Anyone who has ever read my articles knows from the lack of journalistic quality that I am an activist and not a writer.  In turn, this also means there will be times when I have to report on my own actions to inform the public of current issues.   This article is a public notice to the Bandon City Council and it will be helpful to anyone in the public who might want to learn about the subject. It is a message intended to inform the councilors that a group of us will be filling a Referendum Petition on the new Lighting Ordinance. 
  
The Bandon city council denied me the opportunity to speak at the last city council meeting, or otherwise they would know of this endeavor.   If we are successful in a referendum petition it will trigger a March election, which will cost the city up to $5,000 in tax dollars. There are added costs to special elections.  The timing of the vote is set by The Council, so they are solely responsible for the schedule we have to follow.  

Please, Councilors, reconsider the motion and either table the measure until it can be put on a May or Nov ballot or just vote against this harassing law.  Here are the factors why: One, we only missed completing the last petition by 28 signatures and it rained heavily the entire time. This time the weather will be much more agreeable to gathering signatures. Two, the last issue had an unanimous vote, but this time one councilor voted against the measure demonstrating a level of opposition on the council. Three, our group has grown and we have a much more organized political force. Four, we have learned from the mistakes of our last petition
and are better prepared.  Five, this is a black and white issue and not nearly as convoluted as a petition on
Urban Renewal.  Six, The US Fish & Wildlife Service is promoting this ordinance.  The Service is already responsible for the Bandon marsh expansion and has no business influencing local law.  

Bandon is dark enough. In fact, the name of our committee is going to be "The Committee to Keep the Lights ON in Bandon." It’s catchy, huh? 
 
The  lighting atmosphere is perfectly fine in our small town and there is no need for more city regulations.  

The Dark/Starry Skies ordinance deals with much more than just the direction of light, conservation, or the consideration for neighbors or wildlife. I have read the ordinance, but unlike the Bandon city council, I can comprehend the negative ramifications of these new intrusive regulations.   Of course, nobody knows what unintended consequences will occur after this over-reaching law is passed.   Unintended consequences never seem to be the concern of politicians who want to create regulations for the pursuit of leftist ideology.
 
The major problem with this law is that it gives the city total authority to tell property owners what kind of outdoor lighting they can utilize, which is NOT the domain of government.  The city does not know what kind of lighting people will need to make their property safer or how to accommodate the needs of everyone.  Part of the ordinance would make it illegal to have lighting on your deck, if the deck is facing the ocean or can be seen by your neighbors. The enforcement of this law is questionable.  All of this is subjective and will lead to serious abuses. Given that the city body has proved that it can be vindictive against people with whom they do not agree it is not a matter of if it will happen, but when. It will be similar to when the city rejected someone having access to water,  merely on the grounds that that person opposed annexation.

Thank you for taking the time to read this—the time you, the councilors, should have allowed me to speak at the last city council meeting.  The Bandon City Council is supposed to be a reflection of its constituents and the council should end its constant heavy-handed manipulation of the system to affect ending results.

common and  lawful activities.”

 •    A  bystander has the right under the First Amendment to observe and record members

If you’re looking to get involved, there’s a lot happening this week. On Tuesday, President You-didn’t-build-that Obama is swinging through Portland as part of his let’s-not-build-that campaign.

Americans for Prosperity will be holding a counter protest to support coal miners who are being attacked by the green
regime.

The rally will start at 11:00 a.m. at the South Park
Blocks between SW Columbia and SW Clay on SW 9th.

And on Wednesday and Thursday, the US Fish & Wildlife Service has a travelling road

Currently, in Coos County, they’re trying to buy up 4600 acres of land that has a real market value

This isn’t abandoned land that’s just sitting there. It’s active farmland currently in use.
They say they want people to come in and give them input on their plans to do land
swaps.
Here’s an idea: the best conservation happens when land stays in the hands of private landowners.

I tried to speak on this agenda item at the last city council meeting and was denied public  comment.  Since the council was informed by Public Notice I’m going to post the emails that I have received from two of the Bandon City Councilors and my replies to them.

A Message From Karla Davenport of the ISPY Radio Show on the ORS 190

Here is a message from Karla on how to form an ORS 190.  

