PROPOSED EXPANSION OF WATER AUTHORITY WOULD EXTEND FEDERAL CONTROL TO VIRTUALLY ALL U.S. LANDS

WATERS OF THE U.S. There is a proposal that redefines federal authority over the water--and thus the lands--of the United States. The impact is best illustrated by the maps below. The Clean Water Act authority shown in the first map would be extended to the proposed Clean Water Restoration Act authority shown in the second map; essentially, a takeover of all land in the United States. This proposal has been in the works since at least October, 2006 when the second map was prepared for Rep. Oberstar by the Democratic staff of the Committee on Transportation & Infrastructure.

We are in the comment period. According to Doyel Shamley, state and federal representatives across the nation were informed of this proposal weeks ago. The deadline for comments is in 3-4 days. You are urged to contact your county, state, and federal representatives to determine what, if anything, they are doing about this. Here are the links:

One of the great environmental success stories of our time is the Clean Water Act. Forty years ago, the condition of U.S. rivers, streams, lakes, coastal areas and other water resources was a national concern.

Things started to improve after the newly-established U.S. Environmental Protection Agency was given direction “to restore and maintain the chemical, physical, and biological integrity of the Nation’s waters” through major revisions to the Federal Water Pollution Control Act (now the Clean Water Act).

But over the past decade, court decisions have created uncertainty about the Clean Water Act’s protection of certain streams and wetlands from pollution and development. In particular, the confusion centers on questions surrounding small streams and wetlands—some of which only flow after precipitation or dry up during parts of the year—and what role they play in the health of larger water bodies nearby or downstream.

This week, EPA’s Science Advisory Board released for public comment a draft scientific report, “Connectivity of Streams and Wetlands to Downstream Waters: A Review and Synthesis of the Scientific Evidence.” This draft report synthesizes more than 1,000 peer-reviewed pieces of scientific literature about how smaller, isolated water bodies are connected to larger ones and represents the state-of-the-science on the connectivity and isolation of waters in the United States.

The International Code Council and You...

Hey Folks,

The International Code Council is an NGO front for the United Nations Agenda 21.  Last year, Coos County became a member of the international Code Council when the county excepted grant money from FEMA, which is one of the reasons there are people who speak out agianst taking these grants.  The agreement always has strings attached and the Devil is in the details.  Below are some of the excerpts from the ICC's website and since we are now all global neighbors in this international collectivist society it would behoove us to learn our new commandments....Rob T.

History The International Code Council (ICC) was established in 1994 as a non-profit organization dedicated to developing a single set of comprehensive and coordinated national model construction codes. The founders of the ICC are Building Officials and Code Administrators International, Inc. (BOCA), International Conference of Building Officials (ICBO), and Southern Building Code Congress International, Inc. (SBCCI). Since the early part of the last century, these non-profit organizations developed three separate sets of model codes used throughout the United States. Although regional code development has been effective and responsive to our country’s needs, the time came for a single set of codes. The nation’s three model code groups responded by creating the International Code Council and by developing codes without regional limitations; the International Codes.

Source: Christian Science Monitor "The US Supreme Court took up an unusual -- but important -- civil rights case on Tuesday testing whether a ban on using race-based affirmative action in college admissions in Michigan violates the equal protection rights of minorities. The case arrives at the high court four months after the justices declined to issue a sweeping decision in a case testing the constitutionality of an affirmative action program at the University of Texas. Based on questions asked during the hour-long argument session on Tuesday, it appears that the justices are disinclined to issue a broad ruling in the Michigan case, as well." (10/15/13)

 Hello Watchdogs,
One of the main nongovernmental organizations involved with the acquisition of private property for wetland restoration is The Nature Conservancy. This organization has an annual budget of $7.7 million, which allows them to wield heavy influence over small communities. Most of the problem is the direction of The Conservancy or the lack of direction in their leadership. There are limitless amounts of free-market agrarian projects in need of funding, which would benefit nature, without taking property off the tax rolls.

The people of Coos County know the bast ways to take care of our environment, so we have to be the ones to explain this to The Nature Conservancy and tell them how they can help our community with their resources. Please call the Conservancy's leadership team here in Oregon and let them know that we will not tolerate federal land grabs, but we will work with The Conservancy on our conditions, with our own terms.

