Challenging rampant abuse of the ESA to impose federal zoning


Federal bureaucrats are twisting environmental and emergency management law to impose federal zoning control over Oregon’s coastal regions and much of the rest of the state. In order to be eligible for federal flood insurance, local communities are being told to abstain from economic development.


What’s at stake?
  • The federal government is twisting environmental and emergency management law to impose federal zoning control over Oregon’s coastal regions and much of the rest of the state.
  • The issue is a bureaucratic power play: In order to be eligible for federal flood insurance, local communities would have to abstain from economic development—purportedly to protect certain endangered species, even though, as a matter of law, FEMA and its flood insurance program have no impact on species whatsoever.

Case Overview

Town of Coos Bay, Oregon v. National Marine Fisheries Service
In 2016, the National Marine Fisheries Service issued a biological opinion for the Oregon flood insurance program established by the Federal Emergency Management Agency (FEMA). The opinion imposes significant land-use restrictions on floodplain development. We argue that the opinion is contrary to law because FEMA’s insurance program is not legally responsible for any harm to species that floodplain development may cause.

The National Flood Insurance Act of 1968 authorizes FEMA to issue flood insurance to local communities.  The agency provides such insurance once a community has adopted “comprehensive criteria for land management and use,” as well as “adequate land use and control measures (with effective provisions)”.  These criteria and measures must take into account environmental concerns.

An agency must consult under the Endangered Species Act whenever its discretionary action “may affect” listed species or their critical habitat. When the affected species are within the jurisdiction of the National Marine Fisheries Service, that agency issues a “biological opinion,” which details the effects of the proposed action and suggests a reasonable and prudent alternative to the original action, if the Service determines that the action as proposed would jeopardize the continued existence of any listed species or destroy or adversely modify its critical habitat.

In 2009, a coalition of environmental groups sued FEMA for its failure to consult over the Oregon flood insurance program. The agency quickly settled, agreeing to request consultation from the Service on the program. In 2016, the Service obliged.  The agency’s biological opinion determines that the program—which as of 2015 included over 32,000 insurance policies—would jeopardize a number of aquatic species. The biological opinion’s rationale depends entirely on attributing the effects of floodplain development to the program. The document contains a reasonable and prudent alternative requiring draconian land-use restrictions. Consequently, Oregon local governments must dramatically restrict development in or near floodplains in order to obtain FEMA flood insurance.

PLF argues that the biological opinion is contrary to law because FEMA’s flood insurance program is not the legal cause of any impact to protected species or their habitat. Rather, it is the legal cause only of the flood insurance program and its attendant policies. Put another way, the development that may be incentivized by the program’s flood insurance is not caused by FEMA but rather by the various land-use agencies that have authority to control such development.

NOAA is asking for your opinion on their new plan and now would be the perfect time to give it to them.  Please tell the officials at NOAA what you think of more regulations on using the country's natural waters.  Remember, this is the agency that was going to ignore over a dozen local resolutions opposing a marine sanctuary off the coast of Oregon and force us to except their designation.  Please tell them what you think by April 30th, 2017.....Rob T.

Titled Our Vision for America’s Treasured Ocean Places: A Five-Year Strategy for the National Marine Sanctuary System, the plan plots a five-year course for managing some of the nation’s most amazing ocean and Great Lakes places.

The draft document does not catalog everything we do but addresses four principal needs:
  1. To convey to the American public our priorities over the next five years;
  2. To enhance focus and inspire our staff;
  3. To affirm our core values as an organization; and
  4. To deliver on NOAA’s responsibilities as stewards of nationally significant ocean places.

We are committed to having our team, partners, policy makers and the public recognize the goals set out in the final document and, more importantly, their role in helping to achieve them. We look forward to hearing your thoughts on the draft proposal as we work to finalize it in the coming months.

Once finalized, this document will be our roadmap for the next five years, culminating in 2022 with our 50th anniversary.  The draft plan, “Our Vision for America’s Treasured Ocean Places,” is available at http://sanctuaries.noaa.gov/about/five-year-strategy-draft.html.  

