GUN REGISTRATION BILL SCHEDULED?

The anti-rights group "Ceasefire Oregon" sent an email today saying that Prozanzki's gun registration bill SB 1551 is scheduled for a hearing Thursday Feb. 6 at 8am.

As of now, there is no official confirmation and the bill is not scheduled on the committee calendar, so we cannot confirm this date. However, Senator Michael Dembrow, an anti-gunner who is on the committee, recently stated that he expected a hearing early in the session so this may be true.

If Ceasefire is correct then clearly Prozanski is providing them with inside information that he has not provided to the public.  Ethically questionable but not a surprise.

Oddly, Senator Alan Bates (Democrat District 3) said in a radio interview today (KMED, The Bill Meyer Show) the he did not think the bill would get out of committee. He also said he didn't read the bill or know what was in it, so don't put too much faith in anything he says.

We'll keep you posted on any official confirmation, but please keep the heat on.

First Gun Bills Scheduled.

Two gun related bills have been scheduled for hearings in the House Judiciary Committee.

The first is HB 4035. This bill allows corrections officers to have a firearm in their personal vehicles when parked in a "department parking lot." 

The bill requires that the corrections officers have CHL's.

The bill also requires that the firearm be "locked in a gun box inside the vehicle."

We think corrections officers should have the same rights as everyone else so we support this, but we are a bit concerned by the term "gun box" and wonder why corrections officers will be required to have CHL's to keep a gun locked in their car when no one else does.

But clearly the intention of this bill is good and its sponsor is House Rep Jeff Barker who has been as solid a vote for gun rights as you could ever ask for.

The bill is scheduled to be heard on Monday Feb 3. at 1pm in Room 343.

The second bill is HB 4068.

This bill is scheduled to be heard on Wednesday Feb. 5 at 1pm, also in Room 343.

This bill addresses an anomaly in Oregon law.

Currently a person with a conviction for a small amount of marijuana (or a single diversion) can still apply for a CHL, but only if the conviction was in Oregon and only if it was after 1973.

This bill is intended to expand CHL eligibility to those with old or out of state convictions.

It is modeled after a bill we drafted last year that was introduced by House Rep Kim Thatcher.   While it is not as well crafted as last year's bill and needs some fine tuning, it's a good step and we support it.

Oddly, this bill has as a cosponsor anti-gun Senator Floyd Prozanski.   This bears watching. Since Floyd is the main mover behind a bill to expand Oregon's gun registration we have to wonder what his motives are in cosponsoring this bill.  Politicians love to be able to appeal to as many people as possible. Maybe Floyd is trying to get some points with gun owners while doing all he can to ram through anti-gun legislation.

Speaking of Floyd's anti-gun legislation, Senator Michael Dembrow, who serves on Floyd's Senate Judiciary Committee and is part of the extreme anti-gun segment of the Oregon Senate, sent out an email today expressing his support for Prozanski's anti-gun bill and saying "Expect a long and contentious public hearing sometime early in the session."

Dembow is no friend of gun owners, but because he is an anti-gun insider, we assume his prediction to be accurate. 

Please let the members of the House Judiciary Committee know that you support House Bills 4035 and 4068.

Dear Representative,

While not perfect, House Bills HB 4035 and 4068 simply make sense. Corrections officers should have the same right to self defense as everyone else does and people with old or out-of-state convictions for small amounts of marijuana should have the same opportunities as those with in-state and more recent convictions.  I strongly urge you to support these bills.

"The US Supreme Court granted a last minute stay to a convicted murderer who is challenging the drugs prison officials had planned to use for his execution on Wednesday. Death Row inmate Herbert Smulls was to be executed overnight Wednesday by the state of Missouri, but Justice Samuel Alito late Tuesday granted him a reprieve, amid ongoing controversy over the use of lethal pentobarbital manufactured by a compounding pharmacy whose identity has not been revealed. Alito, the justice assigned to cases from the region of the United States that includes Missouri, is expected to rule soon on a similar petition from Louisiana inmate Christopher Sepulvado, due to be put to death next week." The Tea Party 5 Year Anniversary Event Patriots,

On Thursday, February 27, 2014, the Tea Party movement will be five years old. Five years ago, Americans around the country spontaneously united to stand up to government waste, government overreach and government abuse. Five years ago, we said “no more” to watching our elected officials ignore the Constitution and the free market principles this country was founded on. With the auto bailouts, stimulus packages, Troubled Asset Relief Program (TARP), and the utter abandonment of fiscal responsibility, it was clear Washington was in need of a serious intervention.
 
