Responding to a request from Commissioner Dan Saltzman, Portland Police Chief Mike Reese Tuesday released a proposed policy that would restrict police use of video surveillance cameras and their images.

The proposed "Electronic Video Surveillance Directive" states that any use of electronic video surveillance equipment by police will comply with local, state and federal law; be used in a "professional, ethical and legal manner," and will not invade anyone's privacy rights.

While the rest of America was settling in for the Memorial Day Weekend the Supreme Court decided
to restrict the terms of one of this country’s founding principles by slightly eroding the protection from being tried twice for the same crime 
 
Double Jeopardy is an established protection that has long standing in this country in The Fifth Amendment in the Bill of Rights of the US Constitution.   Many people suffered needlessly for crimes they did not commit when our country was under the rule of England.   One of the most diabolical tools used by the King against the enemies of  the crown was to put a person on trial several times for the same crime until that person was found guilty.   People would languish for years in prison and it was a way to silence dissension of the government.  
  
The action taken by the Supreme Court on May 24, 2012 stems from a case originally tried in Arkansas
where the defendant was charged with four different crimes:  capital murder, first-degree murder, manslaughter and negligent homicide.   The jury in the first trial was deadlocked.  There was no vote on the crime of negligent homicide and they were divided over the question of manslaughter, but did come to a unanimous decision that the defendant was not guilty of capital or first degree murder.   The Judge declared a mistrial and the Prosecutors decided to retry the defendant on all charges in the case of Blueford v. Arkansas, No. 10-1320.
 
However, during deliberations of the case, the Defense asked the court to submit new verdict forms to the jurors asking for counts on the already decided verdicts. The Prosecution objected, because the jury was still deliberating and an acquittal had to be, “all or nothing.”  The Defense request was denied by the court and the court made its ruling.  
 
The origins of the argument begin in the fact that the case was declared a mistrial and did not get a final ruling on the actual charge, so therefore the prosecutors in the case filed for a retrial believing the defendant was not protected from Double Jeopardy.  In addition, the jury in the first trial, during the trial, again was able to deliberate over the charges, nor was it prohibited from reconsidering its vote on the more serious of the charges, and could have changed its mind at any time before returning to the courtroom.  That is the splitting of legal hairs.
 
The attorneys for the defendant claim that because the jury made a consciously unanimous decision and decided that the defendant is innocent of the most severe charges, this gave their client freedom from retrial for the same crimes.  It was the belief of the attorneys that the prosecutor could retry their client for the lesser charge of manslaughter. It is formality and the lack of the finality of the ruling where the defense has the problem of claiming Double Jeopardy.
 
It is not improper for a court to declare a mistrial when ““particular circumstances manifest a necessity”.  However, the defense argued that since the foreperson reported that the jury had already voted unanimously against the two more serious crimes, at that point in time during the trial, the court should have taken some action to obtain a partial verdict.  
  
The defense in this case has to acknowledge that the jury was limited to two options: either an all-out acquittal or conviction of one of the other charges.   There was no reason, nor any obligation of the court to give a third
option to the jury for acquitting on some of the charges.  That is the crux of the debate and that is what gives rise to the several  distinct opinions in this trial.  The Supreme Court has never required a trial court to consider any other way of breaking an impasse before declaring a mistrial because of a hung jury,  much less given new choices for the jury to consider.
 
Supreme Court Justice Roberts, Scalia, Kennedy, Thomas, Breyer and Alito gave the opinion that the defendant could be tried again, because the original court was justified in declaring a mistrial with no final verdict.  Plus, there was no formal verdict on the disputed charges.  With a 6-3 divide Justice Sotomayor, Ginsburg and Kagan filed the dissenting opinion citing the jury came to an informal decision, which should have been recognized
by the court, thus giving the defendant Double Jeopardy protections.    These laws keep the courts from getting another “bite at the apple” and abusing the system.   In one instance of the dissenting opinion there was a quote from a similar trial Sanabria v. United States claiming, “Form is not to be exalted over substance.”  
  
In the Blueford case, the dissenting Supreme Court Justices made the opposing opinion based on the jury’s decision and that was on the charges of capital or first-degree murder, even though a court of law did not formalize those decisions.
 
It is my opinion that the jury should have been able to deliberate on the criteria of the trial based on the individual case they were adjudicating, but only after the informing of the jury about their right to deliberate the laws, which established the crimes charged against the defendant.   If the juror finds the law to be as offensive as the crime charged against the defendant, or the charge overreaches the crime committed, then the  jury or one juror can nullify the law.   Unfortunately, that would still lead to a mistrial, so the state court  should have reformulated the charges in a manner so that the members of the jury could have made an objective decision. The court could have done that at trial,  or they could have allowed the jury to submit their own standards for the
charges, within the definition of state and federal law, and added it to the verdict forms they were filing. 
   
