on this
theatre.  All of this is being done as the theatre is literally sinking into the  ground. The theatre is pulling the sidewalk down with it. As it sinks,  the theatre is pushing down the foundation of a building right next to it. And,  the theatre is leaning into that same building right next to it. While  all of this is going on the City of Coos Bay and its Urban Renewal  Agency plan to RESTORE the theatre.
 
Is there no end to complete, absolute, fiscal  incompetence?

Attorney General James Buchal Rally in Grants Pass‏

Republican candidate for Attorney General James Buchal will attend a fly in meet-and-greet rally at the Grants Pass Airport in Merlin Sunday.  His arrival is scheduled for 4:30 p.m., the rally will begin at 4:00.

Come and hear Buchal's ideas on how State agencies regulating growth and development can be reined in.  He also has exciting ideas on how the State can help with out of control federal resource agencies.

This is a great candidate with great ideas and presenting a great opportunity.  Try to make it a point to be there.

The urban density Charlie Hales championed has arrived on Division Street. Why isn’t he celebrating?


Here is a sample of the article, but it shows how one mans plans are another mans problem.

It’s a curious  position for Hales. No one worked more fiercely than he did to push  dense development on Portland’s east side, and to pass the  no-parking-space requirement. His love of promoting streetcars won him  the nickname “Choo-Choo Charlie,” but he could just as rightly have been called “High-Density Hales.”
“Charlie was a  champion,” says former Commissioner Erik Sten, who voted for the zoning  change. “You have to see this in the context of a debate he was leading  about the need for more transit-friendly development: The harder you  make it for cars, the less people will drive.”

  And for good reason.   Increased housing density, less reliance on cars and creating a walkable city
have all been hallmarks of Portland’s smart approach to planning.

The new maps showing the 7 Priority Stages of conservation land that will be turned back to wetland have been completed. 

Combine the Winter Lake Project with the Bandon Marsh Expansion and it is over 15,000 acres. 

That is agricultural land that is currently producing over 5 million plus in revenue for the surrounding area.

UPDATE: on the Bandon Marsh expansion and the release of the CCP

Hey Everyone,

Here is some really good News.........
 
The USF&WS has finally released the Comprehensive Conservation Plan for the Bandon Marsh Refuge.   After
a quick review The Service has decided to convert only 700 acres back to marsh and not the planned 4500 acres.  
It looks like we won this battle.  
 
However, The Service is just lying low and waiting until they can acquire the pieces of property they want through other avenues.  They will just have third party interests purchase the land and hold it in perpetuity.  They are
waging a war of deception and attrition, so we must remain on guard.

Whereas: The Federal Reserve still refuses to give a full public accounting of the TRILLIONS in recent taxpayer-backed loans; and                    

Whereas:   Allowing the Fed to remain out of control and shrouded in secrecy clearly allows for abuse and the continued stealing of our tax dollars through inflation and unaccounted electronic bank "loans"; and

 Whereas:  The Federal Reserve's abuses lead to constant economic crises like the current housing crisis, international banking crisis, and the resulting chaos; and

  Local leaders balk as lawmaker seeks cuts to job creation fund 
  
An influential Portland-area legislator thinks local and regional governments are owed too much money from state income taxes collected as part of their economic development efforts. 

State Sen. Ginny Burdick, who represents  Southwest Portland and parts of Washington County, wants the 2013 Legislature to reconsider how the state repays cities, counties and special districts that waive their property taxes to
attract new jobs.  

The state has not made any such payments yet because of a possible legal glitch in the program created by the 2007 Oregon Legislature. Called Gain Share, it requires that 50 percent of the state income taxes generated by new jobs that qualify for the program be sent back to the local and regional governments.  
 
Burdick says the potential cost is more than the Legislature estimated, however. She believes the distribution formula should be recalculated.

UPDATE: The Committee for Citizen Involvement Meeting on September 11, 2012

Hey Everyone,

I want to thank all the people who took time out of their day to attend this non-meeting.  I believe a couple of
city councilors are manipulating this committee to control the outcome.  Since the “powers that be” realized
they tipped off the public to their actions they decided to change the
parameters of the committee’s mission.  
 

The  Bandon City Manager decided that the below Agenda items should not be the "purview" of the CCI and therefore the committee should not have a discussion.   In other words, he convinced the committee to  change the agenda items to fit the new parameters,  and that way the committee could avoid conducting the public forum on these subjects.    We were blocked out of the public input by administative procedure, which should be an example of why the county does not need a county Administrator.  However, to their credit, the committee, and Mrs. Hundhausen allowed the people in attendance to speak.   Thank You...
 
Agenda Items not in the PURVIEW of the CCI:  

6.3 Public Forum re: Johnson Creek Dam
6.4 Public Forum re: Enlarging Bandon Marsh
6.6 Grant Money for replacing street lights that fit the Lighting Ordinance

We stopped them from conducting the meeting the committee really wanted to have.  I agree that this is not in the purview of the CCI, but the committee made the action in the first place.   We have to be there anytime local governments become intrusive and this was the perfect example of a low-level committee grabbing for to much power.

Walking Westlake with Art!

Dear Friends,
 
This Thursday, September 13th, Art will be in town!  He will be walking the Westlake area and everyone is welcome to join him.  It starts at 11:00 AM, meeting at the Westlake/Dunes City Post Office, address is 82853 Lake Blvd.  Literature to hand out to residents will be provided.
 
Many thanks also to those who have been staffing the new Republican Office on 12th St.  It has been a huge success so far, with many people coming to get literature, sign, bumper stickers, etc.  In fact, we are all out of Romney/Ryan
yard signs already!  Pam will be in Eugene on Thursday to get more for the office.
