Hey Folks,

 The new CEO of the Nature Conservancy Mark Tercek, who came from Wall Street, is trying to make the organization more accommodating to property owners.  However, many of us are skeptical.  We are doing everything possible to make sure The Nature Conservancy is not making purchases in our area, so they can sell that land to a federal agency.   The Conservancy has an annual budget of $7.7 million with many partnering organizations with budgets just as large. These groups buy and sell a good portion of the designated land scheduled for wetland restoration, and mosquito preservation.  Well, this Wednesday you have a chance to talk with Mr. Tercek and ask him about anything you would like to discuss.  Oh look, they still think I’m a Doctor…..Rob T.

Economic development
spin cycle begins again

Economic development generally refers to the sustained, concerted actions of policymakers and communities that promote the standard of living and economic health of a
specific area.” The US Economic Development Agency was established under the Public Works and Economic Development Act of 1965 to “generate jobs, help retain
existing jobs, and stimulate industrial and commercial enterprise…” A lot of taxpayer money is spent in the name of economic development and in Coos County, just from 2008 through June 2012, $78,498,027 in federal stimulus money flowed into, through and almost immediately out of the county. This equates to $1,246 per person or 2,900 per household and does not include the $16.6 million to buy the Coos Bay Rail Link or the $31 million  for renovations or the millions spent on the Southwest Oregon Regional Airport or any of the other taxpayer funded subsidies and incentives like enterprise zones and business credits.
During this same 3.5 year period, unemployment has risen more than 3 points from 7.9 to 11%, poverty is at 16% and unlike its neighboring counties, Coos County has seen a decline in population. Empirical evidence indicates that government backed economic development does not benefit the working class. Distributing the $78 million in stimulus between each household like an earned income credit would have done more to stimulate the local economy. This is true across the nation, throughout Oregon and nowhere is this more true than in Coos
County
. 

Economic development agencies are not evaluated and funded based upon performance or results but more out of the “glass slipper” syndrome expressed by the local paper. The public is pitched with the promise of jobs and its heartstrings plucked with claims about a broader tax base to fund schools and besieged by information about poverty and homelessness. These techniques are all part of the developer psyche and they sell projects like the $51 million 12″ gas pipeline because it promised jobs, 2,900 jobs in fact… that was more than a decade ago. Spending money in the pursuit of jobs gives us hope, if you ascribe to the editorial opinions of the local paper, and perpetuates a 17th century fairy tale that we too can be lifted out of despair if we are pretty enough or willing to pay enough in tax benefits for the corporate prince to condescend to ask us to dance. Perpetuating the myth also keeps the developer funded and employed. In fact, the state has legislated “wooing” a mandated “high priority” and funds it accordingly. 
 
777.065 Development of port facilities at certain ports as state economic goal; state agencies to assist ports. The Legislative Assembly recognizes that assistance and encouragement of enhanced world trade opportunities are an important function of the state, and that development of new and expanded overseas markets for commodities exported from the ports of this state has great potential for diversifying and improving the economic base of the state. Therefore, development and improvement of port facilities suitable for use in world maritime trade at the Ports of Umatilla, Morrow, Arlington, The Dalles, Hood River and Cascade Locks and the development of deepwater port facilities at Astoria, Coos Bay, Newport, Portland and St. Helens is declared to
be a state economic goal of high priority. All agencies of the State of Oregon are directed to assist in promptly achieving the creation of such facilities by processing applications for necessary permits in an expeditious manner and by assisting the ports involved with available financial assistance or services when necessary. [1981 c.879 §6; 1993 c.106 §1]

To that end, Ray Bucheger a lobbyist who lists amongst his clients the Port of Coos Bay and representing Boost Southwest Oregon, or B.S. for short, is queuing the dance card now via an email rallying support for the Jordan Cove Energy Project and promising once again to “kick-start the economy”.
 
The Jordan Cove Energy Project is picking up steam, but we need your help! Construction of this $7.5 Billion project is set to begin in 2014, but only if the U.S. Department of Energy (DOE) gives Jordan Cove a license to export LNG out of Coos Bay. Whether or not Jordan Cove receives a DOE export license will depend in part on the level of local support for the project. 