Five years later, the Tea Party movement has made significant progress. The 2010 landslide elections showed us that the American people are tired of being let down by spend-happy politicians in Washington. Last year during the budget battle, we learned when we are united, we can accomplish great things, like forcing Congress to listen to the people and stand up to President Obama. Still, there’s work to be done. America still has serious challenges ahead in the form of Obamacare, immigration reform, and runaway spending.
 
On February 27, the Tea Party Patriots will gather at the Hyatt Capitol Hill to celebrate the movement’s five-year anniversary, reflect on past successes, and pave a path forward. Join Tea Party Patriots Co-Founder Jenny Beth Martin and other liberty-loving Americans including Sen. Mike Lee (UT), Rep. Louie Gohmert (TX), and Rep. Preserving the American Dream:  Lessons in Beating Boondoggles     By Gini David

First, the bad news:  So-called “smart growth,” central planning schemes involving land use and mass transit are popping up all over the country like crabgrass. Now the good news: Some folks have successfully managed to galvanize opposition with grassroots organizing tactics and to beat boondoggles before they blossom into financial fiascos for taxpayers.

In late October, I attended the Preserving the American Dream conference in Washington DC, sponsored by the American Dream Coalition (ADC, http://americandreamcoalition.org), a  coalition that promotes freedom, affordable home ownership, property rights, and mobility. To combat big government boondoggles, the ADC provides strategic and tactical counsel from planning experts like Randall O’Toole (Cato Institute), demographer Wendell Cox, ADC’s executive director Eileen Bruskewitz, transit expert Tom Rubin, ethics analyst and writer Stanley Kurtz, and others.

The three-day conference kicked off with an all-day tour of urban projects in the DC Metro area, highlighted by the infamous “Million Dollar Bus Stop” in Arlington (which isn’t paved with Swarovski crystals), the proposed Silver Line Metro to Dulles International Airport, and the tree-lined  town of Bowie, aka “Maryland’s Levittown” as an example of a well-planned suburb.

Transit issues were the focus of much of the ADC conference because in urban planning this is often where the tail wags the dog and creates most issues for citizens. Ideally, the end game should be improved mobility – getting people to employment centers -- and congestion relief balanced with fiscal responsibility. As Randall O’Toole argued, “Paint is cheap,” and mobility can often be achieved with bus systems that are more flexible and far more affordable than fixed rail systems like refurbished trolleys and mega-million dollar projects like our SMART train.

But in the last decade or so, there’s been an explosion of rail projects. Like moths to flame, many politicians and planners seem drawn to rail projects because these “new starts” tempt them with glossy funding from federal agencies like the Federal Transit Administration (FTA). Rail plans usually begin with good intentions, often marketed to the public as “Smart” and “Sustainable.”  But too often, ridership projections are fudged to sell projects to taxpayers who later get stuck with construction over-runs and ongoing maintenance. Consider this stat:  nationwide, American cities face $77 billion in unfunded maintenance costs for rail projects!

What’s more, Panos Prevedouros, a professor of transportation engineering at the University of Hawaii, told the ADC audience that rail projects are rife with corruption and fraud, quoting   Bent Flyvbjerg, the renowned Chair of Large Program Management at Oxford University:  “Rail projects are the projects most fraught with delusion and deception.” As Prevedouros explained, “Deception because proponents lie to constituents and overstate ridership and understate costs.  And delusion because proponents believe that their projects are better and different than other failures from the past.”

Further complicating matters: many transit projects are hog-tied to massive land use plans like Plan Bay Area or Portland’s Metro. Federal transit funding becomes both the carrot AND the stick, forcing cities to comply with specific density quotas and “affordable and fair housing” standards, eroding local control, and chasing compliance with far-away bureaucracies and non-government organizations.  (Sound familiar?)

