Coosville Chooses to Preserve the Second While Rejecting Another Tax
 
Despite the irrational warnings coming from the gun control alarmists, 8,905 Coos county voters decided to preserve a valued right of the individual to keep and bear arms by successfully ratifying the Second Amendment measure 6-151 with a 61% majority. 
 
In turn, and in a display of sheer dissatisfaction with the leadership on the Board of Commissioners, those same voters rejected another government grab for the people’s hard-earned cash by vetoing the Transient Occupancy Tax, measure 6-152. 
 
One of the better resulting factors of the election was the national media coverage debating the legal validity of the preservation ordinance, which keeps the issue at the forefront of discussion.  The spokespersons for the leftist news outlets immediately brought out several law experts rebuking the idea of reaffirming the sacred right of self-defense, while the more constitutionally adherent legal professionals presented rebuttals to the contrary.     
 
The Huffington Post immediately posted this very biased headline on November 03, 2015, “Oregon County Passes Measure Directing Sheriff To Block State And Federal Gun Laws P.S.  This is illegal.”
 
The following is a quote from the article:

“Charlie Hinkle, a constitutional law expert in Portland, Oregon, said (Sheriff) Zanni would be violating his oath of office by enforcing a county ordinance that is contrary to state or federal law.
 
"Of course local officials can’t decide what laws are constitutional.  That’s why Kim Davis went to jail," Hinkle told The Huffington Post.  "Even the president can't decide what’s constitutional -- that’s why a federal court enjoined his executive orders regarding immigration."” 
The next day on November 4, The Raw Story had this little provocative teaser, “Oregon voters pass right-wing measure forcing sheriff to act like an Oath Keeper militia member.”
 
Sporting such an outrageous title, it was no surprise their expert espoused this bit of legalese opposing the measure.
 ““The Coos County referendum to nullify state firearms law and require the sheriff to analyze whether federal and state firearms laws are constitutional displays a gross misunderstanding of the U.S. Constitution,” said Robyn Thomas, executive director of the Law Center to Prevent Gun Violence.  “The measure misuses constitutional provisions to support the proposition that a jurisdiction may disobey federal and state laws when residents disagree with those laws on political grounds.””
Even the legal beagles over at The Heritage Foundation were unusually contradictive on the matter with this gem printed in The Daily Signal. 
“Hans von Spakovsky, a senior legal fellow at The Heritage Foundation, said the Supremacy Clause in the Constitution leaves “no question that federal law trumps state law” and that any sheriff who violates a state law requirement could run into legal issues.”
“On the other hand, while federal law can override state and local laws, the federal government cannot force local officials to enforce federal law,” he noted.
However, not all the lawyers were willing to give up these freedoms without a fight.
 
On Sunday, November 8, the publication, The New American, came to the defence of the people’s right to act as the “principal” of the country, and “nullify” unconstitutional laws. 
The most effective weapon in the war against small and large tyrannical attacks on liberty is nullification. Nullification occurs when a state, county, city, or other local entity holds as null, void, and of no legal effect any act of any government body that exceeds the boundaries of its constitutional powers. 
 
As the Coos County ordinance demonstrates, the law of agency applies when one party gives another party legal authority to act on the first party’s behalf. The first party is called the principal and the second party is called the agent. The principal may grant the agent as much or as little authority as suits his purpose. That is to say, by simply giving an agent certain powers, that agent is not authorized to act outside of that defined sphere of authority. 
Using a different argument, the most astute analysis came from constitutional attorney Kris Anne Hall, which the Western Journal published on November 10. 
First, the Sheriff is NOT an agent of the State.  He is an elected representative of The People.  The State does not hire a Sheriff; the People elect him, and they expect him to keep his oath to the people.  Inherent in that oath is the requirement of the Sheriff to protect the people from all who would take their property in violation of their rights.  We expect that our Sheriff, as much as he is able, will help to protect our homes, our property, our lives, and our families from the acts of those who would violate our rights.  But what happens when it’s the government itself that takes up the role of one who would take our rights, the role of the criminal?
Mrs. Hall continues to explain:  “we must educate ourselves on the Truth regarding the application of the Constitution and the proper role and duty of our Constitutional Sheriffs.  May I encourage you to support Coos County, Oregon, and their Sheriff as they act in defense of our inherent Right to keep and bear arms?”

Currently ODF is considering extended riparian buffer rules.  Several of you may wonder why you should be concerned.  The new regulations will affect some operations in what NOAA deems "no kill" of beavers rule included in the proposal.

SALEM, Ore.—The Fish and Wildlife Commission voted to delist wolves from the state Endangered Species Act throughout Oregon today.