Dear Representative Krieger, et al

I'm sorry to bother you if this comes at a busy time.  I've tried many times over the past few months to get you to contact me, but Wayne, I never do hear from you. I find it discouraging that I have to go through another district Rep to pass messages to you, to contact me. The last he said was that he'd bring up the following to you and others in a morning meeting, which I appreciate. I do want to thank all of you for working hard for Oregon.

Wayne, we're asking that you and several other representatives sponsor and support a non partisan Bill for the next year session. The Bill would make it felony illegal for any person, military personnel, elected officials and law enforcement personnel, including Federal law enforcement or Interpol within the State of Oregon from enforcing or assisting with enforcing or facilitating any unconstitutional laws/executive orders such as, and specifically including the application of the Authorization For Use of Military Force and the 2012 National Defense Authorization Act Section 'D' Counter Terrorism Subsections 1021 and 1022 against American citizens and lawful resident aliens.

We've recently had two Oregon counties already stand against the provisions in the NDAA. Those are Coos and Klamath Counties. Now, Douglas County is working on passing a resolution that we recently presented them, and more are in line. We are now working on a state resolution that we believe will suit the scope of the Bill. The momentum is there and the time is right, while we continue introducing it to other counties for increased support.

We're working with the organization called PANDA (People Against the NDAA) and a large Oregon coalition of liberty minded organizations of all political parties, because this effects all of us equally wrong.

The NDAA violates more than half of the Bill of Rights in both U.S. and Oregon Constitutions. As elected officials, under Article VI clause 3 of the U.S. Constitution and Article XV section 3 of the Oregon Constitution, are bound by oath to preserve, protect and defend them.

We can't seem to get many local officials to honor their sworn oaths. Sadly, they ignore it, as if it doesn't exist. Fortunately, for the sake of the Republic, we take it very seriously and hold them accountable to honor it.

As a reminder from a town hall meeting that you and Senator Kruse hosted in Coquille some time back, this was brought up. I well remember your simultaneous answer you gave to the question I asked, which was; "would you sponsor or support a bill against the provisions in the NDAA that apply to American citizens?" It was, "absolutely."

One more issue that I believe you will agree with me on Wayne. This is a real officer safety concern. You well know that society will treat all LEO's with disdain if they show alliance with rogue federal agents enforcing unconstitutional acts, depriving them of their rights. We don't want to see our police hurt or killed. We owe them that protection from harm. We'd rather they interpose themselves in protecting those rights as they are sworn to do. As you and I both have.

We've all been diligently doing the hard work to give you and Senator Kruse the wins that you guys said would help get it to the state. What do you gentlemen say? Are you willing to take a stand against these tyrannical act(s) in protecting the liberties of all Oregonians? Or, do we have to do it ourselves?

Other states have passed Anti NDAA legislation. It's time for Oregon to finally do the same.

APHIS Final Rule Revising Pet Seller Exemptions and You

SAOVA Friends,
Since APHIS announced the Final Retail Pet Store Rule a number of commentaries have surfaced as groups and individuals attempt to interpret this rule and provide guidance. The overarching intent of the revision is to regulate sight unseen sales which APHIS claims have dramatically increased as a result of growing internet usage. APHIS has determined that their mission to enforce regulation of listed animal species under the Animal Welfare Act (AWA) now includes those sold in retail as well as commercial markets.

The revised language as set in the APHIS rule now has the force and effect of law. Anything else stated by APHIS staff in response to questions should only be considered as an explanation of pending policy. These policies are not only open to interpretation by individual inspectors, but can be modified by the agency at any time.

Part 3 of the AWA details the Standards of Care for housing, facilities, exercise, cleaning, sanitization, and housekeeping required under USDA/APHIS regulation. Standards will not be revised for home-based retail sellers as APHIS cannot privilege newly licensed breeders over currently licensed breeders. The Final Rule notes: “Several of these commenters suggested that we amend part 3 in the final rule to establish alternate, performance-based standards for dog and cat fanciers and other small-scale residential breeders. We are making no changes in response to these comments. The comments were predicated on an assumption that it will be cost-prohibitive for most residential breeders who are regulated as a result of this rule to meet the standards in part 3; we do not consider that to be the case. The US Supreme Court has agreed to hear the case of Bruce Abramski.

Abramski, a former police officer, purchased a handgun, (legally) in Virginia and transferred it, through a dealer, to his uncle in Pennsylvania.

In spite of the fact that Abramski completed a background check, and his uncle completed and passed a background check, Abramski was charged and convicted of a "straw purchase" of a firearm.