But all is not lost. A fascinating “Beating Boondoggles” workshop presented testimonies by people like Eileen Bruskewitz, ADC’s executive director and a former county supervisor in Dane County, Wisconsin, which encompasses uber- liberal Madison. Eileen opposed a wasteful rail project using a cool tool box of publicity tactics that turned personal attacks on her as a “knuckle-dragging conservative” into PR gold. Local shock jocks rallied around the spunky, self-proclaimed “Cavewoman” and her “No tax for tracks” campaign, causing the rail plan to go belly up. On the west coast, Tiffany Couch, a CPA/CFF and forensic accountant – how sexy is that! – dug diligently for real numbers and dubious practices on a high-profile $1 billion rail project between Oregon and Washington. Tiffany’s forensic accounting skills and articulate, common sense exposed local corruption and defeated the project.

Also inspiring were Karen Jaroch and Sharon Calvert from the Tampa Tea Party, who won the ADC’s annual “American Dreamers” award for their fearless fight against a 2010 tax increase to fund a rail project in Hillsborough County. I met people who were at different stages of their local battles – people like Barbara and Giselle from Pinellas County who were fighting a wasteful rail plan, and Katherine Kersten, a policy analyst from Minneapolis whose city received a $5 million “sustainable community grant” from HUD, as our own ABAG did to promote Plan Bay Area. Bottom line: Federal $ = Carrot and Hammer.

A major speaker was Stanley Kurtz, author and Senior Fellow at The Ethics and Public Policy Center, who warned about the murky end game of the Regional Equality Movement exposed in his  book, “Spreading the Wealth: How Obama is Robbing the Suburbs to Pay for the Cities.” And at Monday night’s dinner, newly elected U.S. Representative Thomas Massie (KY-R), lightened the mood with an inside look at Congress and a wicked sense of humor: “In DC, I drive a cheaper Tesla sedan with a bumper sticker reading ‘Kentucky Friends of Coal.’”

The conference ended with savvy grassroots organizing tips from an all-star panel featuring Mimi Steel, who discussed opposition to Plan Bay Area, and Andrea McCarthy of the Cato Institute who gave common sense media relations tips (‘call people, follow up!”).  For me, the most compelling insights came from Hadley Heath, a policy analyst at the Independent Women’s Forum (iwf.org) and sometimes Fox contributor, who gave tips on messaging and language. Referencing Jonathan Haidt’s book, “The Righteous Mind,” which studies moral values and politics, Hadley suggested using words like “fairness” and “caring” which tend to resonate more favorably with liberals. (Made sense to me and now I’m commenting “UNFAIR Obamacare” on many of my Facebook posts.)

 Finally, every morning in DC, I jogged six blocks to the White House and  asked strangers to take a photo of me mugging in front of the White House, arms outstretched, asking the president a question, which I’d later post on my Facebook timeline. In my short “Hi Mr. President” photo blog, I asked about jobs, Obamacare, and so on. I never received a response from our president, but while in DC I got plenty of inspiration and resources from the American Dream conference. And a little hope that people are fighting big government boondoggles – and occasionally winning!

A Fresh Approach to Prohibiting Taxes on Family Gifts

             Common Sense For Oregon (CSFO) is starting the year off right by coming up with solutions to fix things here in Oregon. This year, CSFO is supporting four initiatives that we are working to place on the ballot in November. And while it may be difficult to pass all four initiatives this election season, we know with your support, we can make things happen. That is why we are excited to introduce you to one of the initiatives that we hope you can get excited about: No Taxes on Family Giving.  

            We are taking a new approach to our previous efforts to ending the “Oregon Death Tax.” This time, our initiative will limit the negative effects of the Oregon Estate Tax on family-owned businesses, coupled with creating a “safe harbor” which protects any gifts of property within a family from any state or local tax in Oregon. CSFO is excited about this initiative because we believe all families in Oregon should be protected from any additional taxes.

            When Measure 84 was narrowly defeated in 2012, CSFO, the lead organization helping to move the measure forward, was not deterred. The organization looked at the final statistics, and those stats showed we came close to passing the measure. The measure passed in 27 of 36 Oregon counties. It was narrowly defeated - a shift of 3.4% would have reversed the result. The opposition ran a negative television campaign that depicted the measure as only benefiting the wealthiest individuals, ignoring the real issue as to family farms and businesses - and fairness.  