The meeting began at 8 a.m. and adjourned at 6:44 p.m. About 106 people came to testify and they were limited to three minutes each.

Commissioners thanked the public for coming to testify and asked that interests on both sides of the issue continue to work with each other.

Chair Finley noted the many people “some in cowboy hats and others in t-shirts supporting wolves” who came out to testify on opposite sides of the issue because they care about wolves. “The Wolf Plan has been working well and you are all responsible for that,” he told the public still in the meeting at the end of the day. “We will remember the merits of the Wolf Plan and the next one will be as good or better. You can all help that happen.”

With the Commission’s decision made, the rule will be filed with the Secretary of State tomorrow, Nov. 10. The filing removes wolves from the state ESA but has no other effect on wolf management at this time.

The Wolf Plan continues to provide protection of wolves into the future. Any take of wolves is tightly regulated in all phases of the plan. Non-lethal preventive measures to prevent wolf-livestock conflict are the first choice of wildlife managers in all phases of wolf management. There is no general season sport hunting of wolves allowed in any phase of the Wolf Plan.

Wolves in western Oregon will continue to be managed with ESA-like protections until they reach the conservation objective of four breeding pairs for three consecutive years. This is known as Phase 1 of wolf management.
Additionally, west of Hwys 395-78-95 wolves are also still listed under the federal Endangered Species Act and the Commission’s action has no effect on their federal status.

Wolves in eastern Oregon moved to Phase 2 of management earlier this year. They will move to Phase 3 after ODFW documents seven breeding pairs for three consecutive years, which could occur as early as January 2017. In Phase 3 while wolves are delisted, controlled take of wolves in situations of chronic depredation or wolf-related declines of prey populations (deer and elk) is allowed with Commission approval.

The vote was not unanimous. Commissioner Greg Wolley voted not to delist while Commissioner Laura Anderson supported delisting only in the eastern part of the state and voted against the motion.

Other Commissioners also expressed support for delisting in eastern Oregon only. However, they noted that Oregon ESA law does not allow for delisting in only a portion of the state. Commissioners will be sending a note to the Oregon State Legislature asking that the law be changed so that listing and delisting would be allowed in only a portion of the state for other species in the future. Commissioners also asked that penalties for unlawfully taking a wolf be increased. Currently, the maximum penalty is a $6,250 fine and a year in jail and that penalty does not change with the delisting of wolves.

The Commission is the policy-making body for fish and wildlife issues in Oregon. Its next meeting is Dec. 4 in Portland.

Here is a rough agenda for the meeting tomorrow night (6:30pm at Coos
Bay Fire Station #1).

Our primary topic will be radio procedure. We need to determine what frequencies we want to use for Primary, Secondary and Tertiary channels.  I will be bringing something called a "jungle antenna" that could be a simple option to boost the range of the hand held Baofeng's if we decide to stick with them. Our goal is a cheap easy way to actually make contact with each other considering many of us don't have licenses yet and not everyone has the option of setting up an antenna in their yard.  Please bring your Baofeng's if you have them. I should have my laptop with me if anyone wants to program their radio. Also, we would like as many members as possible that already have their HAM licenses to attend this meeting.

Second topic will be a possible handgun training class. Dana Glick got some firm numbers on what it will cost to host a class by Northwest Self-Defense Education. We would need at least 10 attendees.

Third will be an update on Rob Taylor's political plans for next year.  I'm hoping he will be there himself, but if not, several of us were at the election night meet & greet so we can pass on what was discussed.

Lastly, Michael Tribble has said February will be best for the trauma class, so for now I need to get some firm numbers on who will be attending the CPR class in January. I can do 9 max in one class. If we have more than that I will break it into two or more classes. I already received enough money from you all for 10 CPR cards thanks to one person who gave way more than enough. Other than that there is no cost for the class. There is no minimum age for the class, so kids are welcome as long as they are strong enough to do the chest compressions.

As you know, SB 941, the Prozanski/Hoyle gun owner registration bill, was passed with an "emergency clause."

This is the process that races the bill into effect and essentially eliminates the public's ability to refer it to a vote of the people.

There are many games the establishment in Salem plays to limit citizens's involvement, but this is one of the most egregious. 

"Emergency" clauses are supposed to be used for "the immediate preservation of the public peace, health and safety" but the process is commonly abused with "emergency" clauses being attached to bills dealing with subjects as mundane as vanity license plates and interior decorators.

Real emergencies are rare, abuses of the process are common. It's time to put a stop to the fabricated "emergencies" and return power to the people.  And you can help.