This is a deeply disturbing case since even the ATF has told dealers it is legal to purchase a firearm for another person if the other person may lawfully possess firearms. In fact, even Sarah Brady has done it.

Countless lawful transfers could suddenly become the target of  felony allegations if the court agrees with the state. Oregon Firearms Federation has joined other pro-rights organizations in filing an amicus brief on behalf of Abramski. You can read it here.

 I do not support the USFWS proposal that will designate critical habitat for the Oregon Spotted Frog (OSF) under the Endangered Species Act.

I'm concerned of what the designation of Critical Habitat will due to our Rural communities, as the abuse that was done with the Spotted Owl Critical Habitat has devastated the Northwest, with the lack of considering the economic impact.  It is stated that an economic impact is being prepared for the OSF , it is also stated that some of the areas have not been monitored or confirmed of the OSF presence or lack thereof. 

The result of Critical habitat designation is re-purposing property to essentially wildlife refuges where human activity is restricted. I reviewed the Proposal and do not see where the OSF is on the verge of a loss of continued existence, as the OSF is extant and occupies most of the areas identified for Critical Habitat, also the OSF lives in other locations across the Northwest. Only pockets are listed where the OSF is no longer present, that is not going extinct.

The fact that the Oregon Spotted Frog (OSF) is no longer located in many of the Historical locations is not an indication that it is the Habitat, as noted in the proposed rule, climate, introduction of non native predators, Trout – Bullfrogs and the chytrid fungus introduced by the African Clawed Frog have been a factor in the reduction of population.

The McKenzie River unit consists of 98 ac (40 ha) in Lane County, Oregon. This critical habitat unit occurs in the Mink Lake Basin, located in the headwaters of the main South Fork of the McKenzie River on the McKenzie River Ranger District of the Willamette National Forest.  The McKenzie River unit includes seven wilderness lakes, marshes, and ponds:  Penn Lake, Corner Lake, Boat Lake, Cabin Meadows, two unnamed marshes and a pond northeast of Penn Lake. A small segment of the South Fork McKenzie River between the two unnamed marshes also is included within this critical habitat unit.

 Please read the story and then my comments below that I posted online in reader comments to understand why we need as many people as possible to push back tonight in the reader comments section at the bottom of the story. 

We want to focus on the fact that the reporter says it barely qualified when we had a validity rate of 93.5% in the first 1000 name sample, which should have produced over 66,000 valid signatures, not 58,000 as the story says. The other main point is that the Secretary of State just makes up a number to automatically throw out of the 1000 names before they begin verifying those that are left. This makes it almost impossible to get on the ballot  as it just an artificial barrier to make it harder for citizens to get something before the people to vote on. 

Can you please send this out to your email lists? We need as many as possible to get on this immediately tonight, plus we need to Facebook and tweet it out also.

I am astonished that the Oregonian reporter used such a misleading sentenc saying 'the measure barely qualified' when in fact the first 1000 name sample had a unusually high validity rate of 93.5%. (The first version of this story did not include that  very important fact and the reporter only included it after being called out on it by email). It is unusual to make the ballot on the first 1000 signature sample when you consider that the Secretary of State arbitrarily throws out 9.4% of the signatures right off the top, without verifying whether they are valid or not. Then they actually verify the names that are left, adding those that do not qualify (6.5% in this case) to the arbitrary 9.4% rate for a total of 15.9%, deducted from 100% thereby meeting the 84% threshold. Under
these draconian conditions, I am amazed that any measure qualifies for the ballot under any circumstances. To say it barely qualified is a real stretch when you look at the truth as I have just articulated, not to mention that the
entire list of 71,000 names was not verified as the article says. ONLY THE FIRST 1000 WERE VERIFIED and not the total number turned in. I reality, this measure likely had a total of 66,000 names that qualified if they were all verified, which is hardly 'barely qualifying' in my humble opinion.

City of Bandon Update---Dark Skies Initiative still in the news

Hey Folks,
The people of Bandon won the fight against the Dark Skies Initiative with 56% of the voters rejecting the measure.  However, this initiative is happening all over the country and here in Oregon, so the Oregon Public Broadcast Radio did a news story on the subject and their reporter interviewed me.  It seems Bandon voters have been the only ones to defeat this abusive law. Light Pollution Fight Advances One City And Park At A Time

But this movement came to a temporary halt earlier this year when voters in coastal Bandon, Ore. repealed their city’s brand new outdoor lighting ordinance.  Referendum organizer Rob Taylor argued the regulation was “a huge government overreach.”