Boost Southwest Oregon is a coalition of public officials, business leaders, labor groups and other key stakeholders that was created to rally this support and kick-start the local economy. 

You are invited to join us at 9:00am on Wednesday, April 10th at the Coos Bay Visitor Center to receive an update on the Jordan Cove Energy Project and to learn how you can do your part to Boost Southwest Oregon.  The Coos Bay Visitor Center is located at 50 Central Avenue in Coos Bay.

The power point presentations will be loaded with both dire statistics and positive upbeat predictions about future jobs with above average salaries and stock photos of smiling, handsome contractors wearing pristine hard hats and of happy children studying in state of the art classrooms. We know because this isn’t our first rodeo.

 On a related note, Sen. Bruce Starr, R-Hillsboro, notorious for having introduced the towboat bill that put Captain Yates out of business, has introduced SB 845 which if it passes, would effectively allow the governor to declare a state of emergency in order to exempt large businesses from facing land use appeals.
 
Authorizes Governor and Director of the Department of Land Conservation and Development to exempt certain land use decisions from appeal by contract with member of traded sector industry that agrees to acquire and develop large-site industrial use employing at least 500 full-time employees.

 Apparently, the fairy tale only comes true for big businesses.

Today the U.S. Fish and Wildlife Service signed the Record of Decision for issuance of a permit under  the Migratory Bird Treaty Act for an experiment to test the effects of barred owl competition on northern spotted owl populations through removal of barred owls from select study areas.  The Record of Decision and associated materials can be downloaded from our website :

This week:   According to the UK Daily Mail: “Climate change is on ice: UN scientists reveal the world's barely got any hotter in the last 15 years - but say they are now 95% certain man is to blame for global warming.”  So, to paraphrase, nothing has
happened and yet someone is to blame.

Under the guise of “saving the environment,” we have pushed billions of dollars to environmental causes, and bowed to the will of these well-funded groups to pass thousands of environmental policies.  But it's important to understand that these policies have real-world impacts.

Just yesterday on foxnews.com there was an article about the Rough and Ready Sawmill closing. This was the last sawmill left in Josephine County in southern Oregon. A family-owned business operating for 91 years and three generations and now it’s gone.  Done in by environmental policies. 

How is it that entire movements, like the environmental movement, get started?  Especially movements that are based on flawed, faulty, and even faked “scientific studies”?

This week on the I Spy Radio Show, we talk with climatologist, Dr. Tim Ball and we explore how these movements manage to take off. We’ll also talk about the latest UN report from the International Panel on Climate Change. Guess what: the seas are rising-- again!

The Nature Conservancy thinks I am a financial supporter of their projects and that is furthest from the truth, but I also signed up as a doctor.  We have to monitor this NGO, so we can determine how much land they plan on aquiring.  Check out the slideshow of the 33,000 acres now in the ownership of the Conservancy....Rob T.

Sustainability Grants

Plan Bay Area, which I discussed in the August issue of this newsletter, was partly funded by a $4.9 million federal grant issued by the Department of Housing and Urban Development's Sustainable Communities Regional Planning program. These grants were explicitly designed to promote regional planning of smart growth, that is, high-density, mixed-use developments. In 2010 and 2011, HUD gave out more than $165 million to 74
regional planning agencies in 44 states.

Among the largest grants were $5 million to Salt Lake County, Utah; $4.9 million to Centralina COG (Charlotte); $4.5 million to DRCOG (Denver); $4.7 million to East-West Gateway COG (St. Louis); and $4.3 million to Knoxville. Other urban areas receiving $3 million to $4.3 million grants include Baltimore, Boston, Chicago, Hartford, Houston, Kansas City, and several more.

Stanley Kurtz notes that this grant program "is part of a broader suite of initiatives designed to block suburban  development, press Americans into hyper-dense cities, and force us out of our cars." Most of the money is going to regional planning agencies (also known as metropolitan planning organizations) that are unelected and thus not accountable to the voters. These agencies can use the power of the purse--the ability to distribute or deny federal funds to individual cities and towns--to force local communities to adopt denser zoning codes and prohibit low-density development at the urban fringes.