We are soliciting public input on the draft document through April 30, 2017. While we are not required to solicit public comment under government legislation or law, public involvement in national marine sanctuaries’ management is a longstanding core value that we seek to uphold at every opportunity.

Pacific Legal Foundation Fighting Against FORCED Mitigation on Private Property

Hey Folks,

In the following press release from the Pacific Legal Foundation it discusses the practice of FORCED mitigation.  What should be of interest to the people of Coos County is that the attorney involved in this important case was the same attorney who was going to represent the people of Coos County in the lawsuit against the USFWS, Mr. Anthony Francois.  

 
Of course, the City Council of Bandon and two of the three County Commissioners, Mellissa Cribbins and John Sweet betrayed the people of Coos County when they decide not to stand up against the USFWS and defend the people of the Coquille Valley from the Bandon Marsh mosquito infestation. 
 
In other words, the following story should be the Bandon marsh expansion story, but the citizens of Coos County can thank the spineless representatives on the County Board of Commissioners and the Bandon City Council for kowtowing to the feds.  Now, the property owners in the county are at the mercy of these federal agencies…..Rob T.

Status: An adverse decision was issued by the Court on August 10, 2015. Motion for reconsideration was denied on September 3, 2015; a petition for review was filed on September 18, 2015. PLF filed a cross-petition for review on October 2, 2015. The petition for review was denied February 9, 2016. Petition for certiorari will be filed on or before May 10, 2016.

Summary:
San Juan County, Washington, requires shoreline property owners who want permission to build to dedicate large parts of their land as water quality buffers to filter pollutants that come from other parcels in the watershed.  But the county uses an excessive one-size-fits-all formula that takes too much land, with no parcel-specific determination of how much area is needed to filter water that starts on the shoreline parcel, as opposed to serving the public purpose of filtering all of the neighbors’ water run-off.

PLF is representing the grassroots property rights organization Common Sense Alliance in asking the Supreme Court of the United States to require that San Juan County prove that its buffer ordinance takes no more property than is necessary to mitigate the building impacts of the property owners.

Bandon Changes the Revered Day of Infamy to Trash Art Day

Last month, the city of Bandon enacted the following proclamation to declare December 7, as Washed Ashore Day. 
 
What was the Mayor thinking?
 
The Day of Infamy is now Trash Art Day.  Washed Ashore supports designating half the pacific as a National Marine Sanctuary and this “nonprofit” received money in the form of a grant from NOAA.
 
Way to go, maybe on Veterans Day the city council can proclaim it Bandon Marsh Mosquito Day.   It seems fitting since the Mayor conspirers with The USFWS.     
 
The Mayor and Councilors are selling heritage to purchase the support of special interest, again…..Rob T.  
The following is the Mayor’s reply. 
Rob. That was one specific day . . . the day of the city council meeting. It was a one day proclamation, to honor them for having been chosen for the TV show. It has nothing to do with any perpetual, ongoing honor, and you know that as well as I do. It was that specific date because our council meeting happened to fall on Dec. 7. I am sure our administrative assistant never gave it a second thought because proclamations are always dated on the day of the council meeting. Sorry if it fell on Dec. 7.
And, if a council meeting falls on Veterans Day, and someone asks us for a proclamation, one may well be signed on that day.

OMRP Completes Marine Reserve Interpretive Panels for Oregon's South Coast 

Collaborating with community members, partners, and Lodestar Studio, Inc., the Oregon Marine Reserves Partnership just completed designing interpretive panels for the Redfish Rocks Marine Reserve in Port Orford and the Cape Perpetua Marine Reserve at both Sea Lion Caves in Florence and Siuslaw National Forest sites along Highway 101. Production of these signs completes the first of three phases of marine reserve interpretive panels for the coast of Oregon. Installation of all 14 signs will occur within the next several months, in time for the spring tourist season along the coast.

The Redfish Rocks interpretive panels take visitors on an underwater journey from the shore of the Redfish Rocks Marine Reserve to the base of Redfish Rocks, discovering the marine fish and animals that call those habitats home. The panels also featured the important role of community fishermen, research at the reserves, and the abundant fish and wildlife resources found in the reserve.