The Supreme Court should have found in favor of the defendant or the case should have been rejected and sent back to the state of Arkansas.  Either way, this is a case of an uninformed jury being left to the devices of an overbearing justice system, a system that was originally designed, so that ten guilty men would go free before
one innocent man should ever be found guilty.  The Justices made the wrong decision based on a bad premise.

    So if I'm not mistaken, the Urban Renewwal (taxpayers) bought the land for $500,000, and the Port of Bandon (taxpayers)  loaned them the money to build it, and they get free rent and won't pay any    property taxes?

I had a phone conversation with one of our group who  had met with the City Manager yesterday.  There were two meetings. The  first one got out of hand, so it was ended. Apparently the Manager presented  some
smart mouth and Diane Shaeffer of our group took him apart. Later the  Manager called Bill Stieber, a member of our Yes group, who he recognized as  trying to be a peacemaker and invited him back to his office.

In the conversation that developed there, the Manager  told Stieber that the City will not contest the measure and he assured him that  the Mayor concurs. Apparently they have been advised of their responsibilities.
  They will accept that the Measure represents the will of the people.

The discussion included seeking some resolution to the  financial problem that the City faces. I told Bill that he had better not pursue  this and explained why. He understands and will go no further. I do not
know how  they will proceed with budget resolving. We must stand back from that  unless invited to the table. We can and will use the website to influence budget proposals, however.

I will attach a picture of the sign for you. I  arranged for a man-lift and took care of the patching and painting of the high  work before applying the sign. There is still some work to finish from the  ground, but the owner wants to do that himself.

I will have Signs Unlimited  prepare an invoice to  AFP, Oregon c/o yourself. Will that work? 

In closing, I will say that is nice to win and it has been made easy because of a good plan and a lot of help. I did not know at the  time how this would turn out, but I did know that if it were a Charter  amendment, only the people could make changes to that. This really has  surprised a lot of quarters. Similar measures have had problems leading to  some reversals and that is what the press kept saying was going to happen 
here.

Anyway, we appear to have come out of this as a force to be reckoned with.

Diary update  5-28-2012

5-9-2012, Wednesday, the Charter was taken to the Voter  Registration office for filing by the County Clerk.
Dede and Debbie made a duplicate copy  for their records and we asked for & received  a" conformed copy", one  certified by them to be a true copy of the document just filed. Cost:  $11.25. 
 
5-10-2012, Thursday,  Dan of The World requested,  and was given, a telephone interview regarding the Charter. It was to be in  the paper  

5-12-2012, but was not published.

5-12-2012, Saturday, a private gathering to celebrate the filing.

5-15-2012, Tuesday,  Ronnie requested the BOC  put the proposed Charter on the November ballot.  They did not  respond, however Cam Parry came out shouting about how it took all the citizens'   rights away. Dan
said he was waiting to see the BOC's action today before  the interview was printed.
 
5-16-2012, Wednesday, about 4:55PM we again called the Clerks  office and was told by Terri Turi the document had passed the  "Constitutional  Sufficiency  Test" and letters had been mailed to the  chief
petitioners .  ( It seems it is not required that the filing group,  ARRRG, be  notified in any manner.)
We were also informed the document has been forwarded ( 2  copies ) to the District Attorney's office for the ballot title, as  requested.

5-24-2012, Thursday, Dan, of The World,  telephoned  saying he had interviewed Cam Parry and the Disrict Attorney and they had grave  reservations.  He asked for my response.  I requested he put  the concerns they
had in an e-mail to me. He complied, stated he was  on deadline, and requested a quick response.  I soon telephoned him with my  reply. 
 
 
5-24-2012, Thursday afternoon,  in going to the Coos  County  website main page we happened upon the ballot title for the  document.  As it was neither dated nor signed it is not known for sure when  it was posted or by
whom. The review and challenge date written by Terri  Turi in her

5-22-2012  letter ( and ' NOTICE OF RECEIPT OF PROSPECTIVE INITIATIVE  AND BALLOT TITLE FOR
HOME RULE CHARTER' ) to the petitioners states "  6-1-2012 5:00PM".  As this is a Friday there is no way we can know if  a challenge has been made until


6-4-2012.  If a challenge is made we  will have limited time to reply to any possible challenge before a judge.  We will be contacting our attorney first thing

6-4-2012 to discover if a  challenge has been made. This also would delay and shorten our signature  gathering time.... but we will make it! 
  