Congress apparently did not fund this grant program in 2012, but the damage the program has already done will influence the lives of well over 100 million Americans.  Naturally, planning advocates hope to see more funding in 2014, and that debate will take place next week.

Transportation and Housing at the Forefront of Federal Shutdown Debate

If the federal government shuts down next week, transportation and land-use will be among the major bones of contention in the debate. In August, Republicans worked hard to prevent the Senate from passing the Democrat's $54 billion transportation and housing budget (S. 1243). This bill would have spent at least $10
billion more than Republicans think is responsible, partly by funding a number of smart-growth programs.

One of those programs is called the "Choice Neighborhoods Initiative," which provides $250 million for turning low-income neighborhoods into "sustainable mixed income neighborhoods with appropriate services, schools, public assets, transportation and access to jobs"--in other words, a smart-growth urban renewal program. The
Democrat's bill also provides more money for Amtrak, rail transit, and other questionable programs.

When compared with the trillion-dollar budget deficit, $10 billion seems like a drop in the bucket. But when much of that $10 billion is being used to actually reduce the quality of life for millions of urban Americans, the reasons to prevent the Democrat's bill from passing are doubled.

American Dream Conference Gives You an Opportunity to Influence Congress

The 2013 Preserving the American Dream conference will feature Representative Thomas Massie of Kentucky as a keynote speaker. As a noted fiscal conservative on the House Transportation and Infrastructure Committee, Representative Massie will give conference-goers an inside view of the debates over the federal budget and transportation bills.

Other speakers who will talk about transportation budgets and legislation include the Reason Foundation's Bob Poole, Maryland Public Policy Institute's Ron Utt,  transportation expert Ken Orski, and Ryan Bowley of the Owner Operator Independent Drivers Association. Speakers on land-use issues will include Stanley Kurtz on Obama's war on the suburbs; Tom Rubin on Plan Bay Area; Sam Staley on how the Tea Party changed planning in Florida; and Wendell Cox on how cities can become more prosperous.

October 4 is the deadline for making reservations at the Doubletree Hotel at the special conference rate of $139 a night. After that date, prices will nearly double. Coos Bay City Council Rejects Promise of Federalism and Oath

A fundamental promise of federalism is that the state and local governments will act as a watchdog, in our federalist system,  over the authority of the central government, to ensure that the central government does not take power beyond its Constitutional authority and thereby seek to limit the unalienable and fundamental God given rights of the citizens. 

Under Article VI cl. 3 all officers of the state and central government (located in Washington D.C.) must take an oath to support the Constitution. This oath makes state, local and central government officers "federal officers" whose duty it is to protect, defend, support and preserve the Constitution. This is part of the vertical and horizontal checks and balances of our federalist system and all "federal officers" have a duty to protect the federal system. 

From a different perspective we can say that all state and local governments are part of the federal system of government but the central government is not part of the state governmental systems which are independent and sovereign as to each other and the central government. 

​​The states are sovereign and it is in large part their sovereignty that the Constitution, and the federal system within which it rests, seeks to protect.  Such sovereignty is not protected simply for the sake of having sovereign states but because the Framers believed  the maintenance of the states'​ ​sovereignty was essential to preserving the unalienable and fundamental God given rights of the citizens. Only as sovereign states could the states act as  watchdogs over the central government. 

President Kennedy said "The ignorance of one voter in a democracy impairs the security of all."  This is even more true of our state and local "federal officers" who are either ignorant of our federalist systems and their duties to such or simply disregard their duty for other reasons such as laziness or actual distain for our principles of government.   

When local "public servants" say actions and policies of the "federal government" are not
within their realm of authority or part of their job description or they should not waste time on such "federal" issues they are showing their incompetence to hold office. They are also violating their oath to support the Constitution.  They are a clear and present danger to our federalist system and endanger the sovereignty of their state and the Liberty of every man woman and child in this federalist Republic. 

What’s even worse are those who, after being informed of their duties by the citizenry, insist on their anti-federalist and ​u​​n​-American course of action. As Dr. Martin Luther King said: "“Nothing in the world is more dangerous than a sincere ignorance and conscientious stupidity.”  

