Are Americans safe from the threat of indefinite detention and should local representatives do something to ensure the right to trial?

 The Department of Defense’s budget is funded with the annual passage of The National Defense Authorization Act. With each year’s passing Congress adds more provisions to the law, compounding the already controversial nature of its intent. In 2012, Congress added Sections 1021 and 1022 to the bill, which codified the indefinite military detention without charge or trial of citizens
for the first time in American history.

The application of the “law of war” covers all U.S. citizens. The law purports to reaffirm the 2001 Authorization for Use of Military Force (AUMF), which was a poor substitute for a legitimate declaration of war for the invasion of Afghanistan.

Hey Folks,

The decision about the land trade between Bandon Biota/Dunes and Oregon Department of Parks & Recreation  has been made and it is a go. Grose Ranch for gorse.   Now, lets call our representatives and let them know that these types of land swaps are veiled attempts to hide what is really going on.  The state of Oregon is trying to acquire more property from nongovernmental organizations for wetland restoration, so they can use it for tax mitigation.  All of these land swaps are used in these billion dollar taxing scheme's for politicians and businesses will have to pay to play. The tax payer will pay whether we play or not....Rob T.

A complex land exchange, one of the most significant in Oregon State Park history, was approved unanimously Wednesday by the Oregon Parks and Recreation Commission at a scheduled meeting in Corvallis.

The exchange still depends on another vote by the commission in February, following additional field work by state parks staff and completion of land appraisals, but the Wednesday vote "clearly shows that the commission fully expects complete affirmation of all elements of the exchange,'' said Chris Havel, spokesman for the Oregon Parks and Recreation Department.

The final pet seller rule goes into effect on November 18, 2013. This rule would extend APHIS authority to include large segments of the retail pet trade as regulated under the Animal Welfare Act (AWA), including pet species as dogs, cats, guinea pigs, rabbits, and hamsters, among others. The overarching intent of the revision is to regulate sight unseen retail pet sales, which, without proof, APHIS claims have dramatically increased as a result of growing Internet usage. APHIS also claims the rule closes a so-called �Internet loophole� and restores the original intent of Congress for administration of the AWA.

Challenges from the Center for Media and Democracy

PORTLAND, ORE. – A self-described “progressive watchdog group” has launched a questionable campaign to discredit limited government, free-market oriented public policy research groups across the country, including Oregon’s own Cascade Policy Institute.

Taking a page out of the late Chicago community organizer Saul Alinsky’s book, Rules for Radicals, the Center for Media and Democracy (CMD) is personally attacking both those who work for and those who help fund these organizations.

Two of the Rules for Radicals state: “Ridicule is man’s most potent weapon” and “Pick the target, freeze it, personalize it, and polarize it.” CMD is following both these rules by posting supposedly inflammatory information and accusations on its derisively named website, www.StinkTanks.org.

Oregonian senior political reporter Jeff Mapes wrote a story yesterday about CMD’s claim that Cascade Policy Institute “…and dozens of like-minded think tanks around the country receive major funding from secretive national donors to push a conservative agenda.”

Cascade’s president, John A. Charles, Jr. responded, saying, “It is ludicrous to think that Cascade is operating in lockstep with other organizations to promote any specific policy agenda. As a free-market think tank, we don’t believe in central planning, either in government or in the non-profit sector.”

Charles continued, “We set our own research agenda, approved by an Oregon-based board of trustees, which promotes individual liberty, economic opportunity, and personal responsibility.”

As to the charge that some of Cascade’s funding comes from a group of “secretive donors,” Charles notes that the IRS allows anonymity for donors to non-profit 501(c)(3) organizations, including charities, schools, churches, think tanks, and others.

“We respect the privacy of our donors, whether they are large national funders or the individual Oregonians that make up the bulk of Cascade’s supporters. Contrary to the mistaken belief of CMD, we don’t promote the agenda of our donors; they voluntarily choose to support our agenda of personal and economic freedom.”

Charles noted in conclusion, “The timing of this attack is almost comical given the disastrous rollout of ObamaCare. Now more than ever, the country needs public policies that respect the dignity of individuals to run their own lives. Cascade will continue to be the leading voice for self-governance in Oregon, and we welcome financial support from donors regardless of where they live.”