Hi Bonnie,
An ORS 190  is generally used among governments who are forming a relationship to fund or administer specific projects.  In some  ways they are not good when used to develop systems that  voters have resisted with an unpopular project and yet the government agencies can use these agreements to  move ahead on  projects without voter approval.  But there is also a good  side to the agreements when trying to fight bigger, more   powerful government agencies who just won’t listen to their  constituents. It’s what we used it to stop Salem Mass Transit          from encroaching into our rural area.

 You don’t need to create a non-profit to form an ORS 190, but if you already have a non-profit I believe it could be a member at the table.  You need two or more entities to form the 190.  We went to each small town and met with the city council and they  agreed, by ordinance, to sign onto the 190.  The 190 agreement has to be written out and reads much like the corporate papers filed for private business.  They have the mission statement,  what the agreement is established for, if there is funding   what kind and how it’s managed, and much more.  You could probably get hold of a copy from one of your local council  members who may have a draft on file.   

The benefit for you in the Coos County area is by forming an agreement among many small towns you increase your legal abilities to fight off other government intrusions. And if you can get four or five small cities/governments to sign on, then odds are you may have a chance to get the county commissioners to sign on as well. And the good news is that even though Coquille has a larger population, they’d only have one vote at the table maximizing the voices of the smaller population area. Whatever you do, don’t agree to consensus agreements in this arena, it must be a majority vote with each government entity, regardless of size, having equal power. 

I’ll look around to see if I can find an agreement we used because there  was a lot of effort that we put into the wording of the agreement when it came time enter talks with Salem Mass Transit.  And actually how we structured that agreement is we formed another 190 so that our rural 190 as a whole signed an agreement with Salem Mass Transit which formed a second 190.      We did that so that they couldn’t become a member with the individual towns and then try to destroy the rural agreement,  which they did try but we stopped them.

(1) An  intergovernmental entity created by an intergovernmental agreement under ORS 190.010 (Authority of local governments to make intergovernmental agreement) may, according to the terms of the agreement:


     (a) Issue revenue bonds under ORS chapter 287A or enter into financing agreements authorized under 
     ORS 271.390 (Lease or purchase of real estate by public body or council of governments) to accomplish 
     the public purposes of the parties to the agreement, if after a public hearing the governing body of each of the units     of local government  that are parties to the agreement approves, by resolution or order, the issuance of  the revenue bonds or entering into the financing agreement;


     (b) Enter into  agreements with vendors, trustees or escrow agents for the installment purchase or lease, with option to purchase, of  real or personal property if the period of time allowed for payment under an agreement does not exceed 20 years; and


     (c) Adopt all rules necessary to carry out its powers and duties under the intergovernmental agreement.


(2) Except as  provided in ORS
190.083 (County agreements for transportation facilities), an intergovernmental entity may not levy
taxes or issue general obligation bonds.


(3) The debts,  liabilities and obligations of an intergovernmental entity  shall be, jointly and severally, the debts, liabilities and  obligations of the parties to the intergovernmental agreement that created the entity, unless the
agreement specifically provides otherwise.


(4) A party to an intergovernmental agreement creating an intergovernmental  entity may assume responsibility for specific debts,  liabilities or obligations of the intergovernmental entity.


(5) Any moneys collected by or credited to an intergovernmental entity shall not accrue to the benefit of private persons. Upon dissolution of the entity, title to all assets of the intergovernmental  entity shall vest in the parties to the
intergovernmental  agreement. The agreement creating the entity shall  provide a  procedure for:


     (a) The disposition, division and distribution of any assets acquired by the intergovernmental entity; and


     (b) The assumption of any outstanding indebtedness or other liabilities of the  entity by the
parties to the intergovernmental agreement that created the entity.


(6) An  intergovernmental entity created by intergovernmental agreement under ORS 190.010 (Authority of local governments to make intergovernmental agreement) may be terminated at any time by unanimous vote of all the parties to the  intergovernmental agreement or as provided by the terms of the agreement. [1991 c.583 §4;
2001 c.840 §3; 2003 c.195 §7; 2007c.783 §71]

The UN Small Arms Treaty known as “ATT” may soon be completed. While the Bush administration would not participate, Obama and Hillary Clinton have embraced it.

