Watchdog & Friend Gordon Young from Public Access  TV had Stroke & Accident

Greetings:

I wanted to share with you that Gordon Young has been transported to Sacred Heart and is awaiting brain surgery. Many of you may not know him by name but Gordon is the man we traditionally see manning the public access camera at many of our public meetings. It is my understanding that Gordon displayed the signs and symptoms of having a stroke earlier sometime this week while in Coquille while filming a public meeting down there.  Reportedly Gordon refused medical assistance and decided to drive himself back to Bay Area Hospital, but unfortunately he ended up in a motor vehicle accident. A CAT scan was later performed at area Hospital which revealed that Gordon had a tumor on the right side of his brain. Gordon was transported up to OHSU for further testing.  I have been told that Gordon is scheduled for surgery tomorrow. 
Please keep Gordon in your thoughts and or prayers.

Preparing for the upcoming election we have a few things to let you know about to help you insure our election processes are fair and free.


1. True the Vote National call will be on Sept 20th at 4 PM Pacific time. You can register by clicking here. The call is a special on Mail in Ballot Election process. Don't miss it.


2. If you are able to take some time to work at your local elections office as a paid temporary election worker, we would highly recommend it. You will have to apply for these positions. There are number of offices around the country that need help and don't have enough conservative employees. They need to balance their election boards with diverse election workers. So call up your local elections clerk and see if they need some help. 


3. Sign up to be an election observer with the Political Party or Candidate of your choice. This is a volunteer position. The presence of Election Observers in our elections process, continues to inspire workers to do their best to be fair and impartial.


4. Come to our conference. 'Oregonians for Free and Fair Elections' is having a state wide conference for citizens interested in learning about becoming better election observers. The conference is on Oct 8th at the Best Western Mill Creek Inn, 3125 Ryan Dr SE, Salem, OR 97301. 9-4PM. If you RSVP by Oct 15th. The price is $15. After that, the price is $25, all to be paid at the door. see attached flyer.

Special Guests: Brenda Bayes, Oregon Interim State Election Director, along with 
three county elections officials: Tim Scott, Multnomah County Elections, Mickie Kawaii, Washington County Elections and Steve Druckenmiller, Linn County Clerk, will be speaking in the morning. There are other invited guests we are still  confirming so it will be a conference full of information about elections.


This is a great time to meet other observers and talk with them about the observation process. We have a notebook of informational resources for attendees that you can get for $10 optionally. (The $10 is to cover the notebook and printing).  It will have contact info in it for all Oregon county clerks. As many as we can get of the current observer rules and calendars. White papers on various election issues. Election Manuals. Basics of organizing an observation. Much of the information will be available electronically on our website by conference date. So it's up to you if you want to order one.

Learn about our new Initiative Petition #5 for the 2018 election cycle that would require voter to prove citizenship in order to register to vote. This will require all those currently registered to vote to come into the same compliance within 2 years. Thus our voter rolls will be vetted for US citizenship proof. James Buchal and Mike Nearman are the chief petitioners for this petition. Three out of Four voters nationally support proof of US citizenship when registering to vote.

Coos County Considers Predator Damage Control "taxing" District for Landowners

The county formed a committee back in 2011 to analyze the problem of keeping predators from harming and killing livestock or people.  The reason the county commissioners had to form this committee was that the feds cut off funding to the program used by the county to kill dangerous animals. 
 
Now, the committee is creating a Predator Damage Control District, which is a taxing district.  It will be a controversial topic at the next couple of meetings.  The committee sent letters to Landowners in the district asking them to fill out a survey by October 2, 2016.   The information is in the letter from the committee, which is posted below.     
 
Please inform yourself and others by reading the following documents and excerpts from the committee about this issue.  Then you will be ready when it is time to debate the subject of establishing yet another taxing district…..Rob T. 