City of Bandon---Expanding Government Cheese

CHEESE FACTORY WILL BE EXPANDING

At their special meeting on November 18th, the City Council unanimously approved a lease with Face Rock Creamery for the existing 1,200 sq.ft. warehouse building west and south of the cheese factory which is currently being used by the Electric Department for materials and equipment storage.  The cheese factory will be installing insulation and sheet rock on the inside, and some refrigeration units to use it as a cheese aging and storage facility.  Certain cheeses must age for several months to several years at a temperature of 430 F to increase their sharpness and improve other qualities.  Face Rock Creamery has indicated that their ultimate goal would be to eventually purchase enough property to construct new offices and additional storage.  However, they need some additional storage space immediately due to the large number of orders they are anticipating.  Face Rock Creamery currently employs 17 individuals (some full-time and some part-time), and they estimate that this number could double if their on-site, export, and internet sales increase as projected.  Without leasing the additional storage from the City, their other options would have been to rent some refrigerated trailers or rent or construct a building someplace else.

The lease is for an initial term of three years at $600 ($.50/sq.ft) per month for the first year, increasing to $750 per month for the second year, and $1,000 per month for the third year.  Face Rock Creamery is hopeful that within a year they would be able to negotiate a price with the City for purchasing additional property at the existing City Shop property so they could construct a larger building for cheese storage, shipping, packaging, and offices.  The new lease can be canceled by Face Rock Creamery with 90 days advance notice.  In the event of such a cancellation without mutual agreement, the City would retain ownership of the building improvements and refrigeration equipment.

Regarding the City’s use of the building and property, the plan is to relocate all of the City Shop operations to the new City Shop site southwest of the 11th Street and Rosa Road intersection.  This will move the emergency vehicle, equipment, and materials storage out of the 100 year flood plain and make them much less susceptible tsunami inundation.  The storage which is currently located in the warehouse building will be relocated to other parts of the existing building and to the transformer building which has already been constructed at that new location.  The most critical use in the building is the “hot stick” room where the equipment and for working on live (“hot”) electric transmission lines is kept in a temperature and humidity controlled environment.  As part of the new City Shop relocation process, the Electric Department has determined that the preferred alternative would be to purchase a “hot stick” trailer.  Such a trailer has been ordered, and is preferable to a fixed location, since it will allow all of the equipment to be immediately hauled and available at any work site.

Coquille Watershed Association Monthly Meeting

Hello Council & Friends,

Next Monday will be our last Executive Council meeting for 2013!

John Jones, our Board Secretary, will share a video: “Logging for Salmon, Restoration at Camp Myrtlewood”, and we’ll have our last general discussion and take care of business before we part for the holidays.

Since this is the end of the year, please remember that we are a 501 (c)(3) non-profit, and donations to us are tax-deductible. Dawn & Kurt are compiling a “wish list” of items we are in great need of - so if you are feeling generous or just need to take a little off the top of the tax bill, we can use just about anything - from cash, tools, landscaping equipment, office supplies - and a crew truck! We will be needing to replace the crew’s truck - the “Crummy” - because it is on its last legs and crew safety is of utmost importance. We’ll need to figure out how to do that on our limited-to-none auto funds, so any help would be greatly appreciated, and the crew is not picky - a working engine & brakes, heater and room for tools - it could be pink as long as it is in good working condition. J

Our 2012 taxes have been done and can be viewed at the office, please let our Office Manager, Liz, know if you would like a copy. 541-396-2541.

I will not be at the meeting on Monday as I’ll be away celebrating my 39th birthday - again - so if there is anything you’d like to discuss, please give me a call.  Ernie & Dawn will update you on our Yankee Run applications to OWEB & the WNTI, the NFork Ecological Restoration project the crew has embarked upon, Dawn’s involvement on the Gorse Action Group and the re-start of the South Fork Action Plan.  Afterwards, I’ll send out a re-cap and any new information before we turn our minds to the end of the year.

Eric Himmelreich & Holly Huchko are recovering from the helicopter crash and are very thankful for the cards, flowers, donations & well-wishes. We are very, very happy to hear that they are healing and that their spirits are high.  Check out the attached picture for a wonderful shot of Holly - the true Bear Fan (all respect to her from another Bear fanatic). J

We will be celebrating our 20th Anniversary in 2014 - so plans are underway for a fun event thanking our sponsors and partners, and I would love to hear of any ideas you have to commemorate the momentous occasion.  I will also need help with the party planning from any of you that are interested.

