Oregon's economy concerns leaders

DeHart once owned several Salem gasoline stations, which he sold after the economic slowdown.

 “I just don’t see our leadership in Oregon doing any more than giving lip service to job creation,” DeHart said.

 Bill Conerly, a Portland economist and member of the Governor’s Council of Economic Advisers, said he couldn’t recall a time when there was such a wide dichotomy between the best case and worst case economic
forecasts.

We had a silent victory here today in Coos County. The Board of Commissioners unanimously passed the 2nd reading of the Urban Renewal amendment, which gives the people the chance to vote on any substantial changes to the county’s UR agency.   It is officially a law, taking effect 90 days from today’s date.  The voters have taken back control over a rouge agency and we did it through the Representative process, the way it is suppose to work.  
 
I want to Thank Dave Hunnicutt from Oregonians in Action, for his legal expertise and Randall O’Toole for his well thought out arguments against Tax Increment Financing.  Without them it would have been impossible to accomplish this task.  It has taken a considerable amount of effort to get this enacted and it is going to take even more to introduce and pass this type of legislation in Salem. 
 
We are hoping to find several State Representatives and Senators to sponsor the bill.

Oregon’s Urban Renewal Agency’s are going to bankrupt our cities and counties while draining the state coffers with the cost of backfill replacement for the schools.  It would be smart to work in unison.

Also, Nancy reports:  "I spent the day in Florence yesterday (Saturday) working the door to door campaign. The Democrats have a headquarters on 101 already open! The Western Lane  Republicans also have a flag waving, gathering at Duke Wells Wood furniture store (next to the Oregon Pacific Bank buildings) every  Saturday from now until the election. They are prepared to register voters.  There are lots of 'neat folks' at this event and Duke always has lots of Art's, Scott's, and my info and signs available. I guess it is an  outdoor Republican headquarters of sorts."

Dear Fellow Republicans,
 
We have a great opportunity to meet Knute Buehler, running for Secretary of State on

Friday, September 7th at Ocean Dunes Golf Links, with lunch starting at 11:30(reservations needed for lunch) with Knute starting his presentation at 12:00.  If you don't want to pay for the lunch you can just attend the meeting portion for free.  Afterwards, Knute will be at a public reception/coffee at the Bridgeport Market(under the new condos at the
port) on Bay street from 2:30-4:00pm.

Please come to this great event and bring your friends along!

Oops!  I forgot to mention the campaign office in the last email!
 
We are in the process of obtaining a Republican campaign office  with Highway visibility until after the elections.  We will determine  very soon when it will open and what we need to furnish the office.  We  also have a need for some more volunteers to staff it during business  hours.  We will make sure that there is enough literature, yard signs,  bumper stickers, etc. to stock the office.  Please let us know if you  are able to help!

The U.S. Fish and Wildlife Service is proposing that 838,000 acres near the U.S.-Mexico border be designated as critical habitat for jaguars. While a small section of the proposed zone is in New Mexico, most of the land is in
Southern Arizona, including the area of the proposed Rosemont Mine.


 The move was hailed by the environmental group that has long worked for jaguar protection.  "Jaguars once roamed across the United States, from California to Louisiana, but have been virtually extinct here since the 1950s," said Kierán Suckling, Executive Director of the Tucson-based Center for Biological Diversity, which sued to push a recovery plan for jaguars.  


The  agency is set to publish its findings in the Federal Register on Monday, said spokesman Jeff Humphrey, which will trigger a 60-day public comment period.  The proposed critical habitat—outlined in a 126-page document—will help protect the jaguar, which was declared an endangered species in 1997, from extinction, Humphrey said. 


While there have only been "a handful of jaguars seen (in Southern Arizona) in 50 years ... they are elusive cats," Humphrey said. There have been three confirmed jaguar sightings in the last five years, he said.  Jaguar habitat extends through Mexico into Central and South America.

Home Rule Charter is officially on the ballot

To All --
 
    The "Voice of the Voters" Coos County  Home Rule Charter is officially on the ballot!!  It is Measure 6-143.   The "6" denotes it as a Coos County measure.  Thanks for everything  to date -- that's how we got here!
 
    The main activities in the next coming weeks  are fund raising and education.
 
    We'll need money for radio and newspaper ads,  yard signs and bumper stickers, and possibly a mail-out.  We're  setting up more public meetings.  Letters to the Editors and messages on  the blogs would be great.  10 weeks wraps it up!