5-25-2012, Friday morning, Dan left a telephone  message saying he was on deadline for Saturday but needed my reply  regarding the D.A'.s concern the Charter would devastate the county  health care system because we
were eliminatiung all grants for the  department.  I e-mailed him, quoting from chapter 21,  "....The  County shall not demand or enforce any health initiatives, measures, programs,  or regulations that violate the citizens'
personal choices regarding health care  decisions nor will the County accept any grants, gifts, endowments, or other  items of value that prescribe such demands or  enforcement."   Dan's article was not printed in the Saturday  paper. 
 
5-26-2012, Saturday,  I telephoned Dan regarding no  article in the Saturday paper.  He stated he decided to wait and put  it in the Monday paper.  I mentioned to him that when the powers that be  stated they wanted an
Administrator style government it has been immediately  reported as a great thing and then restated over several articles. He said there  was no conspiracy here.

5-28-2012, Monday. Dan's article is on The World front  page.  It is sad to me that one of our commissioners ( the only  one speaking for the BOC these days )  would choose to do character  assassination on me and
speak 180 degrees off the truth of what the English  language in the Charter says, rather than speak on the actual statements in the  Charter itself. Our job  is to provide the citizens an opportunity to read  the Charter for themselves.

Executive Director Update #C-7: 2010 Coastal Wetlands Grants


Background
This report provides an update on the status of the federal 2010    U.S. Fish and Wildlife
Service  (USFWS) Coastal Wetlands Grant Awards projects. The Coastal Wetlands    Grants offer a
significant partnership investment opportunity to restore and protect coastal wetland and estuary
ecological values,  promote strong partnerships, and provide a    significant match to OWEB
funds. 2010 Coastal Wetland Grants

 In June of 2010, OWEB submitted three applications on behalf of  coastal partners for project funding under the Coastal Wetlands Grant Program, after having received permission from the Emergency Board to apply for the federal grants in May of 2010. On    December 22, 2010, the Secretary of the Interior announced the awards that included all    three applications submitted by OWEB. Combined, the three federal grants total approximately $2.4 million and require a total state match of just over $1.5 million. The three projects are summarized below.

Coquille Valley Wetland Conservation and Restoration –
The Oregon Watershed Enhancement Board was awarded
$1 million to help acquire and restore    approximately 622  acres of coastal wetlands in the Coquille Valley on the southern    Oregon coast for permanent  conservation, protection, and restoration by the Oregon Department    of Fish and Wildlife (ODFW). This project is the first phase of a larger initiative by    ODFW to conserve and restore approximately 3,000 acres in the lowlands along the lower  

Coquille River encompassing some of the most productive wetland habitats on theOregon Coast. The total
cost of the first phase is $2,506,000. Protection and restoration of  freshwater wetlands would complement downstream estuarine restoration efforts on Bandon    National Wildlife Refuge. This project would protect nesting, feeding, and nursery areas for a    diversity of at-risk fish and wildlife species, including Oregon Coast Coho salmon,  Coastal    cutthroat trout, Bald eagle, Purple martin, Willow flycatcher,  Western meadowlark, and    Townsend's big-eared bat. The Nature Conservancy is providing technical and  financial support for this effort  through the Northwest Wildlife Conservation Initiative.

A couple of weeks ago, Erin Ryan  of the We The  People radio program out of Redding,  California invited me to be a guest on  her program to talk about Public-Private Partnerships.  She'd been ill and I've  been busy with my Smart Meter issue so we didn't get a chance to talk about what  we were going to talk about until the night before the program.   In the course  of the conversation, Erin was telling me about some developers who were going to build  a mall outside of town at a location that didn't have the proper  infrastructure, the project would pull shoppers out of the downtown and the size  of the mall seemed overly ambitious given the population and the condition of  the economy.   As Erin was talking, I thought,  I know this story.  I wrote this  story - but it wasn't about Redding, it was about Star, Idaho.

 The  first time I wrote about Star, I just did a timeline because there were so  many players involved and what they were doing  was so anomalous that I had a  hard time keeping it straight, but what I did  know is that whatever was  happening was related to Agenda 21.  Last year, I expanded  the Star timeline into a story format.   With all my research on foreign  trade zones (Trojan Triangles), the picture  that comes together is a formula  plan to collapse local, elected representative  government replacing it with a  regional, metropolitan governing structure run by a "public-private partnership"  committee (soviet).   It is a fascist system
that collectivizes the departments  of government into specialized districts  over which the taxpayer/citizens have  no control.   It cannibalizes government from the inside out.   The punch line  is the definition of an inland port connected to a corridor (shipping lane) that  allows the zone to be governed under Admiralty Law as opposed to the law of the  land.  