In another stunning rebuke to the billionaire funded, anti-rights crazies, the people of Coos County have passed a Second Amendment Preservation Ordinance that nullifies dangerous and unconstitutional laws like SB 941.

Coos County Commissioner Bob Main is a strong supporter of gun rights, but the other two Commissioners, John Sweet and Melissa Cribben have served as nothing but road blocks to the defense of liberty, so the people went around them.

This effort, led by Coos County resident Rob Taylor, is one more nail in the coffin of lies spewed by the supporters of more restrictions on your civil liberties. 

While the likes of Val Hoyle and Floyd Prozanski constantly parrot the false statistic that almost "90%" of Oregonians want more of their rights taken away, this measure passed with over 60% of the vote.

In a statement to OFF, Taylor said:

"There were many people involved in the process of gathering the signatures needed to put this measure on the ballot and all of them deserve a huge thank you for taking the time to defend the Right to Keep and Bear Arms.

Several of us who had worked together before decided back in February 2015 that Coos County should pass some law to counter the Background Check bill, SB941.  This group of individuals approached the Board of Commissioners to ask them to enact a Second Amendment ordinance, but Commissioners Cribbins and Sweet refused.  Since I am not a person to take no for an answer, especially from my employees/representatives, I organized a petition committee.  Over the summer, we gathered enough signatures to put the ordinance on the ballot ourselves, and the county clerk approved the initiative for the November election,
 
Yesterday, election day, our measure won the election and now, The Second Amendment Preservation Ordinance is an official part of county code.  Coos County is a "Sanctuary County" for legal gun owners. "

Taylor added:"Moral of the story, never underestimate what a small, determined, well-organized group of individuals can accomplish."  

To which we can only say..."amen."

Predictably, the well funded and shrill extremists that live to destroy the Constitution have attacked the ordinance based on...the Constitution!

In a statement demonstrating once again just how delusional these people are, Ceasefire Oregon said:

"The fringe wing of the gun lobby has truly done a disservice to the taxpayers of Coos County. Clearly, counties cannot nullify state or federal law and they have no power to appoint the county sheriff to interpret the U.S. Constitution. This measure tells criminals they can buy guns in Coos County with impunity and puts the local taxpayers at risk for expensive lawsuits."

There probably is not enough time or space to dissect the sheer lunacy of that statement. The "gun lobby" did a "disservice to the taxpayers?"  
The "taxpayers" passed the ordinance! 
The "gun lobby" was a group of residents. 
But it should not be a surprise when cult followers dig in as their cherished illusions crumble.

Robyn Thomas, Executive Director of the "Law Center to Prevent Gun Violence," said the measure "displays a gross misunderstanding of the U.S. Constitution." In a comical Huffington Post story, far left Portland lawyer Charlie Hinkle (yes he is still around it seems) said "Of course local officials can't decide what laws are constitutional. That's why Kim Davis went to jail, Even the president can't decide what's constitutional -- that's why a federal court enjoined his executive orders regarding immigration." (Sure, tell us about the president Charlie.)

But Hinkle, Thomas and their fellow travelers have been deafeningly silent on Oregon's violation of Federal drug laws and numerous Oregon cities openly refusing to enforce federal illegal immigration statutes.

Shameless hypocrisy is the calling card of the liars who work overtime to attack your rights.

We want to say a resounding THANK YOU to the people of Coos County for standing up to the bullying tactics of frauds like Hoyle and Prozanski who have shown allegiance only to out of state money. And of course, a very special congratulations to Rob Taylor and everyone involved in this incredible effort. You folks led the way.

US House Introducing Conservation Act to Reform Conservation Slush Fund

This week the Committee introduced the “Protecting America’s Recreation and Conservation (PARC) Act,” which includes sweeping reforms to update the Land and Water Conservation Fund (LWCF). Enacted more than 50 years ago, LWCF has transformed into a special interest slush fund with a lopsided funding ratio. Learn more below.

Earlier this week, The Wall Street Journal editorial board published an article about the breakdown of the LWCF, revealing that funds are used for eminent domain projects. The editorial board posed that “Useful updates would include mandating that more spending go toward states, as well as freeing up cash for chipping away at the upkeep backlog and banning the seizure of property. Members of the Crook County Court are now considering Oregon Wild’s plan to lock up wide swaths of the Ochoco National Forest and Prineville BLM District.

In addition to lobbying local officials, the group is also pressuring Congress to pass legislation to make these land set-asides permanent. Oregon Wild’s plan is to create 26,000 acres of new wilderness, and set aside an additional 286,000 acres as a “National Recreation Area,” which only brings more top-down regulation and bureaucracy from Washington, D.C.