Americans for Prosperity Presents the Panal on the Home Rule Charter

Dear All of You --
 
    Americans for Prosperity have invited us to do  our Home Rule presentation - the thirty minute version - on October 11th, 2012  Thursday, at the ESD building on Teakwood at Koosbay in Coos Bay.  They  sell sandwiches
starting at 5:30, the meeting starts at 6:00.  Usually they  start with their "business" followed after by people or groups presenting.   Art Robinson is scheduled to be there so the turnout shoud be pretty  respectable.
 
    This is about one week before the ballots are  mailed out.  This is also one day after our Red Lion performance on October  10th.  Can everybody make it?
 
    72 days to our victory party!
 
PS:  WE NEED LETTERS TO THE EDITORS AND RESPONSES ON  BLOGS.  LEAN ON YOUR FRIENDS.  IT DOESN'T NEED TO BE LONG!  JUST  POSITIVE.  WE CAN DO THIS.

The Committee to Keep the Lights ON in Bandon will be having a public meeting to discuss the reasons to repeal Bandon City Lighting Ordinance 1594.  Anyone interested in learning about this new law is welcome to
attend.  The meeting will start at 11:00 am on Saturday, August 25th, 2012 in the small conference room at the
Bandon Library.  The Library is located in the Bandon Park next to the Sprague Theater.  
 
After the meeting, the group plans to go door-to-door to gather more signatures. Only registered voters living inside the Bandon city limits are eligible to sign the petition, but almost anybody can gather signatures from city
  residents.  All interested parties are encouraged to volunteer.  There has to be 179 verifiable signatures turned in by September 5th before  the city can place the measure on the ballot, and then the voters can decide if there is a need for more lighting regulations.  
 
The ordinance adds 5 pages of new regulations to the City Code, which can, and will be, subjectively enforced.  The US Fish & Wildlife Service is one of several national and international organizations promoting this statute, which means outside sources are influencing local law.  Now the citizens of Bandon can face fines for outdoor lighting originating from their property appearing to shine on the Bandon Marsh National Wildlife Refuge,
which is one of several protected habitats specifically listed in this local ordinance.  
  
The most important piece missing in this verbose ordinance are the RIGHTS of property owners, not to mention that it was passed without the measure going to the electorate.  This issue concerns the right of the individual to choose how best to protect their own property and how to provide for their own safety and comfort.

Here is the Title, The Question and The Summary the way it will appear on the Ballot:
 
BALLOT TITLE – Measure 1202
Ballot Title: Ordinance adding outdoor lighting regulations to the Bandon Municipal Code.
Question: Should the City of Bandon Municipal Code be amended to include outdoor lighting
regulations?


Summary: This is a referral of Ordinance No. 1594 of the Mayor and City Council of the City of
Bandon amending the Bandon Municipal Code to include outdoor lighting regulations. Ordinance No. 1594 regulates the use of outdoor lighting in all zones and requires that all exterior lighting installed after the effective date of the ordinance be full cut-off fixtures with some exceptions. Full cut-off fixtures are defined as fixtures, as installed, that are designed or shielded in such a manner that all light rays emitted by the fixtures, either directly from the lamps or indirectly from the fixture, are projected below a horizontal plane running through the lowest point on the fixture where light is emitted.  Full cut-off fixtures include recessed lighting. Arial lasers, searchlights and temporary or permanent lighting that is installed inside of a building but intended to illuminate outside is
  prohibited from being used or installed except as allowed by a special use permit.  Violations of the
ordinance are remedied by an abatement process.

IN THE HOUSE OF REPRESENTATIVES

Mr. PAUL (for himself, Mr. BROUN of Georgia, and Mr. HANNA) introduced the
following bill; which was referred to the Committee on Energy and Commerce
 
A BILL
To allow the importation, distribution, and sale of investigational drugs and devices intended for use by terminally ill patients who execute an informed consent document. 

      Be it enacted by the Senate and House of Representatives of the United
    States of America in Congress assembled,




SECTION 1. SHORT TITLE.
     This Act may be cited as the ‘Compassionate Freedom of Choice Act of
    2012’.



SEC. 2. DRUGS AND DEVICES FOR USE BY TERMINALLY ILL PATIENTS.
    The Federal Food, Drug, and Cosmetic Act is amended by inserting after
    section 561 (21 U.S.C. 360bbb) the following:


 ‘SEC. 561A. DRUGS AND DEVICES FOR USE BY TERMINALLY ILL PATIENTS.
    ‘(a) In General- Nothing in this Act or section 351 of the Public Health
    Service Act prevents or restricts, and the Food and Drug Administration shall
    not implement or enforce any provision of law preventing or restricting, the
    importation, distribution, or sale of an investigational drug or device intended
    for use by a terminally ill patient in accordance with subsection (b).