            CSFO is not letting the issue die. Instead, we continue to fight for what is right in Oregon. Family-owned farms, ranches, and businesses should not be burdened with the Oregon Estate Tax when gifting those businesses or shares of those businesses from one family member to another family member; any direct gift taxes, state or local, should be prohibited on family gifts; any inheritance taxes should be prohibited; and any other form of transfer taxes as to gifts between family members should be prohibited. Note: “family members” are broadly defined.

            In the U.S., 35 states have abandoned estate taxes. Successful entrepreneurs with movable assets are now moving out of Oregon and establishing residences in other states – such as California, Idaho, Nevada or Arizona – which have no estate taxes.

            We have collected enough signatures to submit the start-up petition for No Taxes on Family Giving to the Secretary of State’s office. We are currently engaged in the ballot title process. Once we receive a ballot title, we will need more signatures (like yours) to allow Oregonians to vote on the measure in November.

Obey The Law, Go To Jail

To illustrate just how dangerous Floyd Prozanski's gun registry bill is, we need only look to a case heard in the Supreme Court Wednesday.

The Court heard "Abramski vs United States" a case in which OFF contributed to an Amicus brief filed by other statewide gun groups and Gun Owners of America.

Bruce Abramski purchased a pistol (legally with a background check)in Virginia.  He then took the pistol to Pennsylvania and transferred the pistol to his uncle, through a dealer, with a background check. 

As a result he was charged with making a "straw purchase" and convicted. The implications of this are breath taking.   Just imagine if they start applying this logic anytime a gun is transferred, (sold, given, traded) from its "original" purchaser. (Some of the comments by the Justices will also trouble you.) And this is why Prozanski's universal registration scheme is so very dangerous.

Floyd wants to extend this kind of entrapment into virtually every transfer that takes place, even if you give a gun to your best friend.

But Floyd and his cronies can't stop lying about what the bill is and what it does.

In a Statesman Journal article published today, Prozanski said:

"If the Legislature wanted to create a statewide gun registry it's been collecting this information on dealer and gun show sales for 23 years. It's not a registry. [The bill] extends what our current law has been since 1989; a process for background checks to be completed. All we are doing is closing a loophole."

This does not even make sense. First he admits the state has been collecting this information for "23 years" (personal info and the make, model, caliber and serial number of the transferred gun) then he says  "It's not a registry."  Really? Then what IS it?

But the lies don't stop there.  Floyd then said:

"In the 23 years that we've had background checks in this state, it has never led to confiscation of gun."

The absurdity of this statement can only make you wonder if Floyd is only a liar or if he is actually delusional.  Perhaps he never heard of David Pyles.

David's life was turned upside down, his home was invaded, and his property confiscated based on the Oregon State Police turning over information about his legal gun purchases to local police. David had broken no law, had been accused of no crime and there was no warrant for his arrest, yet he was taken into custody based on nothing more than the fact that he had purchased firearms.

The State Police broke the law when they turned over this information. Their punishment? Nothing. David's punishment for having done nothing wrong? He lost his job and his home.

And it is this very agency that Prozanski wants to take over the job of giving you "permission" to give a gun to your uncle.

Of course, when a truly prohibited person attempts a firearm's purchase and is denied, nothing happens to him.

According to the Statesman Journal:

"Oregon State Police spokesman Gregg Hastings said sellers aren't told why a person was denied, and OSP doesn't notify parole or probation officers."

If that's true, and we have every reason to believe it is, it makes this following quote from the same article all the more interesting:

"...but Prozanski, who works as a prosecutor in Eugene and Florence, said he is working on a case where someone is facing a parole violation for trying to buy a gun."

Now how do you suppose anyone knew?  Given Prozanski's history of lies, we have no way of knowing if this statement is true.

The Statesman Journal says :

"If you pass your background check, OSP destroys your information after 10 days"

But the fact is, that is only the OSP's published policy (after the David Pyles debacle) it is not the law. The law says they can keep the info for 5 years and in a conversation we had with the retired director of the ID unit a few years ago, he could not tell us how or when records are destroyed. Is it daily? Annually?  Is there ever an audit to demonstrate that, in fact, the OSP is not keeping a very easily duplicated database?

As far as enforcement of this Prozanski said:

"We have a code of honor as citizens that you are going to follow the law,"

If he believes that, why would he think Oregonians are selling guns to felons now?

