Mr. Kirby,

Thank you for your recent inquiry regarding the Oregon's Counties: 2012 Financial Condition Review report. The statement you have made inquiries about is a summary of information provided by the Board Chairman, Mr. Fred Messerle. The following  excerpt was taken from the response, provided Mr. Messerle, to our draft report
and provides more context.

"So faced with the inability to raise local revenues until we have a better economy and the continuing decline in resources available from the state and federal level we can do the following: 


1.            Become as efficient as possible, but cost savings will not be enough to balance our budget

2.            As any entity facing insolvency, we will need to liquidate assets to pay our expenses.

First would be the drawdown of cash and liquid reserves

Second would be liquidation of the forest stumpage inventory

Third would be the sale of county owned real estate including forestland, parks, buildings, etc.

Fourth would be the return of all required responsibilities to the State of Oregon."

This week: In Greek mythology the legendary architect, Daedalus, built the labyrinth, an incredibly complex maze of twisting passageways to house the Minotaur—a horrible monster that was half-man, half bull.  The Greek Hero, Theseus, decided he would kill the Minotaur and put an end to human sacrifices. Except even if he did find and kill the Minotaur, he knew the Labyrinth was so complex he would be lost forever. Thank you for taking time out of your busy day to talk with me yesterday.  Here is the link to the Forest Service DEIS:  http://www.fs.fed.us/nepa/fs-usda-pop.php/?project=34220p The comment deadline is 12/10.  Our rally is planned for Saturday, 11/17 from 1 – 4 at Riley Ranch, 93507 Riley Ranch Lane, North Bend, OR.  97459. Starting at noon we will give away t-shirts to the first 200 people.  We will also be providing free lunch and conduct a raffle drawing for prizes including a Go Pro Hero 2 and a small block Chevy BBQ.  So far, we have about 140 people who have RSVPd.  We were told by the Blue Ribbon Coalition that we would need around 500 people.  I am still trying to figure out different ways to market it to people to get them to come!  We have three keynote speakers planned: Coos County Commissioner Bob Main, Coos County Sheriff Rod Roberts, and Salem Sand Club President Chris Arnett.  The Blue Ribbon will be in attendance (Don Amador).  I have attached a flyer for requesting comments and my comments on the DEIS. Please let me know what other information might be helpful to you.  I have told my colleague to keep his calendar clear on 11/24.  He hasn’t responded yet, but I think we definitely will want to take the opportunity to be on your show.  If you could provide me the contact info for Sharon, Tim, and Bonnie in Coos County which we discussed that would be very helpful to exchange information with them.

The Gun Owners of America is a no compromise group when it comes to the rights of the Individual to own Guns. Well, Sen. Wyden is in cahoots with anti-gun Senator Jon Tester and they are trying to fool the American public with the Sportsman Act of 2012 or SB3525.


These Senator’s are trying to convince sportsman that this bill will grant them more access to public lands.  However, the Bill increases the ability of the government to acquire more land from the private market.  They are exploiting the members of the NRA and other hunting groups, who may not know any better.  Please, if you see this bill being promoted by anyone, let them know the real agenda in this legislation.

Senate to vote on the Federal Land Seizure Act on Thursday

 Senator Jon Tester (D-MT) -- who is “F”rated by Gun Owners of America -- is pushing a “hunting” bill that authorizes the Obama administration almost unlimited power to seize private lands for“environmental” purposes.
 
Anti-gun Majority Leader Harry Reid has scheduled Tester’s bill for a vote, and it will probably take place on Thursday.  
  
ACTION:  It is imperative that gun owners contact their Senators and ask them to OPPOSE S. 3525.  Click here to tell them that the modest conservation gains allowed in the bill are totally offset by giving unelected
bureaucrats the authority to steal land from hunters and private property owners.

 
BACKGROUND  
(1) When the “wetlands” provisions of the Clean Water Act were originally enacted, no one could have foreseen that a landowner would go to prison for applying clean dirt to a junkyard adjacent to a sewer, which was determined to be “wetlands.”  But environmentalists have been brilliant in taking seemingly innocuous programs and massively expanding them through fraudulent interpretations or tiny loopholes.
  
(2) S. 3525 has “sweeteners.” It allows archery bows to be transported through national parks under very limited
circumstances, although Obama could do this by administrative fiat.  It also allows, but does not mandate, Pittman-Robertson funds to be used for target ranges. But none of these small discretionary provisions offset the potential damage this does to the rights of individual landowners.
 