Once informed of their error, of their ignorance, those that insist on such course are either stupid or in defiance of the will of the people and the obligations of their office. 
 

They must be targeted for removal at the earliest convenience of the citizens. And, until they can be removed the citizens should cover them with a blanket of contempt so that they will either mend their evil ways or beg leave of the situation.

Hey Folks,
The following link will take you to a study titled “Promises Made Promises Broken, The Betrayal of Pensioners, and Taxpayers”.  The report has determined that Oregon has the ninth worst PERS program, which will result in higher taxes for the Taxpayer and fewer benefits for public workers, if the Oregon state legislature does not do something about this problem.   I think government employees should receive some type of pension plan,  but it is going to have to come from the open market not programs sustained by tax dollars….Rob T.

If You Value Your Liberties, Stay Out of Coos Bay, Oregon!

Recently, elected city officials refused to pass a resolution rejecting sections 1021 and 1022 of the 2012 National Defense Authorization Act or NDAA. Based on mere suspicion of being associated with enemy forces, under  the military law of war, can detain an American citizen or lawful resident alien until the end of hostilities, rendition to a foreign country or entity without any form of Constitutional due process. A detained person is not allowed legal counsel, may or may not get a military tribunal and is subjected to torture and even execution.  

On Thursday September 12th we held a work session with the city council. Two of  which requested it themselves but we're not present. One (Dr.  Muenchrath) was called into surgery, so he had an acceptable excuse. The other was councilor Daily. The only ones present were Oregon State  PANDA Director Shane Ozbun, myself, the city manager, city attorney, police  chief, and two city councilors; Melton and Groth. Four  councilors and  the mayor were not present.

The information, including an audio tape of the work session was  provided the next day by the city manager  to all who we're not present.  No excuse was given for them not being there.  There is absolutely no  proof that those not present even read the  material from the work session or listened to the audio tape, prior to  the 17th when they unanimously  voted it down. We were  not allowed to ask any questions.  Therefor, in my opinion that they failed to make a proper decision based on  "feelings" instead of Constitutional facts.

On Tuesday the 17th,  Rob Taylor with Coos Watchdog and myself were present during the City  Council  meeting where we were allowed only three minutes to present our  position against the provisions in the NDAA dealing with American  citizens and lawful resident aliens as unconstitutional. Also, we  request they pass the Restoring Constitutional Governance Resolution  (RCGR). The mayor refused to allow for open discussion, stating that "you've  already had a work session on this." 

We were not allowed open discussion and were angrily stifled by the  mayor as she banged her gavel on the desk. At one point police chief  Gary McCullough and a sergeant maneuvered behind staunch advocate Rob  Taylor, preparing to either remove or arrest him, as he gave a  passionate patriotic testimony, asking them to protect our liberties  from the Federal government.

Councilor Daily made the motion to vote against it, after which it was seconded and voted down.

Several reasons were given. 1. That it' isn't within their authority to go against the Federal Government. 2. They just don't feel comfortable with it. 3. The Federal Government doesn't like it  when we don't go along with them and this could cause problems for the  city (paraphrased). 4. We don't want to tell our police not to do their  job. 5. Let it take it's course through the courts to find it  unconstitutional. 6. We don't have the authority to repeal Federal laws. 7. We can't determine if something is unconstitutional or not. 8. I  just don't feel comfortable with this. 9. I just don't think it's part  of our job as we we're elected to handle only city issues. Video  included. Watch until you see us walk out.

Listen closely to the city attorney's concerns about passing the resolution and what could happen if they did. Even  after we had proven that this does effect American citizens through  documentation, a well done power point and congressional proof,  including bills from several congressmen introducing a bill to repeal  sections 1021 and 1022 that failed in the House. We showed them ​irrefutable proof ​how Senators Lindsey Graham,  John McCain and  Carl Levin pushed for it to include American citizens, calling America  the battlefield.

Oath Keepers made it clear to the council that they are intentionally negligent​ in their Constitutional duties as to their oath of office  under the U.S. and Oregon Constitutions. We showed them a list of venues across the country that have passed resolutions against the provisions  in the NDAA;  stating that out of all of these elected officials having  passed resolutions, that they are all wrong and this council is right?