The Abramski case is very troubling and should make you very concerned about expanded background checks. The fact that the State Police ID unit will have complete control over virtually all lawful transfers is cause for concern as well.  Please take a moment to contact the members of the Judiciary Committee and express your opposition to this bill.

Shane Ozbun, (State Director for People Against the NDAA), Tom McKirgan, (Regional Coordinator for Oath Keepers) and Rob Taylor (who runs the Coos County Watchdog) provided some answers.     

Shane Ozbun, Tom McKirgan and Rob Taylor  The NDAA is an act that funds the U.S. military and sets policy regarding federal expenditures.  But, as Ozbun pointed out, beginning in 2012 it included provisions that allow the federal government to indefinitely detain US citizens without due process or trial!  He used several video clips featuring attorney and former prosecutor Kris Anne Hall who provided further details, including the lack of definition for terms such as a "belligerent act" (which may lead to indefinite detention).  Ozbun also indicated that state and local government are pushing back with a variety of resolutions condemning part of the NDAA.  Four states -- Alaska, California, Michigan and Virginia -- have enacted laws that nullify certain provisions of the NDAA.  Similar legislation has been introduced in several other states.  McKirgan followed-up with similar comments.  He also cited federal government programs that are giving local law enforcement military weapons and armored vehicles.  Rob Taylor put a local twist to the event when he described his success in getting the Coos County Commissioners to support a resolution against the NDAA, along with a pending referendum to force the City of Coos Bay to take similar actions.  His message was that the NDAA has to be fought first at the local level.  

Other speakers included Sheriff Dean Wilson (Del Norte County, CA) who made it clear that various sheriff associations overwhelmingly support local law enforcement over the NDAA and federal military actions.

This Land is... the Government's Most people understand that the federal government controls a lot of land,
but few know just how vast the holdings really are.  The map above is courtesy of Investor's Business Daily.  It indicates the vast amounts of land, particularly in the natural resources rich western states, held by the federal government.  

According to the USDA, Economic Research Service, of the 2,264,000,000 acres that comprise the United States of America, the federal government owns 635,000,000 of them, or more than 28%.  In addition, state and
local governments own 195,000,000 acres and another 56,000,000 acres is the sovereign territory of the various Indian Tribes.  

Thus, nearly 4 of every 10 acres of land in the U.S. – 39.13% - is owned by a government entity rather than private citizens; easily the largest asset controlled by the collectivist state. And, even the land that is privately held has volumes of regulations controlling what citizens can do on and with it
Nothing represents the American Dream more than ownership of a piece of land.  While significant areas of the country are legitimate public treasures, it seems yet another great paradox that in a nation of supposedly free people committed to private property rights and individual liberty, vast amount of this country is deeded to the government's Central Planners instead of to individual citizens.

Two gun related bills were officially posted on the Oregon Legislative website today.

One is the "bill" version of Floyd Prozanski's gun registration expansion legislation which we had seen as "Legislative Concept 154". It is now an official Senate Bill, SB 1551.

As you will see, it has been introduced as a "committee bill" because Prozanski wants to attack your rights, but lacks the courage to put his name on the bill. But make no mistake, it's his bill.  While there is little doubt he introduced it to further the agenda of Senator Ginny Burdick, he is the committee chair, he requested the bill and we are going to make sure he takes ownership of it.

The other gun bill that was introduced today is HB 4068.  This bill, while far from perfect, is well intentioned.
Its purpose is to allow people who have had convictions for small amounts of marijuana in other states, or persons who had those convictions in Oregon before the law reduced the penalties for possession of  small amounts of marijuana, to apply for Oregon CHL's.

Currently persons who had convictions in Oregon and after 1973  may apply for CHL's but persons whose convictions were from other states or who were convicted before July 22, 1973 can not.

We think this bill could be improved. A bill with the same intention was introduced last session by House Rep Kim Thatcher and was somewhat better.  We'll work to make this bill better but in any event support its intent.

Floyd's gun registration bill is still the biggest danger so we urge you to keep the pressure on to kill it. The bill will go to the Senate Judiciary Committee, so please use the contact info and suggested message below to let them know how much you oppose this dangerous legislation.

Dear Senator,

SB 1551 is one of the most poorly crafted pieces of legislation I have ever seen.

Under this bill a uncle can give a gun to his nephew but the nephew cannot return it without subjecting his uncle to a background check!