PURPOSE:
To evaluated funding options for the animal damage control in Coos County as well as the Wildlife Services program. To set goals, priorities, and suggest staffing levels for the animal damage control (Wildlife Services) program. Educate the public on the importance of animal damage control. Evaluate the needs and effectiveness of the Wildlife Services program.  Educate the Coos County Budget Committee concerning the program, its benefits and results.  Report back to the Coos County Board of Commissioners with recommendations and carry any statewide funding recommendations to the statewide Stakeholders Group.

SCOPE OF THE WILDLIFE SERVICES PROGRAM IN COOS COUNTY
  1. Protect public health and safety
  2. Control spread of disease in wildlife population (such as rabies)
  3. Protect the Coos County infra-structure (culverts, roads, dikes)
  4. Control animal damage to forages, crops, livestock and timber
  5. Assist with wildlife control within city and rural populations
  6. Protect the County forests and parks

Committee Damage Control Advisory Committee
A committee of ten persons shall be approved or appointed by the Coos County Board of Commissioners. 

The committee members shall represent the following entities:

Oregon Department of Fish & Wildlife

The Committee shall elect a Chairman, Vice-Chairman, and Secretary.  One of the members of this committee will serve on the statewide Stakeholders Committee.  The Chairman will set the meeting dates as necessary.  The Secretary shall take and submit minutes of the meetings to the Board of Commissioners.  The of office shall be three years.  This is a volunteer appointment and there shall be no cost to the Coos County.

Mayor, City Councilors and Council Candidates:

I'm sorry to have to report that at the conclusion of last night's Council meeting, Tom Leahy tendered his resignation from the City Council.

The matter of filling the vacancy on the Council will be on the agenda for the next Council meeting scheduled for October 4th.  Below you will find the relevant sections of the City Charter which addresses filling a vacant position:



Section 3.6          Qualifications: 

A person who at the time of election or appointment is a qualified voter within the meaning of the state constitution and has resided within the City one year immediately preceding the election or appointment to fill a vacancy shall be eligible to fill an elective office of the City. No elective office holder of the City may be employed by the City in a position that is not substantially volunteer in nature.  Before the names of candidates for elective office are placed on the ballot and before the appointment of an elective officer to fill a vacancy, the candidate for elective office shall present proof of qualifications to the municipal judge whose decision shall be a final determination of both fact and law, but if there is no municipal judge then such determination shall be made by the city attorney.



Section 6.8          What Creates Vacancy. 

An elective office shall be deemed vacant by declaration of the Council upon the incumbent's death, adjudicated incompetence, convictions of felony, resignation, recall from office, ceasing to possess the qualifications necessary for the office, the failure of the person elected or appointed to take the oath of office within three weeks after the time for the term of office to commence, which shall be the first regular council meeting following election or appointment, or absence from meetings of the council for 30 days without the consent of the Council.



Section 6.9          Filling Vacancies.

Vacancies in elective offices of the City shall be filled by appointment by a majority of the entire membership of the Council holding office at the time of the appointment. The appointee's term of office shall begin upon taking the oath of office following appointment and shall continue until a successor has been elected and qualified following the next regular city election.  The successor to a council member appointed during the first two years of the term shall serve for the unexpired term of two years.

Over the last 24 years the City Council has been in the position of deciding how best to fill a vacancy on the Council nine different times.  The Council has used a variety of methods to fill those vacancies which have included a direct appointment to the Council by a majority vote, using an application/interview process to identify and appoint interested persons, and appointing a person based on the results of the previous election. In this case the Council could do any of those three and/or leave the position vacant and allow it to be filled in the upcoming election.

Hey Folks,

Please do not get angry at the business owners for trying to recoup some of their tax dollars.  Everyone tries to take advantage of government loopholes, which are designed to divide the people based on all kinds of arbitrary categories.   

The people responsible for this form of corporatism are all those voters who keep putting politicians in office that are supporters of corporate welfare.  The problem is not the company, but the government policy. If this business owner did not take advantage of the program another one would take its place, as designed. 

 In this case, it is the worst program of all, Urban Renewal.  Nero had a great Urban Renewal program that did not go so well for the Christians living in the neighborhood that was being redeveloped.....Rob T.

