Greetings,

Just to note to let you know that there are no additional filings for open positions on the Council yesterday.  I was asked recently, given the large number of candidates running this year, if this was abnormal.  In checking the files I learned the following:

·         In 2014, only one citizen ran for the position of Mayor and three citizens filed for the four open City Councilor positions.  There was a right-in campaign by three individuals for the fourth position.

·         In 2012, only one citizen ran for the position of Mayor and seven citizens filed for the three open City Councilor positions.

·         In 2010, two citizens ran for the position of Mayor and seven citizens filed for the three open City Councilor positions.

·         In 2008, three citizens ran for the position of Mayor and nine citizens filed for the three open City Councilor positions.

·         In 2006, only one citizen ran for the position of Mayor and seven citizens filed for the three open City Councilor positions.

Based on the above, it looks like we have a good track record of having citizens interested in sitting on the Council in serving this community.

All my best,

Columbia County Resident Files for Second Amendment Preservation Ordinance

8/31/2016

Comments

Hey Folks,

I have been working with individuals from several different counties in Oregon to get the Second Amendment Preservation Ordinance enacted in their county.  Chris Brumbles from Columbia County and a group of supporters could not convince the Board that they have a duty to preserve and protect the Bill of Rights and that it was their job to enact such laws.

Since the commissioners refuse to do their job then we are going to do it for them.

On August 22, 2016 Mr. Brumbes filed an imitative for the SAPO in Columbia County and on August 30 the county responded with a letter stating that it does meet the requirements of section 1 (2)(d) and (5), Article IV of the Oregon Constitution.   There some pie in the eye for the commissioners.  What a bunch of Pie Boys.

Now the people of Columbia County are going to need the help from anyone who is willing to go out and get signatures for the Second Amendment.....Rob T.

GENEALOGY OF THE U.S. CONSTITUTION

Tuesday September 13th at 6:00 PM Coos Bay Library 525 Anderson Ave. Coos Bay, Or

In this 1-hour presentation Constitutional Attorney KrisAnne Hall will destroy the Living Breathing lie that says our Constitution should be reinterpreted for modern man. She will present the 5 foundational documents that make up the genealogy of our founding documents, stretching back beyond the Magna Carta and the history that gave them to us. You will see the stunning parallels with the tyranny being perpetrated today and discover why our founding documents were not created on a whim and that they are reliable and relevant today. And....

FOUNDING PATRIOTS

Wednesday September 14th at 6:00 PM Coos County Owen Building 201 N. Adams St. Coquille, Or

So many gave so much and there were leaders that we don't know and voices that still go unheard. In this class we will be reunited with a few essential founders that we have forgotten, or perhaps whom have never even been introduced. The student will be inspired by these patriots, amazed by their bravery and deeds, and even a bit angry that we have failed to remember and celebrate these essential men and women and their sacrifices.

Curry County BOC Vote to be a Second Amendment Sanctuary County

8/6/2016

2nd Amendment Supporters,
At the August 3, 2016, meeting of the Curry County Board of Commissioners, the 2nd Amendment Preservation Ordinance was passed by Commissioners David Smith and Susan Brown.
Commissioner Huxley said beforehand that he would only support the Ordinance going on the November ballot for a vote of the People and so, voted "No".
Special thanks goes to David Brock Smith for coming up with the version that sidestepped the objections to the original version.  David has been a valuable ally in the 2nd Amendment Battle and will receive my support in his November bid to become our State Representative for District 1, maintaining a consistent Conservative presence in the Oregon Legislature.
Thanks also goes to Mike Dunn for his leadership of the CCRCC in getting the Ordinance passed.
Most of all, Thanks to all who showed up at all the BOC meetings and to all that sent emails to the Commissioners.  Without your presence, it would have been easy for the Board to dismiss this issue as not widely supported.
Thanks to ALL of You Patriots, our 2nd Amendment Rights are now, more secure here in Curry County!!!!!
Best Wishes,
Butch Jark
Chairman, Second Amendment Preservation Ordinance Committee
Attached is the final version that was passed by the BOC with the minor exception that the actual Title passed was "Second Amendment Preservation Ordinance for Curry County".

The Oregon Supreme Court Issues Historic Property Ruling

Court Issues Historic Property Ruling
The Oregon Supreme Court ruled this week in Oswego that when a local historic designation is imposed on a property, only the property owner Lake Oswego Preservation Society v City of Lake at the time the restriction is imposed has the right to remove that designation under ORS 197.772.  If the original property owner does not exercise this right, subsequent property owners who acquire the property will remain subject to the designation and any accompanying restrictions.

In this case, a subsequent property owner challenged in 2013 an historic designation that had been in place since at least 1992. The court examined the statutory text in context along with its legislative history (including a lengthy discussion of the meaning of the word “a” as compared to the term “the”). A key part of that context was a legislative requirement that local governments create and implement comprehensive plans and regulations to protect historically significant properties, incorporated in 1996 into Statewide Planning Goal 5, which required the identification and preservation of historically significant properties. If ORS 197.772 applied to subsequent property owners, such a result would effectively dismantle the established statutory and regulatory framework for the Goal 5 protection of historic properties, which the Legislature would not have intended. The court noted that when an historic designation is placed upon a property for the first time, the designation can significantly, and sometimes negatively, impact the property.

ORS 197.772 provides the original owner with a right to refuse the designation to protect that owner’s reasonable expectations as to the use of the property at the time the designation was imposed.  Subsequent owners acquiring the property with notice of the designation and, “most likely, at a price or valuation that reflects the designation” have no reasonable expectation of using the property in a manner inconsistent with that designation and therefore suffer no harm to their property interests.