On the citizen side, it starts  out with a ridiculous development plan that gets the citizens riled up
and then  it's showtime:


On the public side, the  Feds swoop in with money for enhanced 9-11 -  but in order to get that money,  they need to have cross jurisdictional agreements for first responders - for the  sake of efficiency.  That means agreements between local police departments and  county sheriffs.  In order for the local police
department to participate, they  need the city mayors to have a cross  jurisdictional agreement.   This results in  a metropolitan regional emergency services district.  On the citizen side, community change agents swoop in
with  money to organize the grassroots to fight the evil developers.  The developers  bring in their change agents.   Of course, the FEDs have grant money ready and  waiting for "community planning".  The resolution to this dialectic is a  regional land use and zoning agreement including a packaged set of zoning
and  building codes.  This packaged set of codes is supplied by the Smart Growth Network.   

Once the soviet (committee or commission) is established  for land use and zoning, your elected officials are no longer in control.  They become puppets of the soviet.   Collectivization of the other functions of local  government can then take place - probably - most significantly, consolidating  the information systems of local government - again in the name of efficiency  and cost savings - probably accomplished by a contractor who
takes over the  systems for the purpose of the consolidations.  

As I've been saying for the last 10 years, it is the  consolidation of government functions through systems design and control of the  computer systems that is the essence and power of the 'New World Order'.  By
  definition it is a fascist, corporate system combined with collectivization and  management of the "assets" of the corporation.  It is the privatization of  government through the privatization of the administrative functions of government.

 Today in my inbox, there was an email from Charlotte  Iserbyt.  Charlotte has a treasure trove of documents that she's collected over  the years that she sends out to researchers as we all try to put the pieces of
  the puzzle together to understand what is happening to our country.  The  document she sent today, is the capstone for me.   It pretty much let's me say,  "Case Closed". 

The Garvey  Memo is followed by source information for the Houlihan Plan that was produced  during Reagan's
term as Governor of California.I  knew about the Houlihan Plan but this is the first time I've seen the Garvey  Memo.
   
Of course there is much more to the story, but it's too  big to put on one webpage.  Last year I did try to tell the story in a powerpoint presentation.  It has all the major elements that are, I hope,  self-explanatory.

Middle management never seems to get much love. In 2011, the state  Legislature
passed a law that sets a goal of 11 staffers for every  manager working for the
state. Of course, there are exceptions depending on the work being done, but the
consensus was the state needs fewer  managers and more people on the ground.

It seems I was put on the planet to educate people about the negative economic impact of excessive
government
. Though I must be doing a bad job because the burden of the public sector keeps rising.


But hope springs eternal. To help make the case, I’ve cited research from international bureaucracies such as the Organization for Economic Cooperation and  Development, International Monetary Fund, World Bank, and European Central Bank. And since most of those organizations lean to the left, these results should be particularly persuasive.


I’ve also cited the work of academic scholars from all over the world,  including the United States, Australia, and Sweden. The evidence is very persuasive that big government is associated with weaker economic performance.

Dear All,
    Just got off the phone with a Board Member who sits on the O & C    Board, who just got back from an O & C Mtg. in Salem   (O&C Board is comprised of 18 counties and comprises 2.6 million acres).

    Key Pts From Mtg.:
Presentation was given by Jody Caicco, USFWS   Portland Office.
    1. Draft EIS with comment period ending June 8th has been completed    by USFWS to
    remove the Barred Owl from protection in favor of the Spotted Owl.

    2. Proposal includes killing Barn Owls which is not an endangered species in order to protect
     the Spotted Owl.

    3. There will be only 1 public meeting on the issue in Seattle. We need to find out when and get
    a group or buses.

    4. USFWS in collaboration with the BLM (see link above) is preparing to counter the turn-over of O & C lands   to the Counties with  a move that will increase critical habitat areas from 5.3 mil acres  to 13.9 mil acres.

    5. New Critical Habitat lands in Oregon will include 670,000 acres of State-owned land and 1.3 mil acres
    of private lands.

    6. Increase of Critical Habitat Lands will limit what Counties can do with land and limit Counties ability
    to manage and log.

    7. BLM conducted the North West Forest Plan which took 5 years and is in the process of beginning a new study  on Logging (No-logging) BLM Lands. The work that won awards and    recognition that the Coquille Tribe
received for responsible    sustainable  Logging was actually conducted by the BLM.