Salem, Ore. – Oregon’s Legislative Counsel has released a legal opinion on the constitutionality of possible Public Employees Retirement System (PERS) reforms. Of the reforms analyzed, seven were deemed likely constitutional.
Senator Betsy Johnson (D-Scappoose) and Senator Tim Knopp (R-Bend) are spearheading the Bipartisan PERS Solutions Work Group. Any Oregonian interested in pursuing fair, constitutional PERS reform is invited to participate. Invitations have also been sent to a broad, bipartisan coalition of school administrators, local government officials, and labor and business groups representing a variety of interests across the state.

“This legal opinion gives us a great foundation as we gather Oregonians around the state in our Bipartisan PERS Solutions Work Group to consider the best way to start fixing the nearly $22 billion PERS unfunded liability,” said Senators Knopp and Johnson. “We no longer want to hear that there are no solutions. Oregonians want fair, constitutional solutions to our PERS crisis and working together, we will find them.”

The PERS reform options deemed likely constitutional by Legislative Counsel include:
1. Cap the final average salary calculation at $100,000 per year;
2. Use a market rate for Money Match annuities;
3. Ensure all PERS members contribute to their benefit by redirecting member contributions into an account to help pay for their future retirement;
4. Stop unfair pension enhancement by preventing future unused vacation and sick leave from artificially inflating final average salary calculations;
5. Spread the final average salary calculation over five instead of three consecutive years;
6. Move all new employees to a defined contribution plan requiring employers to match the 6% employee contribution into the Individual Account Program; and
7. Allow full bargaining regarding government payment of employee PERS contributions and limiting agreements to five-year periods.

The PERS actuary, Milliman, is evaluating the financial impacts of these proposals. If implemented, these reforms would not affect benefits already accrued by current PERS members.
“We now have a solid place to start conversations on real, fair PERS reform, and we’re ready to get to work,” said Senators Knopp and Johnson. “We invite any Oregonian interested in solving our PERS crisis to join us.”

Judge Will Reportedly Misinform Jurors in the Trial of Ammon Bundy & Six Others

Greetings,  

We have quite a bit of jury-related news regarding the trial of Ammon Bundy and six other defendants that has gotten under way this week in Oregon. 

News sources are confirming what I heard from an observer from courtroom: the judge in the case is reportedly planning to misinform jurors regarding their right of jury nullification. 
According to The Oregonian,

"The judge also said she intends to question each juror on whether they were handed a flier outside court about jury nullification, and to instruct them that they must follow the law even if they disagree with it. Judge Brown said deputy U.S. marshals indicated there may be people outside court distributing such fliers.

Ryan Bundy and Ammon Bundy's lawyer Marcus Mumford objected to the judge's proposed instructions to prospective jurors. Ryan Bundy argued that they will "rob a juror" of the right to serve as a "check and balance'' on the federal government's power."

I understand from a courtroom observer that jury instructions were argued for approximately an hour to an hour and a half. In the event that there is an appeal after this trial is over, this issue may be ripe for litigation.
Despite the judge's stated plan to try and keep jurors in the dark about their right of jury nullification, on the first day of jury selection, defendant Ken Medenbach appeared in court wearing a shirt that the judge apparently did not become aware of until late in the day. As shown in the photograph above, the shirt displays a quote from the case of U.S. v. Dougherty on the back. The famous John Jay quote from  Georgia v. Brailsford (1794) appears on the front.

After becoming aware of the shirt yesterday afternoon, the judge apparently sent the following letter to Mr. Medenbach:

  • dismissal of one potential juror who would not agree to follow the law blindly if he disagreed with it,
  • questioning of jurors to ensure that they would all ignore "pangs of conscience" if they found that they disagreed with the law, and
  • questioning of jurors to determine if anyone had received jury nullification information outside the courthouse.