Sea Lion Caves panels focused on the "Legacy of Protection," the story of Sea Lion Caves and the long-term stewardship of the site by private landowners. In addition, upwelling, Stellar sea lions, and research at the caves were featured on the panels.

Siuslaw National Forest panels feature the 41 square mile Cape Perpetua Marine Reserve, including the critical "Land-Sea Connection," the Globally Important Bird Areas (e.g., Heceta Banks) that attract birds from all over the world, the hundreds of species that call this marine reserve home, and the "Giants of the Land and Sea," - the whales and Sitka spruce that define the marine and terrestrial ecosystems of Cape Perpetua.

Hey Folks,

The following is the NOAA draft proposal for the area including the south coast for your reading pleasure.  For those on Johnson and Two-Mile there is even a special section.  These proposed rules will affect not only agriculture, but also timberlands. 
 
Currently ODF is considering extended riparian buffer rules.  Several of you may wonder why you should be concerned.  The new regulations will affect some operations in what NOAA deems "no kill" of beavers rule included in the proposal.

This week the Committee introduced the “Protecting America’s Recreation and Conservation (PARC) Act,” which includes sweeping reforms to update the Land and Water Conservation Fund (LWCF). Enacted more than 50 years ago, LWCF has transformed into a special interest slush fund with a lopsided funding ratio. Learn more below.

Earlier this week, The Wall Street Journal editorial board published an article about the breakdown of the LWCF, revealing that funds are used for eminent domain projects. The editorial board posed that “Useful updates would include mandating that more spending go toward states, as well as freeing up cash for chipping away at the upkeep backlog and banning the seizure of property. Notice of Intent to Initiate a Management Plan Review for Monterey Bay National Marine Sanctuary

In accordance with the National Marine Sanctuaries Act, NOAA is initiating a review of the management plan for Monterey Bay National Marine Sanctuary (MBNMS), located off the Central California coast, to evaluate progress toward implementing the goals for the sanctuary, and to make changes to the plan and regulations as necessary.  NOAA is asking the public and stakeholders for comments on this upcoming management plan review for MBNMS.  Members of the public are invited to submit comments now through October 30.

The current management plan was completed in 2008.  Preliminary priority topics for the management plan review are: climate change, wildlife disturbance, water quality protection and marine debris. NOAA is interested in public comment on these topics, as well as any other topics of interest to the public or other agencies in the context of this management plan review. NOAA is also requesting public comment on potential regulatory changes aimed at better protecting the marine living resources and maritime heritage of MBNMS.  NOAA will conduct public scoping meetings to gather information and other comments from individuals, organizations, tribes, and government agencies.  Scoping meetings will be held on: (1) September 10, 6-8 p.m., Monterey Conference Center, Monterey, CA(2) September 23, 6-8 p.m., Louden Nelson Center, Santa Cruz, CA(3) October 23, 6-8 p.m., Veteran's Memorial Hall, Cambria, CA

We have been hearing from a lot of landowners recently on the Army Corps permitting process, mostly about the complexities and intricacies, and we are, ourselves, deep into the process - so I wanted to remind everyone about the public meeting to discuss the process this Wednesday (Aug 19) from 1-4pm, in Coquille, where you will have the chance to discuss your potential projects and get feedback from the Army Corps and other agencies and perhaps get some answers and/or direction. There will also be a public meeting on November 18 (same time & place) in case you can’t make it to Wednesday’s forum. The CWA is looking forward to working with affected landowners on the Lower Coquille in the coming months, and if you have questions/comments we would love to hear them. Program Manager, Dawn Weekly, will be there for the CWA.

Attached please find our application submitted to the WRCA for the Coquille Watershed Action Plan 3.0. A hearty thanks to those that were able to get us letters of support so quickly, if you would like to send one to include with OWEB’s application, we’ll plan to submit that on April 17.

