HI,
Many people think I speak and write only for the rights of miners and dredgers. Please, please read the following and understand that I am trying to fight for our RIGHTS and FREEDOMS that are ours, not just a privalige, but a right. Life, liberty and the pursuit of happiness, 2nd ammendment, etc. We all need to stand together to stop this bill. I don't care if you don't live in Oregon at this time, you might have lived here or you are hoping to live here. Contact these congresspeople and tell them to vote NO on this bill. This bill can and will affect hunting, fishing, camping, picking mushrooms, hiking, day trips, etc.
One thing to bring up over that way is that SB 401 will impose a scenic easement down the Chetco that will extend for 1/4 of a mile on both sides of the river. Oregon Department of State Lands will become
the authority inside that 1/4 mile area and will regulate any activity that is not conducive to the so-called "scenic value" of the river. An explanation is found in the bill, which reads in part:
"'Scenic easement' (defined) the right to control the use of related adjacent land, including airspace above such land, for the purpose of protecting the scenic view from waters within a scenic waterway; but such
control does not affect, without the owner's consent, any regular use exercised prior to the acquisition of the easement, and the landowner retains the right to uses of the land not specifically restricted by the easement."
People in Galice live under such an easement and let me tell you, they are NOT happy. While it may sound
completely reasonable to some people to live inside such easements, "regular use" constitutes what DSL says it is and what is "publicly acceptable".
For example, with the declining economy, more and more people are planting gardens, keeping chickens and livestock, switching to wood heat. People who live inside of scenic easements will find that DSL are not
going to be very receptive to land owners building chicken houses, fencing land, building a toolshed, piling firewood, cutting down brush to plant a garden, etc.
Much the same way, some people in Galice have raised the ire of varying agencies for parking an old car or camp trailer on their property. Some have had trouble performing work on their property, especially when it involves digging up the property. (Septics, replacing water pipes, etc.)
Under such scenic easements, what you get is varying government agencies always imposing their will upon the property owner for the simple fact that it erodes property rights.
Here over my way, the easement will go right up the Rogue and right through Grants Pass, Rogue River and Gold Hill. I can't actually see the river from my place, but I am within that 1/4 mile.
Needless to say, SB 401 is a very serious
bill.