As frequently happens when high profile cases involving substantial disagreement come up, I am aware that there are many people who have opinions for and against the defendants. There is a larger point here that is independent of any particular case, charge, defendant, or what we might think of any of those:

In every case, ALL defendants have a right to a fair trial before a fully informed jury, who can then decide based on the facts, the law, and their consciences how best to vote in order to ensure a just outcome. 
To stack the jury with people who will ignore their consciences on command and to instruct the jury falsely they are required to uphold the law as the judge instructs them amounts to de facto jury tampering under color of law. This undermines the fundamental purpose of trial by jury, which is to be an independent body empowered judge both the facts and law, and to stand as a protective bulwark shielding individuals and our rights against government.

Mark Daily, is running for Mayor, City Coos Bay, November 2016. Replacement of waste water treatment plant #2 is on the table. Mark’s issues revolved around two concerns. One,  user rates, fees. Two, best available technology for quality of water discharged into the Bay. 

DEQ, promotes lower standard of discharge quality currently available in the industry as of 2016.  13 years, City Staff proceeded to design a plant of a lower standard, than best available technology, DEQ meets minimum NPDS permit standards, and is offering to in-debt the Citizens of Coos Bay with a one percent loan of 26.1 million to build this lessor quality plant. 

Yes, most of the City Councils members over the 13 years said yes, voting in a fee structure in the summer 2009, and in 2013 a resolution for a 20 year fee schedule at 6.5 percent. 2015, it was pointed out to the Council, 6.5 percent increase, each year going forward would be overwhelming, burdening rate payers.  Several members of the Council acquired magnifying glasses, and started viewing the waste water plant construction plan and fees.

 It soon became clear the current plan cost were high, water discharge quality of a lessor standard, and the sewer fees were designed to pay those high cost.  The seven member council, including Mayor became divided in their views. These two issues, fees, necessary to support cost, and quality of discharged waste water, on one side, and the other side, just move on with the plans as are, with money from DEQ. The Council was split.

 Is there a way to decrease escalating fees and improve discharge, in the short term, 20 years? Yes, privatize the whole operation. Attorney Report, “ Viability of Privatizing”. Currently, a plan called, a DBFO, where a private partner, designs, builds, finances, operates, City owns plant, a shoe, fitting most Councilors foot.

 DBFO, can provide cost saving for rate payers. The DBFO bid process, open to all, meeting the specs of the bid, not limited to bidders from the state of Oregon.

 Mark Daily proposed motion to the Council to initiate a privatized bid for plant #2, to have a comparison of the current project. He then went a step further to make a motion to start this same process, privatized bid on Plant #1, soon, to be required to meet new NPDES permit standards, requiring plant upgrades. Motion did not pass?

Cowardly Vandal Destroys Property of Another Individual Mocks Trump Campaign

Subject: Anti-Republican Vandalism at Old Cedartree in Florence

This morning, Labor Day, 2016, Duke and Trish Wells, owners of Old Cedartree Woodworking came to work to find yet another work of vandalism against their support of Donald Trump.  This time, instead of just throwing their Trump signs in the street and driving over them,(see picture) a slingshot was used to break the window holding the large Trump sign.  This large, bay window in the front of the store has been in their shop, with its matching windows for 30 years.  The hole is in the upper left and the entire window will have to be replaced.

Duke and Trish have offered their shop as a place to pick up Republican campaign signs and a place for patriotic rallies for the last many years.  We need to support them by funding the replacement of the window.  They feel this is violent intolerance encouraged by democrats and they will not stop supporting the candidates they feel can help get our country back. 

As a fellow Republican, grateful for Duke and Trish's courage and patriotism, I urge you to support them in this effort. Brief Explanation on How Oregon Became a Sanctuary State for Illegal Immigrants

   Most Oregon County Sheriff’s Offices adhere to an Oregon law (ORS 181.850) enacted in the 1980s that prevents local law enforcement from enforcing federal immigration laws. A 2014 federal court ruling, Olivares v. Clackamas County, upheld the plaintiff’s Fourth Amendment rights protecting citizens against seizures and also ruled that ICE detainers are administrative requests and not mandatory. Based on this ruling, most county jails only holds a foreign-born person based on local charges, probable cause holds or federal judicial warrants.