(3) THE ISSUE OF LOST OPPORTUNITY:  If this is the Democrats’ sop to gun owners, it may make it a lot more difficult to secure national concealed carry reciprocity or to stop anti-gun measures and treaties.
THE CENTRAL PROBLEM WITH S. 3525 The central problem with the bill is that it allows seizure of private lands for “aquatic habitats” [Sections 201(8) and 204 (d) (2)]. The definition of this term is limitless and includes seizure of lands  in order to “protec[t] the quality and quantity of water sources” and to “serv[e] as a buffer protecting the aquatic environment.” [Section 201 

(2)] Thus, a factory that “pollutes” can be seized to protect an “aquatic habitat.” The only real limit on seizure in
Section 204 is the requirement that the government manage the seized property “in accordance with the purposes of this subtitle.” WHO ARE THE DECISION MAKERS? The National Fish Habitat Board consists of
27 members. The initial members (Obama appointees) select the remaining members.  Thus while the “commercial fishing industry” supposedly has a representative,  you can bet that that fisherman is an Obama-supporter and will support his agenda.
 
The board then enters into “partnerships”  with, inter alia, outside groups. And you can bet that every liberal
environmental organization in the country will now be feeding at this pig sty.  The outside groups recommend fish habitat programs and plans for seizing private lands.
 
Bottom line:  This will give immense powers to unelected bureaucrats -- a clear violation of the Separation of Powers which our Founders implemented as a way of protecting our rights.
 
WHAT ABOUT SECTION 211 (e) (2)?
 
This supposedly requires the consent of landowners prior to having their lands seized. But, note the sneaky loophole: Section 211 (e) (2) applies only to property that is being seized with federal funds and, under Section 204 (e), half the funds need to come from non-federal sources.
 
So while this section is put forward as a “protection,” it actually doesn’t provide total immunity because the government can take a land owner’s property using non-federal funds -- and there is no protection in the bill against that.

On September 11, 2012,  The 11th anniversary of 911.
The Ambassador to Benghazi, Libya was murdered with three others NEEDLESSLY, as the Administration and the State Department clearly denied requests for security and protection for our Consulate.
WHY?
  
A security team was relieved one month prior, even after they requested an extension as the situation was deteriorating with ten Al Qaeda training camps in the area. WHY?
  
When the alert of an attack in progress was sent out, personnel a mile away in the annex, were told to stand down three times and no military help was sent to rescue our Ambassador. WHY?
  
There are statements released before the attack it was peaceful and there was no protest . The Administration watched the attack on a live feed from a drone. The attack was blamed on a you tube video about Mohamed, which provoked a protest at the Consulate. This claim was made for 14 days and included a report to the UN.
WHY?

The Administration would not comment.  WHY?
  
The mainstream Media failed to report on Benghazi, even when there were cables and emails that confirmed the Administration was lying.  WHY?
 
Could this have changed the outcome of the election.. we will never know as the media failed to report. WHY!
  
There needs to be resolve to the families and the American people.
   
There is an outrage across the nation that is building as more are becoming aware of the atrocity in Benghazi.

(Reuters) - An Anglo-German team of astronomers has discovered a new planet  orbiting a nearby sun at just the right distance for an Earth-like climate that  could support life.

 The team actually found three new planets orbiting the star 44 light years  away, but only one of them is in the so-called Goldilocks Zone, the band around  a sun where temperatures are neither too hot nor too cold for liquid water to exist.

ODFW holds public meetings on proposed Eel Lake/Coquille Valley land exchange

ROSEBURG, Ore. – The public is invited to attend one of two meetings in Coos County to  learn more about the Eel Lake/Coquille Valley land trade. Meetings are scheduled for 6pm – 8pm in Lakeside on Nov. 8 and Coquille on Nov. 13.
 
The Oregon Department of Fish and Wildlife will present information, answer  questions and take comments. The Lakeside meeting will be held at Osprey Point RV and Resort, 1050 North Lake Road. The Coquille meeting will be at the Coquille High School’s library, 499 W. Central Ave., Coquille. 

ODFW and Bandon Biota, LLC have agreed to exchange 607 acres of property the agency owns at Eel Lake for approximately  510 acres of wetlands in the Coquille Valley. Agreements are in place to protect the Eel Lake watershed and the city of Lakeside’s water supply. ODFW will work to restore wetlands in the Winter
Lake and Beaver Slough areas to improve habitat for native fish and wildlife.

Bandon Marsh Expansion remains in planning document

 What appeared at first to be good news for opponents of the Bandon Marsh expansion quickly changed to bad news.

 On Sept. 18, the U.S. Fish and Wildlife Service released draft Comprehensive Conservation Plans (CCP) and Environmental. Assessments  (EA) for Bandon Marsh, Nestucca Bay and Siletz Bay National Wildlife Refuges.

The plans describe a vision for the three Refuges and present goals, objectives and strategies for management over the next 15 years.