    ‘(b) Patient Requirements- In order for an investigational drug or device to
    be intended for use in accordance with this subsection, such drug or device must
    be intended for use by a patient who has-- 

      ‘(1) been diagnosed with a terminal illness by a licensed physician;


      ‘(2) been informed by a licensed physician that no drug or device that is
      lawfully marketed in the United States is likely to cure the illness; and


      ‘(3) executed a written informed consent document that states--
       

        ‘(A) the known and potential risks and benefits of such drug or device;
        and


        ‘(B) any indications of the illness for which a drug or device is lawfully
        marketed, or for which treatment is otherwise available, in the United
        States.


    ‘(c) Prohibition on Requiring the Disclosure, Collection, and Reporting of
    Certain Information by Food and Drug Administration-



      ‘(1) IN GENERAL- The Commissioner of Food and Drugs may not require the
      disclosure, collection, or reporting of--



        ‘(A) any information related to the delivery, administration, or use of an
        investigational drug or device pursuant to this section; or


        ‘(B) any information related to the clinical outcomes experienced by a
        terminally ill patient supplied an investigational drug or device pursuant to
        this section.


      ‘(2) EXCEPTION- Nothing in this subsection prevents the sponsor of a clinical
      trial from voluntarily disclosing, collecting, or reporting information to the
      Food and Drug Administration.


    ‘(d) Definition of Investigational Drug or Device- In this section, the term
    ‘investigational drug or device’ means a drug or device that--



      ‘(1) has not yet been approved, licensed, or cleared for commercial distribution under section 505, 510(k), or 515 of this Act or section 351 of the Public Health Service Act (42 U.S.C. 262), and cannot otherwise be lawfully marketed in the United States; and


      ‘(2) is or has been the subject of one or more clinical trials.’.

The ordinance adds 5 pages of new regulations to the City Code, which can, and will be, subjectively enforced.  The US Fish & Wildlife Service is one of many national and international organizations promoting this statute, which means outside sources are influencing local law.   Now the citizens of Bandon can face fines for outdoor lighting originating from their property appearing to shine on the Bandon Marsh National Wildlife Refuge, which is one of several protected habitats specifically listed in this local ordinance.  
  
The most important piece missing in this verbose ordinance are the RIGHTS of property owners, not to mention that it was passed without the measure going to the electorate.  This issue concerns the right of the individual to choose how best to protect their own property and how to provide for their own safety and comfort.

BALLOT TITLE – Measure 1202

 Ballot Title: Ordinance adding outdoor lighting regulations to the Bandon Municipal Code.

Question: Should the City of Bandon Municipal Code be amended to include outdoor lighting regulations?

Summary:
This is a referral of Ordinance No. 1594 of the Mayor and City Council of the City of Bandon amending the Bandon Municipal Code to include outdoor lighting regulations. Ordinance No. 1594 regulates the use of outdoor lighting in all zones and requires that all exterior lighting installed after the effective date of the ordinance be full cut-off fixtures with some exceptions. Full cut-off fixtures are defined as fixtures, as installed, that are designed or shielded in such a manner that all light rays emitted by the fixtures, either directly from the lamps or indirectly from the fixture, are projected below a horizontal plane running through the lowest point on the fixture where light is emitted.  Full cut-off fixtures include recessed lighting. Arial lasers, searchlights and temporary or permanent lighting that is installed inside of a building but intended to illuminate outside is  prohibited from being used or installed except as allowed by a special use  permit.  Violations of the ordinance are remedied by an abatement process.

With today’s news about a group of Republican leaders’ latest lapse in judgment, it reminded me of an argument I had back in the 90s when the Clinton scandal broke regarding Monica Lewinski.  My point boiled down to this: leaders,
especially ones in public office, can either have a positive impact or a corrupting one, because those observing might say “After all, if he can do it, so can I”.

Let’s imagine if Clinton had said, “What I did was wrong, I’ve violated a sacred trust with my wife and have opened
this office to potential manipulation. So to protect the integrity of the office, I’m taking responsibility for my actions.” Wow.  Rather than worrying about defining “is”, what a huge change that might have brought to our culture,
especially our political culture.  How are leaders supposed to respond in the wake of these kinds of scandals?  We discuss that and much more tomorrow 11:00 to noon.

POCATELLO, ID (June 13)--The BlueRibbon Coalition (BRC) today strongly criticized a U.S. Forest Service proposal to exempt major ground disturbing activities from environmental analysis and public comment.