Long the subject of rumor and speculation (we are still receiving emails claiming the treaty was already signed while we were too busy paying attention to the Gulf oil spill) the treaty now seems close to completion.

Hey Folks,

Here is an economic report on the Counties of Oregon from the Secretary of State’s office.  Notice it is recommending that some of the counties liquidate their assets, which is what Commissioner Fred Messerle was recommending in several candidate forums. 
Why would we get rid of our assets?

This is a list of the 10 most deadly animals found on land and in water. 
While some may seem innocuous – especially number 1, they lead to millions of deaths every year.  From least, to worst, the list:


10. Poison Dart Frog

The backs of the poison dart frog ooze a slimy neurotoxin that is meant to keep predators away. Each frog produces enough of the toxin to kill 10 humans, though, strangely, in captivity, the frogs do not secrete this poison.  The
frogs are brilliantly coloured and live mainly in Central and South America.

9. Cape Buffalo
Cape buffalos weigh 1.5 tons and, when faced by danger, attack head on with razor sharp horns.  They stand up to 1.7 metres high and 2.8 metres long.  Humans are virtually its only predator and even lions will avoid crossing their
path.  Every year the Cape Buffalo is known to maul and kill multiple humans;  some believe that it kills more humans in Africa every year than any other  creature.

8. Polar Bear
These massive creatures, native to the Arctic, regularly eat elephant seals and could cut off a human head with one swipe of its paw.  The Polar Bear is the most carnivorous of all the Bears and will eat walruses, whales, rheindeer, and
even other polar beers.

7. Elephant
 African Elephants, with their sharp tusks, are not as friendly as many believe.  They kill over 500 people per year (either by stomping or impaling).  The African Elephant generally weighs in at 16 tons.

6. Saltwater Crocodile
 This is the largest of all living reptiles and is found mainly in Northern Australia and Southeast Asia.  A healthy adult is typically 4.8 – 7 metres (15.75ft – 21ft) long, weighing up to 1.6 tons.  There have been reports of larger.  This creature is capable of killing and eating animals up tot he size of a water buffalo.  In its most deadly attack (called the Death Roll) the crocodile grabs an animal or human with its mouth and begins to roll.  A 1ton stallion is known to have been killed by this method in under 1 minute.  In the water, the crocodile can move as fast as a dolphin.

5. African Lion
 The African Lion can reach up to half a ton.  Lions are thought to kill up to 70 humans per year in Tanzania.  These large animals are eclipsed in size only slightly by the tiger.

4. Great White Shark
 This shark is an exceptionally large shark found in coastal waters in all major oceans.  It can reach lengths of up to 6 metres and can weigh up to 5 tons.  The Great White Shark is the worlds largest known predatory fish.  It is
the only surviving species of its genus.  In general these creatures do not attack humans, and (while there have been some fatalities) the majority of attacks on humans are believed to be test bites – the Great White Shark are
known to test bite other objects in order to determine what they are.  More people are killed each year in the US by dogs than Great White Sharks in the last 100 years.

3. Box Jellyfish
 Also known as the wasp jellyfish, this salad-bowl sized jellyfish can have up to 60 tentacles as long as 15 feet.  Each tentacle has enough toxin to kill 50 humans.  They are found in Australia, the Philippines, and many other tropical
areas.  Since 1884 at least 5,567 deaths have been attributed to these creatures.

2. Asian Cobra
While the Asian cobra does not have the deadliest venom, it does make the most of what it has, causing the largest chunk of the 50 thousand deaths by snakebite per year. An average cobra is about 1 metre in length.

 Due to malaria carrying parasites transferred by the mosquito, it is responsible for the deaths of more than two million people per year.  In addition, Mosquitos are estimated to transfer diseases to more than 70 million people per year.  Even in countries such as the UK, New Zealand, and Japan, where the more temperate climate has reduced mosquito bites to mostly an annoyance, they still cause some deaths every year.