Under this bill I could not give a hunting rifle to my own father-in-law!

If my gun club allows someone taking a safety class to use one of our club owned guns, we'd be required to run a background check on the student and transfer the gun for the duration of the class. The student would than have to do the same to return it!  This is lunacy.

Vote against any restrictions on private transfers.

OWEB is in the process of updating the Oregon Watershed Council map in preparation for launching the new Council Capacity grant program in 2015.  We would like you to review the map (at the link below) and let us know if your watershed council boundaries have changed since this map was last updated in 2010.   

How do I Review the Map

Below is the link to an online map with the current boundaries of the locally recognized watershed councils in Oregon. Please review the boundary of your watershed council to determine if it is accurate.  Within the map, each watershed council is shaded blue with areas of darker blue representing the overlapping of two watershed council boundaries.  By clicking on the polygons for the watershed council boundaries you will get an info window that will tell you the name of that watershed council.  You’ll also note that multiple info windows may be present (e.g. “1 of 3”).  You can access these additional info windows by clicking on the white arrow in the upper right of the open info window.   Also included in the map are the Oregon county boundaries and hydrography. For the hydrography layer, clicking on the layer name will expand it to show additional features such as the  different HUCs.

Update on the BOC meeting January 20, 2014

Hello Watchdogs,

The following is an update to a discussion item on the agenda at the Board of Commissioners meeting January 20, 2014. 

Agenda item A. was a review of the China Creek Winter lake Project, as related by Fred Messerle of the South Slough Drainage District and Steve Denny of The Nature Conservancy.

The discussion focused on the benefits of the project and on how it would prevent the area from becoming a "Summer Lake", as inferred by Mr. Messerle.  They claimed that without ODFW replacing the old deteriorating tide gates with more modern structures, the valley would flood all year round.  Then they made the argument that the project would in-fact decrease the chances of a mosquito infestation occurring due to the construction of these new water barriers. 

However, the maker designed the new gates to allow more water intrusion during high tides and wintertime flooding as to meet the newer federal and state guidelines for fish passage.  This would also allow the Oregon Department of Fish and Wildlife to sculpture their parcel of property so the reseeding water would leave standing ponds all year round, which could lead to the very mosquito problem they are claiming to avoid.  The proponents of the project have modified the points of their proposal since the meetings they held with the public to discuss their concerns. 

Unfortunately, the updated assertions did nothing to alleviate the very real worries of the people living in the areas surrounding the restoration.  A question was asked about the ODFW using the restored wetland for “mitigation banking” to offset the places that are utilized for industrial purposes. 

Denny and Messerly referred to Biologist Stuart Love and none of them had the answer.  Mr. Love did say he would find out the answer to that question, and get right back to the board.

Comments Requested DOT Proposed Primary Freight Network/NADO Provides Guideline to Members for Submitting Comments - In November, the U.S. Department of Transportation (USDOT) proposed a group of key highways to serve as a Primary Freight Network. The Moving Ahead for Progress in the 21st Century Act (MAP-21) included a requirement that the Secretary of Transportation designate up to 27,000 miles of existing interstate and other roadways as a Primary Freight Network (with the possible addition of 3,000 miles in the future). In the Federal Register notice, USDOT identifies 41,000 miles necessary to transporting goods efficiently on highways throughout the nation and requests comments from the public to help finalize the map. The Oregon Department of Fish & Wildlife will be holding six public open houses in January 2014 to solicit public comment on their Draft Coastal Multi-Species Conservation & Management Plan.

The draft Coastal Multi-Species Conservation and  Management Plan is now available for public review and comment.  The draft Executive Summary (attached) and full plan are located on this web page (http://www.dfw.state.or.us/fish/CRP/coastal_multispecies.asp) under Documents:  Public Review Draft of CMP.  The full Plan is 8.5 MB, thus I elected not to send it in the event that it might exceed the ability of some of your machines to open the document.  I elected to also not send the angler survey results report as it is 4.5MB (that document can also be downloaded at the address above if you are interested in reviewing it).

I’m also attaching a copy of the Columbia Basin Bulletin of January 17, 2014 relating to the ODFW Draft Coastal Multi-Species Conservation & Management Plan upcoming open houses up and down the Oregon Coast.