Fellow Patriots,
I wrote a letter to Oregon State Rep Wayne Krieger because of a total lack of action on his part on the 2012 NDAA. See below. His words now mean nothing. This is truly disgusting. So far, state rep. Tim Freeman of District 2 has been upstanding, however he does not cover our area of Coos County. This will be Tim's final year in state office. It's too bad to see him go, but he is sure to fill a Douglas County Commissioner seat and will do well there.

Here's an example of how one of our state reps work. If we are to pursue a state sponsored Bill, this is not the politician who we need any longer. He is the one who initiated a Bill (defeated) for DUII check points in Oregon. I think it's time to do what we can to oust these types of people who refuse to represent us.  Feel free to let him know where you stand and what his job actually is. Comments please.

Dear Mr. Krieger,
 
I realize that you're very busy, however, I've tried unsuccessfully for several months to get you to contact me, but, I never do get a response. I've spoken more to Colleen that with you. I've even asked Tim Freemon to hand deliver notes to you and I know he brought this up to you several times before.
 
We have been working extremely hard against the 2012 National Defense Authorization Act here in Oregon, but we're not getting any assistance from our elected representatives after having repeatedly asked  for it.

I recall asking you and Senator Kruse in a town hall meeting in Coquille if you both would sponsor a bill or support one rejecting sections 1021 and 1022 of the NDAA. Both of you said "absolutely."

Well sir, when will you act on this, if ever? We've had several positive actions against it at the county level. What more do we have to do to get your attention to this awful Bill that destroys our Bill of Rights and Constitutions? You represent us and are supposed to protect out rights. I haven't seen any evidence of that with you.

I am certainly very disappointed in both you and Kruse, and I voted for you both over the years, thinking that you guys actually cared. Never again unless I see results on this issue that nobody seems to care about. Politicians get into office and forget the little people below them. I do not expect to hear from you. I would be very surprised.

If you talked to Colleen about your issue that is basically the same as talking with me.  With 70,000 constituents it is impossible to personally speak to everyone who contacts my office.  Though I do try to.

You refer to the 2012 Nation Defense Authorization Act.  Note the word “National”.  I am a State Rep not a Federal Congressman or Senator.   Federal laws and Acts in nearly all cases preempt State Statutes. 

I don’t recall your exact words as to asking Senator Kruze or me to sponsor or support a bill.  I was under the impression that you were asking that if there was a way to have a provision available to reject this bill or reject section  would we be willing to do so, not that we do a bill or a resolution. And, yes we would, but in fact we can do little else.  Federal law trumps anything we might propose. 

We are also in the minority.  The Democrats would not give a hearing on any legislation that was counter to a Federal Act.

 You mentioned there had been “Positive Actions” against the NDAA at the County level. A House or Senate Resolution could be drafted , but has no legal effect against the Federal Act.  Again getting a hearing this session and work session on the bill  would be beyond unlikely.

It is frustration to see President Obama and Attorney General Eric Holder violate our rights and liberties, lie daily, fail to enforce laws passed by Congress and use their power in the most corrupt ways.

Our problem is a Federal Government out of Control.

The Whole Watershed Restoration Initiative (WWRI) is pleased to announce its 2014 Request for Proposals (RFP) for community-based habitat restoration projects in Oregon and Washington.

The WWRI is a public-private partnership between Ecotrust, the National Oceanic and Atmospheric Administration (NOAA), the U.S. Forest Service (USFS) the Oregon Watershed Enhancement Board (OWEB), the Bureau of Land Management (BLM), the U.S. Fish and Wildlife Service (USFWS), and the Natural Resources Conservation Service (NRCS). The partnership focuses on restoring the major ecological processes critical to the natural function of entire watersheds. The WWRI directs funds and resources to select watersheds and restoration activities that provide the greatest opportunity for the recovery of native, anadromous salmon populations across land ownerships.

Approximately $1.2 million will be available in the 2014 funding cycle for projects within the WWRI’s Priority Basins. Please note that some changes have been made to geographic priorities, and are described in the RFP. The deadline for applications is January 9th, 2014 at 5:00 p.m. PST and awards will be announced in late March 2014.

The court turned aside the appeal without comment. Our thanks to the Oregon Farm Bureau for sharing their video tour of Charlie Ruddell from the Coos-Curry County Farm Bureau.  The tour includes wet harvest and dry harvest of cranberries, and also shows them being cleaned by our friends at the Russell Cranberry Company!  

Oregon raises about 7% of the U.S. cranberry crop. The berries are Oregon's 37th largest crop by production value.