We need your help. Please take two minutes and click here to tell the Court and your members of Congress that you oppose this wilderness and land set-aside plan. Tell them these lands should be managed for multiple uses and benefits such as wildfire mitigation and forest access, so more citizens can enjoy these lands in the future.

Oregon Wild’s plan is bad news for Central Oregon’s economy and environment. It is intended to curb sustainable forest management activities, as well as motorized and Off-Highway Vehicle (OHV) access onto these lands. This means federal agencies will be further hamstrung in their efforts to reduce the threats of catastrophic wildfire to local forests, wildlife habitat and watersheds. As we’ve seen elsewhere this year, catastrophic wildfire also threatens private lands, homes and recreational opportunities.

As the Central Oregonian newspaper recently noted, the proposal would undermine local collaborative efforts to restore fire-prone forests back to health. It would also undermine the 129-mile OHV trail system the Forest Service has developed for the national forest.

If you think Central and Eastern Oregon’s federally-owned forests should be sustainably managed for economic and environmental benefits, tell elected officials that Oregon Wild’s Massive Wilderness Plan is not a wise use of our public resources.

An open letter to Coos Bay Schools Board Members
 
According to the most recent The World reporting, after recognizing that there is a cancer on the Coos Bay schools system, after many months of discussions hidden from the public regarding the matter, after courageous teachers and administrators have put the students first and apparently have asserted at least 64 written complaints demanding your attention, you have decided that communication and collaboration is the remedy to what ails us.  Hopefully you folks did not waste the taxpayer’s money or your time searching for that meaningless solution.  Rodney King of can’t we all get along would have offered similar advice for free.  Why wasn’t the selected schools superintendent expected to have the skill of communication and collaboration as a part of her bag of tricks when she applied for the job?
 
I understand that at least 20 teachers and staff have departed the Coos Bay schools system since the arrival of the current schools superintendent.  How many more quality people must resign before you get the message?  Teachers are in demand across the country.  How many over - educated, qualified and under paid teachers are searching for a job here in the boonies?  You have an easily identifiable problem; you have kicked the can beyond the end of the road; the solution can be seen by a blind man; please remedy the problem.  If you were a public corporation, most of you unable to affect a cure to what ails the schools system would be removed from the board.  Lead, follow, or get out of the way.
 
Please understand, in this community of grey haired and informed people who are paying the bills and who take the few minutes required to cast the majority vote in such matters, whose family long ago stopped using the schools system, your planned tax increase and other ballot measures will be rejected.  You must know that you few won’t be the loser; the children will be.
 
In the interest of our children, grandchildren and educators whose pleas are being ignored, remedy the problem now.

Coos County Voters Pass Unconstitutional Ballot Measure

Coos County voters have passed Measure 6-151 which attempts to nullify part of Oregon state law and give the Coos County Sheriff the power to interpret the U.S. Constitution. Ceasefire Oregon characterizes the measure as unconstitutional and unlawful.

“The fringe wing of the gun lobby has truly done a disservice to the taxpayers of Coos County,” said Penny Okamoto, Executive Director of Ceasefire Oregon. “Clearly, counties cannot nullify state or federal law and they have no power to appoint the county sheriff to interpret the U.S. Constitution. This measure tells criminals they can buy guns in Coos County with impunity and puts the local taxpayers at risk for expensive lawsuits.”

Measure 6-151 is a reaction to the passage of SB 941, the Oregon Firearm Safety Act (OFSA), which went into effect on August 9 of this year. OFSA requires gun sellers to perform background checks on prospective gun buyers before a sale can be completed. A background check would prevent people who are prohibited from owning guns, such as felons and domestic abusers, from buying guns.

Monica Kirk, a board member of Ceasefire Oregon and the Central Coast Chapter of Ceasefire Oregon said, “The purpose of OFSA is to stop felons and domestic abusers from getting guns and killing people. It’s that simple.”
The unconstitutionality of the measure has caught the attention of a national law group. Robyn Thomas, Executive Director of the Law Center to Prevent Gun Violence, said the measure “displays a gross misunderstanding of the U.S. Constitution.” She added, “The U.S. Supreme Court’s ruling in Heller made clear that reasonable regulation of firearms is presumptively lawful. This measure is patently unlawful and will bring costly litigation and unwanted negative attention to the County.”

Several Oregon sheriffs have claimed to lack funds to enforce OFSA. No word if Coos County has the funding to enforce 6-151 and if they are fiscally prepared to respond to an increase in illegal gun sales.