 The U.S. Forest Service (USFS) today began accepting public comment on a proposed change in regulations that would allow certain activities,  including road obliteration, to be exempt from any public comment or analysis
under the National Environmental Policy Act (NEPA).

The proposed rule would allow the agency to bypass normal environmental review for projects that remove, replace or modify water control structures and remove debris and sediment after natural or human-caused events including
floods, hurricanes and tornadoes. The rule would also exempt road decommissioning efforts such, as stabilizing slopes, restoring vegetation, blocking the entrance to the road, installing waterbars and removing culverts.

 However, the proposal would also exempt major ground disturbing activities such as completely eliminating the road bed by restoring natural contours and slopes.

 "Some of the agency's recommendations make sense, but as usual, they go too far," said Brian Hawthorne, Public Lands Policy Director for BRC. Hawthorne said, "If 40 years of NEPA has taught us anything it is that noble intentions
don't justify half-baked analysis. A bulldozer moving dirt is a bulldozer moving dirt. Environmental impacts don't magically disappear because the source of sediment is called a restoration project." 

"This borderlines on willful mismanagement," said Greg Mumm, BRC's Executive Director. "The Forest Service is sitting on 20 to 40 million acres of beetle-killed fire hazard and the fuse is lit. Their priorities are out of whack." Mumm said.

 As an example, Mumm said that just in Colorado some 6.6 million acres are affected by the mountain bark beetle epidemic. The agency  estimates that, over the next 10 years, an average of 100,000 trees will fall daily. Visitors to USFS lands are affected not only by the visual impacts, falling trees pose serious risk to human life and the infrastructure our rural  communities rely on. Dead trees across the state have created heavy fuel loading
which can result in intense, so-called "fatal wildfires." Beetle-killed trees now threaten thousands of miles of roads, trails and developed recreation sites.  Mumm said; "Exempting culvert removal is all well and good, but the agency
crosses a line when, at the same time, they increase analysis on such things as maintaining safe power transmission corridors."

 Hawthorne also expressed frustration with the proposed changes. He noted that the USFS is saying the majority of issues associated with road and trail decommissioning arise from the initial decision whether to close a road or trail
via the travel planning process. "That's not our experience," Hawthorne said.  BRC has been urging the USFS to develop a streamlined procedure to allow public comment before any ground disturbing or road obliteration activities are proposed precisely because the travel planning is usually focused on recreational users of the Forest. Other users are often assured their access and activities could still continue under stipulations of their permit, lease or other agreement.

 Hawthorne said few, if any, USFS travel planning projects get it right the first time. "Many travel planning projects we are aware of have been amended within one or two years after completion, and many have been amended even before the plan has been completely implemented on the ground." It is quite likely that routes proposed for decommissioning will be necessary additions in future recreation and travel planning. Hawthorne said the fact the agency doesn't want any public involvement means the agency probably doesn't care about any potential recreational uses of these routes.

The Bandon city council passed a very restrictive lighting ordinance on Monday August 6, 2012 and several of us residents have filed a Referendum Petition on this measure.  The group, “The Committee to Keep the Lights ON in Bandon” will be gathering signatures until the 5th of September and we need your help.

We need you to sign the petition.

We need people to gather more signatures.

We need businesses to sponsor a petition site.

We need help from our fellow citizens.

IMPORTANT:
Time is of the essence, so we have to get started NOW! 
Please join us in the fight against the local intrusion onto our private property.  This is a matter of safety and comfort and your right to choose what’s best for your home.  Technology will improve existing lighting fixtures and these products will become more efficient on their own and with better quality, without the force of more government regulation.  
 
The Bandon outdoor lighting ordinance, Ordinance 1594, gives the authority for city officials to determine what type of lighting fixtures can be used on your property.  This law will give the city the right to fine people arbitrarily, or because neighbors have a grudge.  You could pay a fine if your property has lighting that faces the forest or the
  beach or if it can be seen.   These new local regulations will add 5 new pages to the City Code and the cities analisys of the fiscal impact is officially“Undetermined.”  The recommendation by the City Manager to the city council was to adopt Ordinance No. 1594.  Do we need more bureaucracy and government control?

The law should be suspect since it is promoted by the US Fish & Wildlife Service, which is the same agency involved with the Bandon marsh expansion.  No federal agency should be influencing local law and the public should worry when they do.  The other non-governmental agency involved is the International Dark –Sky Association www.darksky.org, which has an environmental extremist agenda. I like wildlife, but this law goes too far in the name of protectionism over the free choices of the individual.  The environment will be saved through education and advancement, not administrative intervention.