“We were trying to tell people that this is a matter of safety and security,” he says. “Or even if it didn’t give you more security, but it gave you the perception of security, we believe that was the right of the individual to choose for their own property.”

Taylor described his preferred path forward in a post-election letter-to-the-editor. “People who want ‘Dark Sky’ compliance can use public cooperation, personal communication and more education to achieve their desires.  Only now, they cannot use the force of government to make other people comply with those rules, so everyone should be happy,” he wrote.

Statewide measures to regulate against light pollution have repeatedly failed in the Washington and Idaho legislatures too. Currently, city councilors and planning commission members in Cannon Beach, Ore. are debating whether or not a “dark sky” ordinance is needed in their town. A similar law just took effect in nearby Seaside.

The Port Orford city councilors voted unanimously not to form a National Marine Sanctuary committee in the Mayors absence.  The voters are going to the Curry BOC to get a resolution against the establishment of all marine estuaries, reserves, and sanctuaries.

The State of Oregon is sending a survey to economic and community development “practitioners,” including city managers, county executives, elected officials, and local business owners. It asks what economic development projects the state should take on.

A state spokesman says, “We want stories and experiences and recommendations on how to get better.” Given that “free money” is always welcome, the inevitable huge response surely will be taken as a sign that finally the state can make the proper decisions about how to invest other people’s money, namely the taxpayers’.

Hello Watchdogs, 

The feds are at it again.   A front-group for NOAA, The National Marine Sanctuary Foundation, is interested in establishing a sanctuary or marine reserve in Port Orford.  The group is forming a new  committee to rubberstamp this land & water grab, because the sanctuary will consist of a 3-mile setback of land to complete its boundaries.   We have a chance to prevent this from happening.  
 

There will be a meeting in the Port Orford City Hall at 3:30 pm on Thursday, October 17, 2013.  The  tagline for the NMSF is “Protecting, Preserving, & Promoting America's Underwater Treasures”.  They are a non-profit NGO with a million dollar budget and they specialize in the acquisition and restoration of private property.  The NMSF will do to the ocean what the USFWS has done to our public lands and none of it is good.    We already have plans to present a resolution against Marine Reserves to the Board of Commissioners, so we will need all of your support.

Dear Editor --
 
    The ads say over twenty-five million dollars in  taxes annually will go to Coos County from Jordan Coves's export LNG (liquified natural gas) project once built...?  Really? 
 
    Let's talk about an urban renewal district  overlaid by an enterprise zone.  Should Jordan Cove get permits, they  will have two construction years that are tax-free followed by three more years  tax-free if they follow guidelines on hiring and payroll.  Enterprise  zone tax exemptions can, as I understand it, be extended out to twenty years,  and possibly more.
 
    But let's say at some vague point taxes kick  in.  Wow!  NOW the county will be rich! --except for that pesky urban  renewal district.   The base line for the county's share of those taxes  will be the unimproved land  the facility sits on, aka "lot value".  All the  taxes assessed on the new improvements will go the urban renewal  district.  This district is the county's district but it is run by the Port  of Coos Bay.  So all that money goes to an  unelected agency to spend,  and not to schools, safety, seniors.
 
    And what about those 720 permanent new  jobs?  FERC (Federal Energy Regulatory Commission) estimated the new jobs  on the old LNG-and-co-generation-plant to be 36 to 39....  a mere  factor of 20.
 
    And the over 2000 construction jobs?  I  believe it was Jordan Cove that optimistically estimated that number to be 1,600  on the very similar old project.
 
    But if you get in their face, the twenty-five  million tax dollars suddenly become an annual contribution donated by  Jordan Cove, from its profits, to a foundation headed by Who Knows and with What  Intent.   ("Schools" are noted prominently in the rant.)  Did you read  the word "PROFIT?   What company with a development of this magnitude makes  a "profit" on paper?   Between building expenses, depreciation, payroll,  ongoing business expenses, etc, it's questionable Jordan Cove will turn an  annual profit of $25,000,000 anytime soon, let alone bequeath it to the benefit  of southwestern Oregon.
 
    And on top of that bucket of propaganda, I  understand American Bridge in Reedsport is closing its doors in two  months.  Anyone for a chorus of  "I've been working on the  railroad....."?