The CCP had no mention of expansion of the Bandon Marsh, which led opponents to believe that the Service had dropped their expansion plans.

But that didn't happen.

 In early November 2011, the public was invited to participate in the planning process. Preliminary alternatives detailing how the refuge would be managed during the next 15 years were developed as part of the Refuge's CCP process.

And when the CCP was released last week, there was no mention of expansion of the Bandon Marsh.

What actually happened, according to information on the Service website, is that in early February, the USFWS made the decision to separate the CCP for Bandon Marsh from the boundary expansion study.

 "This schedule change allows the CCP to continue on pace and meet the Congressionally mandated due date while allowing more time for thorough analysis and study of the Land Protection Planning (LPP) range of alternatives."

Nothing has changed

On the website, it was learned that the study area that has generated so much controversy in Coos County, particularly in communities that border the Coquille River, has not changed.

The LPP study area continues to be approximately 4,500 acres.

However, priority habitats are limited to about 2,180 acres of bottomlands and adjacent forested habitats within the lower Coquille estuary below river mile 10.4, which is a mile or so below Riverton, according to information on the USFWS website.

Bandon Marsh National Wildlife Refuge, established in 1983, conserves 889 acres of land in fee title ownership within an approved refuge boundary of 1,000 acres.

Spoke with official

The Herald contacted the Portland office of USFWS and spoke to Ben Harrison, Deputy Regional Chief of the planning branch of the National Wildlife Refuge System.

He said the expansion issue is "kind of in limbo until the CCP is completed. But nothing has changed.

 "No work has been done on the land protection plan because we are attempting to complete the CCP at this point," Harrison said.

 "No lands outside of the 4,500-acre study area are being considered for inclusion within the proposed expanded boundary. "The USFWS is gathering information on potential economic and ecological impacts to be evaluated in the LPP. The results of this analysis will be made public," said information put out by USFWS

The website points out that "landowners in the study area in the LPP retain all private property rights, and will not be subject to additional regulations or any searches for threatened or endangered species." That is during the study period.

 A November vote

 Former resident Jill Halliburton of Coquille, who is a leading opponent of the marsh expansion, reminded people that the issue will be on the November ballot as an advisory vote.

 "The outcome will send an important message from our local population," she said.

"The plan has the potential to remove valuable Coquille Valley farmland from our economic base and turn it into marshland.

 "I am unable to comprehend how this project will do more than very short term contribution to the economy, in spite of economic guesses by the folks who want to make it sound good.

 "I also don't see it stopping at the lower Coquille Valley. This is a cancer that will only grow larger and, like a cancer, answer to no one," Halliburton said.

Willing sellers

USFWS continues to point out that their "long-standing policy is to only acquire land from willing sellers. Eminent domain (condemnation) is very rarely used by the USFWS, and we would need a compelling reason, such as a request from the landowner to clear title, to use it to purchase land for the refuge," said a spokesman.

"If the LPP is approved and the Refuge boundary is expanded, landowners within the boundary wishing to sell their lands to the USFWS may do so at a price based upon appraisal if funding is available. Landowners within an approved refuge boundary are under no obligation to sell their lands to the USFWS," according to  information on their website.

It is clear that the USFWS plans to go ahead with their original proposal to study the expansion of the Bandon Marsh well beyond its current boundaries.

 The draft CCP/EAs are available for review through Oct. 22. Copies of the plan are available in the references section of the public libraries in Bandon, Coquille, Newport, Lincoln City, Pacific City and Tillamook.

 "The planning process is a way for the Service and the public to evaluate management goals and objectives that will ensure the best approach to wildlife, plant and  habitat conservation, while providing opportunities for the public to safely enjoy fish and wildlife-oriented recreation on national wildlife refuges," said Lowe.

 The National Wildlife Refuge System has grown to more than 96 million acres, 548 refuges and 37 wetland management districts nationwide.

Dear Oregon Tea Party Patriots,   

We got the wind knocked out of us yesterday. We're tired and frustrated and many want to give up. I get it. I really do. This is our "Valley Forge" moment, and we have a decision to make.

Do we throw in the towel and surrender, telling our children and grandchildren that ours was the generation that allowed their liberties to be stolen without a fight? Or do we pick ourselves up and show these Marxists what we're made of?

As Thomas Paine wrote, "These are the times that try men's souls. The summer soldier and the sunshine patriot
will, in this crisis, shrink from the service of their country; but he that stands by it now, deserves the love and thanks of man and woman. Tyranny, like hell, is not easily conquered; yet we have this consolation with us, that the harder the conflict, the more glorious the triumph
." 

If we give up, our children and grandchildren will suffer under the tyranny of the USSA. I can't allow that to happen while there is still breath in my body to fight it.