The Bandon Marsh Mosquito Farm

We are the federal government, we can do what we want, and you can do nothing to stop us.
In November 2011, the US Fish & Wildlife Service sent a letter to owners whose properties lay within an area proposed for expansion of the Bandon Marsh outlining a proposal to acquire their land.  Since then, this federal agency has tried to bully the people of Coos County while displaying only indifference to the needs of farmers, their livelihoods, and our local rural economy.   The Bandon Marsh is located next to the city of Bandon, Oregon, near the mouth of the Coquille River and the Pacific Ocean.  Currently the marsh incudes less than 1000 acres divided into two parcels, the Bandon Marsh Unit and the Ni-les’tun Unit, separated by Bullard’s Bridge on Highway 101.  The Service has plans to expand the marsh by 4500 acres, extending its area up both sides of the Coquille River to the 10-mile marker.  Under its plan, known as The Bandon Marsh National Wildlife Refuge Restoration Project, the Service wants to buy land from “willing sellers.”  To date, most property owners in the proposed expansion area have made clear they do not wish to be “willing sellers,”creating a major obstacle for the agency. 
 
The USF&WS completed the first phase of the marsh expansion on the Ni-les’tun unit in 2011.   The following is the agency’s own description of their efforts: “In September 2011, the Refuge completed marsh restoration for this unit.  The influx of saltwater and freshwater will allow re-establishment of mudflats and marsh plants, and interconnecting tidal channels bisect the wildlife habitat south of the overlook deck.  As the land returns to a rich functioning intertidal marsh, flocks of seasonally driven migratory birds and young fish will use the restored habitat.”  
 
 
What the Service failed to mention in their report is that their work on this project would also spawn millions of mosquitos -- destroying residents’ quality of life, harming livelihoods and endangering the health of humans, animals, and wildlife.  Many people, including biologists and health professionals, believe the explosion of mosquito larvae populations directly resulted from work done by the agency during the first phase of the marsh expansion.  Some even believe the mosquito invasion may have been a deliberate tactic to turn current property owners into “willing sellers”, thereby eliminating the biggest barrier to marsh expansion.   
 
It is hard to believe the Service could not have foreseen the mosquito problem.   It is not new.  In fact, efforts to fight mosquitoes in this area began more than a century ago.
 
The Swamp-Land Act of 1860 empowered the state of Oregon to dike marshes and drain swamps for mosquito abatement.  In the early 1900s, The Army Corps of Engineers repaired tide gates on the Coquille River to prevent tidal waters from moving into the valley.   Before the construction of these gates, the tide would rise into the valley, while the receding water pooled in stagnant ponds, creating perfect breeding grounds for mosquitos.   Fear of mosquito-borne diseases, which include malaria, yellow fever, encephalitis and others, led the Corps and local interests to install the original tide gates.  The Service should have known the history of the area before they removed the tide gates during the first phase of the project.   With all the available, historical documentation and professional experience with other wetland restoration projects, one wonders if the agency’s conduct was a case of inexcusable ignorance or, even worse, willful malfeasance. 
  
Recently, there has been a spate of news stories about Bandon’s mosquito problem. It has become such a serious issue that, on August 30, 2013, Senators Wyden and Merkley, and Congressman DeFazio wrote a letter to the new Secretary of Interior, Sally Jewel, demanding that The Department of Interior take immediate action to alleviate the problem. In the letter, the Congressmen put the blame for the “mosquito invasion”directly on the expansion of the marsh and at the feet of the US Fish & Wildlife Service.  
 
In early August 2013, the Service issued a press release announcing that the Bandon Marsh expansion was “suspended” due to lack of funding.   The suspension is a small victory for the opponents of the marsh expansion, proving that the people of Coos County can stop government action – in this case, a federal land grab -that harms our area when we set aside differences and work together. 
 
This same, unified approach is needed to help people dealing with aggressive mosquitoes and caustic chemicals for vector control.  This catastrophe was manmade and avoidable.   Those responsible must be held accountable.   The fight to rid the county of the agency’s unwanted actions must escalate or the residents of the region will have to tolerate swarming mosquitos and exposure to insecticides from aerial spraying for the foreseeable future.  The only real remedy for this problem is a class-action lawsuit against The US Fish & Wildlife Service that uses the force of the courts to get the agency to replace the dikes and drain the marsh.  The people who have suffered tangible loss should seek compensation through legal action. 
 
