Keep Out Of My Computer!

There is a vote scheduled in the Senate for later this week  concerning our digital privacy.

Democratic Senator Patrick Leahy has been back and forth on  the revision of a 1980's security bill and it is unknown what he may bring to  the table when it is ready for voting. First he submitted a proposal saying a  search warrant was required for agencies to access private email, twitter,  Facebook, and Google accounts.

  Then with pressure  from law enforcement such as the National Sheriff's Association he changed his  proposal saying a search warrant would not be required to access these private  accounts. After extreme criticism from the general public Leahy made a  statement saying he would not support warrantless access to private EMAIL.

 Although he and his committee have addressed that they will  not support warrantless email access. They have not mentioned whether or not  they will still support warrantless access of Twitter, Facebook, and Google  accounts.

The amendment Patrick Leahy is working on is an attachment  to the Bill H.R. 2471 which has already been approved by the House of  Representatives.

 The Center for  Democracy and Technology said, "We wouldn't support the rewrite described  in CNET(Where the story broke)." This coalition who made the statement is  made up of Amazon.com, Apple, Facebook, IBM, Intel, EBay, Google,  etc. These  are currently some of the most powerful companies in the world.

 Leahy's proposal  would have given over 22 agencies access to citizen's private email, Facebook, Twitter, and Google accounts without obtaining a search warrant. Some  exceptions in the Bill would even allow the FBI and Homeland  Security access to  your private accounts without notifying the owner or a judge. This is a direct  violation of the Fourth Amendment of the United States.

 Fourth Amendment - Right To  Privacy

"The right of the  people to be secure in their persons, houses, papers, and effects, against  unreasonable searches and seizures, shall not be violated, and no warrants  shall issue, but upon probable cause, supported by oath or affirmation, and  particularly describing the place to be searched, and the persons or things to  be seized."

Last year Leahy boasted that his idea "provides enhanced privacy protections for American  consumers by... requiring that the government obtain a search warrant."  Now we do not know what Senator Leahy supports or what he will bring to the  table, but we can stop it before it happens.

 As Leahy is currently back and forth on his proposal  reflects his shaky record of privacy. He has blocked law enforcement's efforts to  gain access to  private computers and has also passed a law helping law  enforcement gain access to private accounts which did not protect our civil  liberties.

  The American people already do not trust our Government.  There are tons of conspiracy theories out there saying the Government can  listen in on conversations, see through your web cam, look at you from a  satellite, pick up on key words in text, and many other ideas that could be  true or could be completely made up. If there was a law passed that gave the  Government access to private accounts there would be no question whether or not  it was going on. People enjoy privacy, they always say you never know who your  neighbor really is and you never should.

 Our Fourth Amendment was written to protect  our right to privacy and will be protected until there is probable cause for which  a search warrant will be obtained. If no one has done anything wrong, leave  them alone. People could have absolutely nothing to hide but that does not mean  they want someone snooping around their private life. There are countless  reasons why this is an extreme violation of privacy. It could be because of you  work, relationship,  ideas, pictures, whatever the case may be that is your  business not the Government's.