Curry County Update---Voters Reject new Property Tax, but may get Sales Tax

This related to Coos County, because we could face a situation were the voters rejects a property tax, but the governor, inclusion with willing county commissioners, intervenes with a Sales Tax.  Having the state involved with the county government will lead to Regionalism.  This is a scary proposition for the taxpayers of Oregon....Rob T.

Oregon Farm Bureau---Coos-Curry FB wins national farm award November 4, 2013

 Hello Watchdogs,

It is a very good day when one of our own achieves the accolades they deserver. The Coos-Curry County Farm Bureau recently received a national County Activities of Excellence award from the American Farm Bureau. They received the award, because of the “Save Family Farms Initiative”. The group worked against the Winter Lake/China Creek project and The Bandon Marsh Expansion.

They are a “no compromise' organization when it comes to government land acquisitions for wetland restoration projects. There were a lot of people working against these land grabs and they all deserve a big Thank You for all their hard work.

Mrs Sharon Waterman will receive the award for the group at a CAE presentation ceremony at the 2014 AFBF Annual Meeting in San Antonio in January. Sharon has been a tremendous leader in the fight for property rights and has set new highs in activist standards that all of us should learn to follow.

Thank You and keep fighting the good fight.

Coos-Curry FB wins national farm award November 4, 2013 Coos-Curry County Farm Bureau recently received a national County Activities of Excellence award from the American Farm Bureau. The CAE program acknowledges exceptional grassroots projects, events, and activities at the county Farm Bureau level. Only 24 county Farm Bureaus across the nation earned this honor in 2013.

Coos-Curry County Farm Bureau was recognized for its Coquille Valley Land Acquisitions/Save Family Farms initiative. The campaign works to protect farmland in southern Oregon’s Coquille Valley from being purchased by state and federal government entities and non-profit organizations for wetland restoration — which permanently takes land out of agriculture production.

“It is essential that these prime agricultural lands are protected and preserved for future generations of farmers and ranchers, so we can continue to provide food for the public and for wildlife, and sustain our local economy,” said Sharon Waterman, campaign coordinator, cattle and sheep rancher, and member of Coos-Curry County Farm Bureau.

To achieve this goal, the county Farm Bureau launched a successful public education initiative, which included posting “Save Family Farms/No Wetlands” signs in the Coquille Valley, an informational meeting that aired on public television, the development of a legislative concept for the land-planning process with local lawmakers, and testifying at the State Capitol on the issue.

“Grassroots members who join at the county level are the heart and soul of Farm Bureau,” said AFBF President Bob Stallman. “AFBF congratulates the members of Coos-Curry County Farm Bureau for their excellent work and passion for preserving farmland.”

Waterman will represent Coos-Curry County Farm Bureau during the CAE awards presentation ceremony at the 2014 AFBF Annual Meeting in San Antonio in January.

Bandon Biota Changes Boundary of State Park Lands Desired for Golf Course

The proposed exchange between Bandon Biota and the Parks Department is still ongoing, with detailed negotiations taking place between the two parties. However, there is a recent important change. Bandon Biota still hopes to acquire 280 acres of Bandon State Natural Area (BSNA) so that the Bandon Dunes golf resort can build a sixth golf course. According to a May 2013 Golf Travel Insider article, Michael Keiser, owner of Bandon Dunes, owns sufficient land in the area to build a "pretty good" golf course, but the additional BSNA land would make it "superlative." Now, however, Keiser has requested some different, new acreage: a long chimney of land further north in BSNA. This northern oblong is all adjacent to Keiser ownership. The western edge of the proposed BSNA exchange lands would be drawn further east to compensate.

This long strip of BSNA land Keiser now wants is rare and valuable habitat, containing many wetlands and undisturbed natural plant communities, as can be seen on the map. It is troubling that Bandon Biota would request a major change so late in the negotiations in the lands they hope to acquire. Furthermore, these new lands the public would lose are very important and rare dunal wetland systems, largely unspoiled by gorse or other invasives. Oregon Coast Alliance opposes this exchange for many reasons, including major loss of farmland in Coos and Grant Counties. A key consideration is the importance of coastal State Parks to Oregonians, and the high value of uncommon dune and wetland habitats. The new acreage proposed for exchange makes this proposal worse, as Oregonians would lose even more rare coastal habitat than before.