BLM Q & A 
What is the purpose of the planning effort? 
The new Resource Management Plans  (RMPs) will define new goals, objectives, and management direction for the  BLM-administered lands in the western Oregon. The RMPs will result in a different mix of resource protections and resource uses than currently exists.  The new RMPs will determine how the BLM will manage BLM-administered lands in western Oregon to meet multiple objectives, including contributing to recovery  of threatened and endangered species, to provide clean water, to restore fire
adapted ecosystems, to produce a sustainable output of timber products, and  provide for recreation opportunities. 

Why is the BLM doing this now? What's different from past efforts? 
There are several factors that have
contributed to BLM's decision to initiate a RMP revision process, including the
ongoing litigation associated with the 2008 planning effort, the U.S. Fish and
Wildlife's 2011 recovery plan for the northern spotted owl, the 2012 proposed
critical habitat for the northern spotted owl, and the underlying Federal Land
Policy and Management Act requirement for the ongoing maintenance and revision
of land use plans. 

Recognizing the contentious nature of forest management in western Oregon, the BLM is interested in exploring new and innovative approaches that address the social, cultural and economic dimensions
of forest management. 

Are the Secretarial pilot projects going to be part of the new planning effort? 
The BLM has recently completed several Pilot Projects intended to fulfill the Secretary of the Interior's
direction to apply ecological principles developed by Drs. Norm Johnson and  Jerry Franklin, on BLM-administered lands within the Roseburg, Medford, and Coos Bay Districts. The pilots are now completed and information learned from these efforts will help to inform the RMP revision process. 

What plan(s) is the BLM  revising? 
The six western Oregon BLM districts completed RMPs in 1995 that incorporated the land use allocations and Standards and Guidelines from the Northwest Forest Plan. In 2008, the BLM completed RMP  revisions for the six western Oregon districts. 

Ongoing litigation is seeking to set aside the 2008 Western Oregon RMPs (WOPR). The BLM intends to revise its RMPs  notwithstanding the pending litigation. The BLM will continue to manage these
lands in accordance with the existing RMPs until the revised RMPs are completed
and a Record of Decision is signed.

On Proposed Spotted Owl  Critical Habitat, Announces
Public Meetings  Schedule

New deadline is July 6, 2012 
 
        The U.S. Fish and Wildlife Service (Service) is extending the   public comment period through July 6, 2012, on the proposed        revision to the critical habitat designation for the northern  spotted owl, a threatened species protected under the Endangered  Species Act.  The Service will host three open meetings and one        public hearing to seek input on the proposal.  Documents for  review and explanatory information are available at www.fws.gov/oregonfwo  on the “Spotted Owl Main Info Site.”

clicking on “Send a        Comment or Submission.” By hard copy:  Submit by U.S. mail or hand–delivery        to: Public  Comments Processing, Attn: FWS–R1–ES–2011–0112;        Division of Policy and  Directives Management; U.S. Fish and        Wildlife Service; 4401 N. Fairfax Drive, MS 2042–PDM; Arlington,        VA 22203.

The  original 90-day public comment period on the proposed critical   habitat, which began on March 8, is extended through July 6 to  coincide  with upcoming public comment periods on an economic   analysis and
environmental assessment related to the critical     habitat proposal.   Those two documents are expected to be   published in the Federal  Register in late May and both  will be available for a 30-day public review and comment   period (see attachment for a full schedule of all  spotted owl recovery-related public information forums).

    
    A critical habitat designation identifies areas within the range  of a species at the time it is listed under the Endangered  Species Act that have the physical or biological features        essential for the conservation
of a species and that may require   special management.  For the spotted owl, these features include        particular forest types of sufficient area, quality, and configuration to support the needs of territorial owl pairs   throughout the year distributed across the species’ range,  including habitat for nesting, roosting, foraging, and        dispersal.   Federal agencies must avoid activities that  jeopardize listed species and  must ensure any action they        authorize, fund, or carry out does not destroy or adversely modify designated critical habitat.  A critical habitat  designation that includes private or other non-federal lands has  no direct effect on land uses unless there is a federal   connection, such as an activity that is funded or permitted by a        federal agency.

This is a really bad decision.  It goes against the Fifth Amendment and the tradition of protection from Double Jeopardy.

WASHINGTON — The Supreme Court ruled on Thursday that a criminal defendant may be retried even though the jury in his first trial had unanimously rejected the most serious charges against him. The vote was 6 to 3, with the justices split over whether the constitutional protection against double jeopardy barred such

Cars are confiscated and sold. Currency is confiscated and kept.

 It’s all legal. And it’s spreading.

 Then there is the DEA: “. . . in all states, police agencies can contact the
Drug Enforcement Administration (DEA), making the case federal, and under
federal law, local police departments can keep up to 80 percent of forfeiture
proceeds, with the rest going to the Department of Justice.”
Now, that’s a tempting offer!