It would be very exciting and timely if we are able to get this project off the ground, combined with the recently completed South Fork Action Plan and possible future update to the Coquille Tribe’s Sub-basin Plan, we will have a complete overview of the watershed’s conditions and strong backing for funding restoration projects, bringing money and work to our communities and wonderful habitat for our fish to return to!

State Representative Carl Wilson has a plan to quickly fix Oregon’s forest crisis before the terrible looming deadline this July 1st for when the timber payments run out and leave counties without the support they were promised when their land was taken away. Federal forest policy has been stuck in a legal quagmire with the result of leaving rural Oregon with double digit unemployment and a damaged tax base that can’t fund local law enforcement. Rep. Wilson wishes to return federal land back to the states so local communities can create jobs, expand the tax base and fund vital community services. One Bill (HB 3240) would create a task force to study the effect of transferring federal lands to state control to help measure the legal, economic, social and practical benefits. Another bill, (HJR 13) is a House Joint Resolution that urges Congress to return federal land to the state.   One Legislative report on increased timber harvesting showed that Oregon could create 2,100 new jobs while adding $414 million in personal income growth. The tax revenue to counties would hit $33 million over five years.

There are increasing signs that Oregonians want to use their own land. Josephine Commissioner Simon Hare, says that his survey of the public shows over 80% support for more harvesting and better post-wildfire use. Yet, the decisions on Josephine’s land are made by non-Oregonians who live 2,800 miles away on the east coast.    While Representative Carl Wilson is pressing for more local control the alternative idea being pushed is to raise local property taxes to replace the tax revenue timber once provided.

Thanks to Tyler at the US Army Corp of Engineers, we know where this permitting process at the federal level is going.  Here is the information you will need to make comments on the permitting of the Winter Lake/China Camp Creek Project.  I would encourage everyone living in Coos County to send comments to both Tyler Krug at Tyler.J.Krug@usace.army.mil  and Madeleine VanderHeyden with the USFWS at madeleine_vanderheyden@fws.gov.  The Winter Lake Project was sold as an ODFW project, but it seem that the USFWS is the agency in charge of the project.....Rob Taylor

We are currently evaluating the project under several Nationwide Permits.  Specifically Nationwide #27 (Aquatic Habitat Restoration, Establishment, and Enhancement Activities), potentially Nationwide Permit #3 (Maintenance) and Nationwide Permit #18 (Minor Discharges).  Our current thought is that the project impacts are similar in nature and would not cause more than minimal individual and cumulative adverse environmental effects, thus allowing the use of general permits.  I'm emailing the 2012 Nationwide Permits as well as the Nationwide Permit General and Regional Conditions, DEQ 401 Water Quality Certification Conditions and DLCD CZMA concurrence conditions.   

I will discuss internally but we do not currently forecast the need to elevate our review to that of an Individual Permit.  If you or other landowners in the BSDD have concerns on the proposed work please provide them in writing to the Corps.  We will definitely factor those concerns into our evaluation.  Our permit evaluation or any decision would not carry any property rights. 

As a side note:  Corps understand U.S. Fish & Wildlife Service may provide funding for the project.  We're working with them to understand who would/could be responsible for compliance with other applicable laws and regulations.

Thank you so much for this information.  I will get it printed and will do some reading.  I do have comments and am quite appalled that some of the project is on our property yet I have to request the permit, which is dated Nov. 28, 2014, that should have been sent to me up front.  I saw nothing in the document that referenced the geo-tech report that was done some time ago, the hydrology report, or the water management plan.  Do you have those documents?

My hope is to get something put together for you by the first of the week but will try to get it out no later than the end of next week.  If this is inadequate, please let me know.

USFWS is taking the lead federal agency role on the project moving forward.  I suggest you contact Madeleine VanderHeyden with the USFWS at (541)347-1470 or
madeleine_vanderheyden@fws.gov.  Also, for project materials you can contact Ms. Merri Martz with TetraTech at Merri.Martz@tetratech.com.  She is the consultant working on the project.

Corps is involved but we will be stepping back as USFWS will be taking the lead agency role.  We do not distribute the applicant's permit application as our standard process.  A Corps decision would carry no property rights or access thereof.