PUBLIC SAFETY PERSONNEL GENERALLY
181.850 Enforcement of federal immigration laws. (1) No law enforcement agency of the State of Oregon or of any political subdivision of the state shall use agency moneys, equipment or personnel for the purpose of detecting or apprehending persons whose only violation of law is that they are persons of foreign citizenship residing in the United States in violation of federal immigration laws.
(2) Notwithstanding subsection (1) of this section, a law enforcement agency may exchange information with the United States Immigration and Naturalization Service in order to:
(a) Verify the immigration status of a person if the person is arrested for any criminal offense; or
(b) Request criminal investigation information with reference to persons named in service records.
(3) For purposes of subsection (1) of this section, the Bureau of Labor and Industries is not a law enforcement agency. [1987 c.467 §1]
Note: 181.850 was enacted into law by the Legislative Assembly but was not added to and made a part of ORS chapter 181 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
 
Oregon is the only state that has a law specifically limiting the extent to which state resources can be used to enforce federal immigration laws.

Hey Folks,

During the last election cycle I was contacted by Attorney Daniel M. Hinrichs about a Coos county judicial candidate, Ryan Hughes.  It was about some personal issues that was allegedly plaguing Hughes.  Even candidates should have to be considered innocent before proven guilty and it did not rise to a level of real concern. 

Also, he was never charged for any crime or misconduct in his capacity in any official position, but the mere perception created by his opponents may have cost him the election.  The following is the email thread between me and Mr. Hinrichs.....Rob T.

Are you interested in reporting on one of the Judicial candidates that has several criminal convictions (Oregon and Iowa) and is currently on probation?  He did a fluff piece in The World, but it does not accurately represent the behavior he engaged in that led to his conviction.  He is currently on probation for the convictions out of Lane County, and he should not be judge.

Do you have a link to the article?  I'm having no luck hunting it down and really have not been paying much attention to that race.  A DUI would not be a reason to disqualify anyone from judgeship, but it would be something to look into if there was a pattern of criminality and a background story. 
 
However, I would be more interested in this persons stance on the issues and how they would conduct themselves on the bench than I would be about some personal problems.   In some cases, the leaders who show no human emotions and who have not lived a varied life may be more detrimental than someone who has lived a little.  
 
By the way, who are you supporting and why?

I will send you a copy of the printed article, the police report- which is egregious, and some associated stuff.  I am supporting Megan Jacquot because she is the most experienced and has the best temperament for the job.  I would not be offended if Inokuchi won- I just think Jacquot is better.  I do have a problem with a convicted criminal who “quit” his job at the DA’s office becoming our next judge.  The Oregon Code of Judicial Conduct prohibits a judge from being convicted of a crime or doing anything that would reflect negatively on the office.  Coos County has a strong history of very good judges.  Mr. Hughes was convicted of reckless driving and recklessly endangering- “A” misdemeanors- for driving at a high rate of speed, swerving around people, hitting another vehicle and forcing it off of the road, and then speeding away without stopping.  He’s just lucky that no one was injured.  That type of behavior should disqualify him from being judge.  The fact that he claimed he didn’t know he was in an accident should raise serious doubts about his credibility.

Please send what you can, because some close confidants have expressed their concern for the legitimacy of this candidate.  Yet, others like this person's policies. I do not know this person, but it is starting to become a very intriguing issue and yes there should be a standard for judgeship.  Of course, I like to determine the case based on its own merits.   
 
Hey, If the law states a person convicted of a crime cannot be a judge then how did the candidate's filing fly by the County Clerk and SOS?  Do they know and can someone file an injunction to the candidacy?