There is still plenty of time for Oregonians to state their concerns with this project.The Parks Department is accepting public comment on the Biota exchange proposal until the Parks Commission meeting November 20th.

Here are my comments to the ODPR

  To Whom It Concerns:

The following is comment on the proposed Bandon Biota request for boundary changes of State Park Lands that they desire for a new golf course.

Please allow the proposed changes, because anytime property is in the hands of private industry that property will produce revenue that will rebound in the community to stimulate the economy. The ideal situation would be for the Oregon Department of Parks and Recreation to sell this property on the open market to the highest bidder. Then the owner of The Dunes Golf Course, Michael Keiser would have the chance to buy it and put the property back on the tax roll to benefit everyone.

The system of trying to piecemeal together properties to switch and trade in these high-stakes land deals gives the perception of impropriety. Trading gorse for the Grouse Ranch is no deal for the people around the ranch and there is no evidence that they support the deal, so why should we screw them.

Mr. Keiser has a proven record of creating jobs, employing family providers, thus feeding the people of Coos County and he should be celebrated for all that his industry has brought to the southern coast of Oregon. All the ODPR has done is use tax dollars to take more property out of circulation in the real-estate market and to the detriment of the people.

I was listening to Gun Talk Radio today and this issue was brought forth by David Goldman of Silencer Shop. This is just another sneak attack from the rear from our beloved government slowing, silently taking our
gun rights away.

The silencer business is exploding (I wonder why?), so the government wants to make it as difficult as possible to get one. It's been much easier to do through a trust rather than individual, but now they want to require our local CLEO (sherrif) to have to sign off on this.

As many of you may have heard, the ATF recently published a proposed rule that, if adopted, would place new and cumbersome requirements on purchases of NFA items, including silencers, by trusts and other entities.  The proposed rule would require each person listed on a trust to submit fingerprints and photographs, and to obtain a “sign-off” from their chief law enforcement officer (“CLEO”).  As many of you have personally experienced, obtaining a CLEO sign-off is virtually impossible in many parts of the country.  CLEO’s often withhold their signatures based purely on either a lack of department resources, or their own political philosophies or biases regarding firearm ownership - not because the buyer is prohibited from owning the item.

Historically, our customers have used trusts and other entities as an accepted and lawful means to acquire suppressors.  We believe that if this proposed regulation passes, many of our law-abiding customers will no longer be able to obtain these hearing-saving devices; and, consequently, we are taking a stand to fight the proposed rule.  Silencer Shop has engaged an international law firm to draft a public comment to publicize the significant negative impacts of the proposed regulation and to oppose the regulation as both unnecessary and illegal.

The Defense Authorization bill (NDAA 2014) will cost the average family over a tenth of their income.
But the Senate will spend only a few days to consider it, and then give it a rubber stamp.

That’s why you should tell Congress to support and pass DownsizeDC.org’s Read the Bills Act.

 Like almost every other year, the premier reason to pass the Read the Bills Act is the NDAA.

This year's bill (HR 1960) is 1,104 pages long — and that's BEFORE the Senate gets its hands on it.

The SUMMARY of the bill at the Library of Congress site is nearly 22,000 words — one-third the length of the average BOOK.

I know you won't even read the summary, let alone the bill itself.

There may be a few debates on some issues, but the majority will pass it… WITHOUT KNOWING WHAT'S IN IT.

Do you call that "representative government?"

Also, the bill will cost the average family nearly $5,700. But how much will…

* go to actual national defense?
* instead go to your contractor lobbyist cronies?
* pay for foreign aid and 1,000 military bases across the globe?
* pay for warrantless spying?

Do you even know?

The Read the Bills Act would FORCE you to know. Plus, it would give the public time to find out what's in the bill and give you feedback.

That's REPRESENTATIVE government!

Curry County votes on raising taxes

GRANTS PASS, Ore. (AP) — A new Oregon law that gives state and local officials an emergency pathway to raising taxes if voters won't pay for a minimum level of public safety faces its first test in Curry County, where declining federal timber revenues and a struggling local economy have left law enforcement on the brink of going broke.

Both the governor and Curry County Commission Chairman David Brock Smith hope voters will approve more than doubling their county property taxes, currently the lowest rate in the state, on Tuesday.
Look which county is next:
Curry County is not the only rural timber county facing a funding crisis. Josephine, Jackson, Douglas, Coos, Klamath and Lane counties have all struggled to keep jails open and law enforcement functioning.