Some things are releasable under the Freedom of Information Act (FOIA), some aren't.  From what I understand the water management plan is still in the works.  The project materials are quite large.  I suggest you talk to Merri Martz or Fred Messerle to see if they would mail you a CD of the materials for review.  You can also submit a FOIA request and we could a lot time to gathering the project info and sending it your way (w/fee).

USFWS is just getting on board and Madeline was going to try to get in touch with you regarding concerns.  Please try reaching out to her or Merri.

Researchers offer new insights into predicting future  droughts in California Natural cycles, sea surface temperatures found to be main drivers in ongoing event

According to a new NOAA-sponsored study, natural oceanic and atmospheric patterns are the primary drivers behind California's ongoing drought. A high pressure ridge off the West Coast (typical of historic droughts) prevailed for three winters, blocking important wet season storms, with ocean surface temperature patterns making such a ridge much more likely. Typically, the winter season in California provides the state with a majority of its annual snow and rainfall that replenish water supplies for communities and ecosystems. 

Further studies on these oceanic conditions and their effect on California's climate may lead to advances in drought early warning that can help water managers and major industries better prepare for lengthy dry spells in the future.

"It's important to note that California's drought, while extreme, is not an uncommon occurrence for the state. In fact, multi-year droughts appear regularly in the state's climate record, and it's a safe bet that a similar event will happen again. Thus, preparedness is key," said Richard Seager, report lead author and professor with Columbia University's Lamont Doherty Earth Observatory.

This report builds on earlier studies, published in September in the Bulletin of the American Meteorological Society, which found no conclusive evidence linking human-caused climate change and the California drought. The current study notes that the atmospheric ridge over the North Pacific, which has resulted in decreased rain and snowfall since 2011, is almost opposite to what models project to result from human-induced climate change. The report illustrates that mid-winter precipitation is actually projected to increase due to human-induced climate change over most of the state, though warming temperatures may sap much of those benefits for water resources overall, while only spring precipitation is projected to decrease.

The report makes clear that to provide improved drought forecasts for California, scientists will need to fully understand the links between sea surface temperature variations and winter precipitation over the state, discover how these ocean variations are generated, and better characterize their predictability.

This report contributes to a growing field of science-climate attribution-where teams of scientists aim to identify the sources of observed climate and weather patterns.

"There is immense value in examining the causes of this drought from multiple scientific viewpoints," said Marty Hoerling, report co-author and researcher with NOAA's Earth System Research Laboratory. "It's paramount that we use our collective ability to provide communities and businesses with the environmental intelligence they need to make decisions concerning water resources, which are becoming increasingly strained."

Dear Coastal Community Leader,

In 2006 the States of Oregon, Washington and California established the West Coast Governors Alliance on Ocean Health (WCGA) to work together on ocean issues that could best be advanced through regional collaboration. The WCGA’s first Action Plan, adopted in 2008, identified 10 Action Areas and established working groups made up of staff from all levels of government and nongovernmental organizations across the three states to coordinate actions. In 2012, the WCGA sharpened its focus to emphasize a shorter list of four priorities, while preparing to undertake a full Action Plan review and updating. As we launch the full review process now, we wish to take the opportunity to reestablish a connection and lines of communication with local governments, and benefit from perspectives won on the front lines of an array of ocean and coastal issues. We request your assistance in identifying shared priorities for ocean and coastal health, and strategies to ensure lasting communication between local entities and the WCGA.

To this end, I am writing on behalf of the WCGA Executive Committee to cordially invite you to attend a local government workshop on October 22, in Florence, Oregon. This meeting has been planned in coordination with the DLCD Fall Coastal Planners Meeting to lessen the travel burden for those attending both meetings. Please find attached a draft agenda for the WCGA meeting. This meeting will provide opportunity for local entities to offer input into the WCGA Action Plan, develop strategies for coordination, and enhance communication between the WCGA and local government representatives. Your participation will help ensure effective implementation of the WCGA Action Plan in years to come.