There is no prohibition, as far as I can tell, on someone running for judge with a conviction.  Once he’s elected, perhaps the judicial fitness committee might investigate.  If a sitting judge was convicted of these crimes, with these facts, I am certain that judge would be investigated and sanctioned.  I will try to scan what I have and attach to this email- except the World article which I don’t want to reproduce due to copyright issues.  The World article from March 29 is:

Perhaps you are among the 4,356 Coos County folks who voted for Ryan Hughes, a recent candidate for Circuit Judge, and you were wondering what happened as a result of the demand for disciplinary action matter that was before the state of Oregon Bar Association (OSB) during the election. 
 
The OSB disciplinary committee acknowledged receipt of such demand from an anonymous Coos County lawyer regarding Hughes personal, not professional, conduct prior to the campaign and election. 
 
Most adults in Coos country, legally or not, recognize a series of three numbers followed by two numbers followed by four numbers as a US government issued social security number.  There is no greater prize for an identity thief than name and related SSN.  Many believe that there are no act that is intended to destroy a person’s personal life worse than to release their name and SSN intentionally or carelessly. 
 
Until a couple years ago, many of us were walking around town with wallets containing cards (social security, Medicare, veterans administration, employee ID, etc.) clearly showing our name and SSN waiting for that number to be stolen.  Twenty five years ago it was common practice for banks, government bodies, creditors, etc. to put us in jeopardy by placing our SSN on court documents, pay checks, medical bills, medical records, credit card bills, and other every day documents. 
 
So it was many years ago that a record of a $20 fine ($34 in today’s buying power) by an Iowa court assessed against Hughes, then a typical college student, was released.  It was reported that a Coos County lawyer acknowledged disseminating copies of that document to the public with the SSN not redacted; apparently, as reported, he was unaware that a series of three, two and four numbers was a SSN. 
 
Concurrently, a slithering individual claiming to be a local lawyer in fear who must write anonymously contacted the OSB.  That person demanded action that would place Hughes license to practice law, and his livelihood, in jeopardy. 
 
Unlike state agencies that summarily reject anonymously written letters, the OSB acts on every inquiry received.  For many months the Hughes matter has been thoroughly investigated by the OSB disciplinary committee.  OSB findings have been published.  Absolutely, positively, no action against Hughes was deemed appropriate.  Anonymous was unable to destroy a life.  Too late – the damage is done; Hughes is gone; chased away to Harney County.

Please, is the matter closed?  Did the Bar investigation result in any disciplinary action?  Or, were claims from an anonymous (alleged) Coos County lawyer dismissed?

City of Coos Bay at a turning point. The long standing practice of taking a cut of the user fees to fund City operation may be in jeopardy. What! Probably you have heard that the Coos Bay Waste Water Plant #2 has been in upgrade planning mode for 13 years.

A waste water, user fee, payment structure was voted into practice in 2009, by the City Council, on the recommendation of City Staff, and other paid consultants. Those fee increases are moving up each year at a six and one half (6.5%) percent increase into the future.

Turns out, the cost of the city paying for the upgrade (total rebuild is required) is horrendously expensive, and the water discharge into the bay is a lower standard, by not using the best technology available.

Four of the current councilors said enough. Surely we can get bids for lower cost for a new plant. That could even lower our user fees. How?

Current method, city staff has proposed, to continue to want to design, finance, build, operate and own the plant. Using user fees to fund, all the wastewater operations.

What if? As clearly determined in the Council Wastewater Treatment Committee Meeting held at City Hall, Council chambers, August 12, 2016, 9 AM, the Coos Bay City Council can decide to go out for bids for a Privatized Waste Water Plant #2 upgrade.

OH! Of several options in the privatization concept, one is called a DBOO, which means the private offer, will be something other than the City of Coos Bay. The private Entity will Design, build, finance, operate, and own the plant.

Then it would be clear, this waste water plant owner, in their bid, would tell the City how much it will cost the users, so clean water can be discharged into the Bay. This will certainly help all to understand and see what their user fee is being used for.

This is very simplistic concept, and the City Council can request bids from private providers who would like to Design, build, finance, own, and operate a Waste water treatment plant here. The Council can compare the current 13 year proposal, and the new concept to see which is best for the future of the users, and the community at large.