It might seem that our efforts to hold Attorney General Eric Holder accountable have gotten mixed into the shuffle with Obamacare and the virtual march that we haven't given proper credit to all of you for your accomplishment on getting AG Holder held in Criminal Contempt of Congress. 

For months we have been occasionally asking you to send letters to only your individual representatives in Congress and you responded in a HUGE way!  Together we sent more than 491,000 letters to Washington!  Our sample letter read:

US Attorney General Eric Holder has continuously stonewalled the Congressional investigation into the "Fast and Furious" scandal by withholding evidence and documents requested by Congressional committees. As your constituent, I demand that you hold the AG accountable and hold the AG in contempt of Congress.
We as Americans and voters deserve the truth.


 
An  independent special prosecutor must be appointed to investigate and prosecute this crime.  As the nations top
law-enforcement officer if he is convicted of perjury he should face the absolute maximum penalty.


The Republicans and even some Democrats in the House of Representatives listened to your demands and now
you've probably heard that the Department Of Justice refuses to enforce the CRIMINAL CONTEMPT of Congress.  Which means that it is up to us to make sure that the House understands that a toothless criminal contempt isn't enough! 


We have re-written the petition with new demands!  Please take a few moments and send a new batch of letters to your elected  representatives so that all those responsible for the death of Brian Terry are held accountable.

  In 1933, Nazi Minister of Propaganda Joseph Goebbels decided to bring professional and cultural organizations in line with Nazi ideology—meaning getting rid of any messages that disagreed with the regime.  He convinced the
Student Associations and universities to join in and on May 10, 1933, the university students burned more than 25,000 volumes of “un-German” books.  These included so-called “corrupting foreign influences” by American authors Ernest
Hemmingway, Jack London, and Helen Keller.

Charleston, OR the Board of Commissioners met at the OIMB Boathouse for the first regular meeting after Independence Day.  It would have been another ordinary meeting with few items on the agenda, but there was one very controversial item.  The topic of the Governance Committee Report and the BOC’s next step had filled the room with people eager to hear how the board was going to proceed with this issue.   
 
Commissioner Parry opened the discussion to public comment where several citizens proclaimed their  opposition to the creation of a County Administrator position.  One person informed the Commissioners that there was a group of citizens ready to file a referendum petition if the Board voted to create this new county manager position without going to a public vote.  There was only one person who spoke in favor of this new position and that person was a member of the Governance Committee.
 
After a brief public discussion Commissioner Parry made a motion to create a county Administrator and increase the Board to five Commissioners.  Then Parry explained that he would want to put that question on the ballot in the November election, so the electorate could decide whether or not there should be an administrative change to the way the county is structured.
 
These new commissioners would be elected at large and not from districts. Commissioner Bob Main opposed the idea and suggested the group go through the regular process of filling an Initiative Petition to put this issue on the ballot.  He also thought putting  this measure on the ballot was not fair to other groups who have asked the Board to put their initiatives on the ballot and was denied.    Commissioner Fred Messerle was supportive of the idea of an administrator position being created and seconded the motion to draw up the ordinance.  The motion passed with Parry and Messerle voting in favor of the measure, Commissioner Bob Main voted against it.
 
When this process is completed for the November election, the voters of Coos County will have to make some very important decisions.  There could be a scenario where on the ballot the voters will be asked to decide on the Home Rule County Charter, The County Administrator and the creation of two new commissioner positions, not to mention the advisory question on the Bandon Marsh Expansion and the County Urban Renewal Amendment.   However it shakes out this fall it looks like it will be a full slate on the ballot coming this November.

The Recession Has Not Ended for Private Sector Employment

The technical definition of a recession is when the nation’s Gross Domestic Product (GDP) declines for two successive quarters. From a private sector worker’s standpoint that appears to be a reasonable definition because as the economy contracts, employment contraction occurs simultaneously. However, utilization of the same data for determining when a recession ends – two successive quarters of growth in the GDP – does not find a corresponding
increase in employment. The net result is that while private sector workers almost immediately feel the brunt of the beginning of a recession, the technical end of a recession seldom brings any degree of relief to them. That is
particularly true in this most recent Bush-Obama recession.