In addition, the battle against government-created wetlands will have to expand to include projects such as the one in the China Creek, Winter Lake area.   According to a seven-stage priority restoration map produced by The Nature Conservancy, The USF&WS and the Conservancy are making plans to acquire another 15,000 acres in the Coquille Valley, which was evident in the Conservancy’s application for a grant from the Oregon Watershed Enhancement Board. If they execute the plan properly, the Bandon Marsh expansion area will connect to the Oregon Department of Fish & Wildlife’s Winter Lake Restoration Project.   At that point, the entire valley would become one large mosquito farm.

Where would that leave the people of Coos County?

 APHIS Final Rule Revising Pet Seller Exemptions and You

SAOVA Friends,

As  you know by now, APHIS published the Final Rule September 10, 2013 which revises the definition of "retail pet store" under the Animal Welfare Act (AWA) licensing and regulations. The new definition of retail pet store means a place of business or residence where the seller, buyer, and animal are physically present in the same location. Not only dogs, but cats, rabbits, mice, small exotic animals, and other small pets will no longer be sold at retail without either public or APHIS oversight.  If you cannot qualify for the retail pet store exemption in the AWA by selling only face-to-face, then you must either obtain a federal license or be limited to 4 or fewer females bred and raised on your premises. This limit of 4 is an aggregate number of females regardless of species (i.e., 2 dogs, 1 cat, 1 rabbit).

The transaction does not have to take place at the seller’s home.  A meeting place can be set up to transfer the animal. However, everyone needs to be aware that many municipalities have ordinances restricting sales in public places and should plan accordingly. It appears APHIS will allow a third party to be designated as the agent to stand in for the breeder or buyer in the face-to-face transaction, but this needs additional clarification.

Anyone selling dogs for hunting, breeding, security purposes, or as working dogs is excluded from the definition of Dealer and from the definition of Retail Pet Store.

Hey Folks,

The National Fish & Wildlife Foundation is the organization that funds land aquisitions for the agencies in The Department of Interior and Americans have a duty to stop this drain of money.  This foundation is where the US Fish & Wildlife Services receives money for projects like the Bandon Marsh expansion.  One clue to know how bad this bill is for the people, Senator Barbara Boxer is the Sponsor.  Need I say more?...Rob T.

Summary 
We, NMFS, announce a 90-day finding on a petition to delist the Southern Oregon/Northern California Coast (SONCC) Evolutionarily Significant Unit (ESU) of coho salmon (Oncorhynchus kisutch) under the Endangered Species Act (ESA). We find that the petition does not present substantial scientific or commercial information indicating that the petitioned action may be warranted.

 This is a twenty minute video of members and guests of the Constitutional Sheriffs and Peace Officers Association gathering in Las Vegas Jan 30th, 2012. Hosted by Sheriff Richard Mack (Ret) founder of the
CSPOA.

We felt that if you watched this video, coming of others who have already passed a resolution titled Preserve Habeas Corpus and Civil Liberties. It might make more sense to you, particularly coming from a county commissioner and sheriff in Colorado explaining why they unanimously passed it.

El Paso County Commissioner Peggy Littleton shares with the sheriffs and peace officers in attendance on Monday how she and her board developed  and passed their resolution to nullify indefinite detention prescribed  in the National Defense Authorization Act passed Jan 2012.

El Paso County Sheriff Terry Maketa, who supports the nullification  measure, explains how prior to the current board of commissioners he  felt he stood alone, when it came to upholding the people's liberties.

On January 30-31, 2012 over 100 county sheriffs and peace officers, from over 30 states, united to uphold their oaths of office, protect citizen liberty, and stop state and federal tyranny. Inspired and led by the  example of former Graham County

The following grant application was written by Steve Denny of the Nature Conservancy.  ODFW and The
Conservancy is trying to finance a Tide Gate for a piece of property in the China Creek, Winter Lake Area.   They want to create a wetland by placing a dike to make a permanent lake.  The project will create