Oregon: Transfer public lands from feds?

The United States government owns more than 55 percent of all the acreage in Oregon. A total of more than 53,000 square miles, or 34 million acres, is held in federal title. Oregon has the fifth highest federal ownership percentage among all of the 13 Western states.

So what is wrong with this massive federal ownership of Oregon land and how did it happen?

The United States Constitution prohibits the states from imposing or collecting taxes on property owned by the federal government. More than half of the landmass of the state of Oregon is thereby excluded from Oregon’s taxing authority. Any existing or potential improvements located on that 53,000 square miles of federal land is also exempt from property taxation. This situation obviously creates a huge barrier to the adequate funding for Oregon’s schools, public safety, transportation infrastructure, and care for our most vulnerable citizens.

 Further, the federal ownership of more than half of the landmass of Oregon functionally excludes it from economic development. Virtually all of Oregon’s businesses, jobs, wealth and infrastructure are found on the 40 percent of Oregon’s landmass that is privately owned. Conversely, virtually none is found on the 34 million acres of federally owned land. The burden of the cost of State and local government in Oregon is borne by the taxation of less than half of the lands of the state.

State Forests Management Superior to Federal Forests
for Job Creation, Revenue Production, Local Economies and Fire Prevention

WASHINGTON, D.C.,  February 26, 2013 -    Today the House Subcommittee on Public Lands and Environmental Regulation held a hearing examining, “State Forest Management: A Model for Promoting Healthy Forests, Rural Schools and Jobs.” The hearing was an opportunity to hear from state leaders, local land managers and timber experts on the inadequacies and burdens of current federal forest management practices that have contributed to poor forest health, underfunded schools, lost jobs, and suppressed economic activities in communities near National Forests.   In comparison, state managed forests can often produce hundreds of times more revenue, from just a fraction of the land base while maintaining vibrant, healthy forests to support local communities.
“[Washington state] lands generate an average of $168 million annually, support construction of public elementary, middle school and high schools statewide, facilities at the state’s universities, and other state facilities and institutions. In comparison, the U.S. Forest Service is responsible for managing over 9 million acres of forest land contained within seven different national forests in the State of Washington, yet harvests just 2 percent of the new growth, yielding a four-year average of only $589,000 in revenue,”  said Natural Resources Committee Chairman Doc Hastings (WA-04).  “Rather than offering all-too-familiar rhetoric of how complying with one federal law or another ‘costs too much,’ it’s time for the federal government to adjust how it does business, and honor its own statutory responsibilities to manage the forests, including allowing sufficient timber harvests, that benefit forested counties and their schools, as well as improve declining forest health and reduce the threat and soaring costs of catastrophic wildfire.” 

“Over the last few decades we’ve seen our National Forest System fall into complete neglect—what was once a valuable asset that deteriorated into a growing liability. I believe our forests and public lands are long overdue for a paradigm shift,” said Subcommittee on Public Lands and Environmental Regulation Chairman Rob Bishop (UT-01).“It’s time for the federal government to cease being the absentee landlord of over 600 million acres of land in this country that it controls and start leveraging those lands in a way  that benefits rather than burdens the taxpayers and communities who are forced to play host to the federal estate.”

FOR IMMEDIATE RELEASE 

Public Meeting – Special Presentation: Greg Palmer, Maverick Solutions  LLC, will be speaking with the Coquille Watershed Council and the Coos County community about “Vegetated Terra Walls”, an innovative solution to many of the erosion and sedimentation problems facing the Coquille River. Their “Gripper System” is the most advanced terra wall technology available today, and the system is a fully engineered, cost effective and labor reducing solution that is stronger than concrete block, rock and traditional hardscapes. Any plant that will grow in the environment where the project is located will grow in the Gripper System, which allows for superior structural integrity over hardscapes, such as rip-rap, while still creating an environmental habitat that is fully vegetated and natural to its native environment. Terra walls produce the most successful permanent bio-engineering results, and Maverick Solutions has worked closely with permitting agencies and a multitude of state, county and city  governments to implement effective projects. They have also been approved for grant funding on private property projects through OWEB. They are an Oregon-based company and partner in the environmental construction industry.  
 
Since they work with private landowners, contractors, governments and corporations, we will discuss a variety of applications, including streambank erosion, retaining walls, retention ponds and sloping. For more information and photos of their work, please see their website: www.maversol.com.
